New Armenia: Revolution in the minds as PM Nikol Pashinyan stands up for trans weightlifting champion and against censorship

This was perhaps the most revolutionary speech that Armenia PM Nikol Pashinyan made so far. He stood up for human rights despite conservative hate groups’ backlash against (partial) state financing of the film re Armenian trans weightlifting champion, and offered his unwavering support to Mel. Inspirational and unprecedented for Armenia.

[Of course, there were some problematic wording and passages in his speech, but the key here is to consider the context and view it as a whole.]

There is a huge resistance to the Revolution and its ideals from old regime linked circles. Left without usual source of illegal earnings but still able to utilise their illegal wealth and connections in state institutions and media, they try to sabotage and discredit Armenia’s new leadership.

Since the Velvet Revolution, old regime forces manipulated public agenda by exploiting LGBT rights and putting them against ‘national values’. After months of hesitation and trying to avoid directly addressing any LGBT-related issues, (I hope) government understood that without firmly and unequivocally supporting human rights for all, they simply leave more space for old corrupt circles and their proxies to keep manipulating it more and more, shrinking the space for reforms.

This speech followed another important one against censorship. Finally, Armenia has a PM who publicly confronts calls for censorship/limiting freedom of expression in art, culture etc. I love how he brought up an example of Charents. He could have gone further by quoting Charents homoerotic poetry, but hey, may be next time…

Few days before, a similar statement was issued by the Minister of Education, Science, Culture and Sport Arayik Harutyunyan. This is what I expect from state reps in New Armenia: firm no to censorship without any conditional language. I hope these words will be evidenced in practice.

«Նախարարն ընդգծեց՝ Հայաստանում այլևս չի լինելու սատանիզմի հիմքով, այլ մտացածին հիմքերով համերգներ չեղարկելը: Արվեստը լինելու է ազատ, որովհետև անկախ պետության կարևորագույն գրավականներից մեկն ազատ արվեստն է: Ոլորտի գերատեսչության ղեկավարի խոսքով՝ որոշ մարդիկ, ովքեր փորձում են քաղաքական դիվիդենտներ հավաքել, հետադիմության առաջամարտիկներ են: «Այո՛, մարդիկ կարող են որոշակի սկզբունքներից ելնելով՝ ասել, որ այս արժեքն իմը չէ: Մենք պետք է հարգանքով մոտենանք մեր այդ քաղաքացիներին, այդ խմբերին: Բայց արվեստում ցենզուրա սահմանելն անթույլատրելի է», - շեշտեց նա:

Consider this also within the context of proposed radical reforms in education which are key in changing people’s mentality. Here we are: real issues vs manipulations by old regime and connected with them ARF Dashnaktsutyun party.

As frequently (if not always) in modern Armenia history, Dashnaks are on the wrong side of it. They manipulated this occasion and started actions against the reformist minister but ultimately against the government and PM. They supported hatred, discrimination, homophobia and transphobia under the disguise of fight against educational reforms and for ‘national values’.

Bizarre things happening in Armenia: government (!) advocates against censorship in arts/culture, while some cultural reps argue for censorship; government wants to give universities greater independence re choosing courses, while some students & uni reps prefer having compulsory subjects…

And not to forget the shameful open letter by number of sport federations and sport personalities  against trans weightlifting champion Mel. It is utterly shameful and simply disgusting on so many levels. It illustrates how much hatred, homophobia and transphobia embedded in Armenia sport. To see so many united against ONE? Despicable. I never saw such unity by them for any good cause.

To remind, all those sport federations were (still are) affiliated with old regime reps and oligarchs, including BHK (‘Prosperous Armenia’) party head Gagik Tsarukyan (nicknamed ‘Dodi Gago’). They turned them into corrupt business enterprises to exert influence and keep sport under their control.

Ironically, newly appointed national ambassador for UNICEF Armenia - Olympic champion wrestler Artur Aleksanyan, is among the signatories. And until now, UNICEF Armenia office failed to act on this, instead promoting him further. Also, at least 3 of the signatories were charged over doping scandal. As they say: “գողն առաջինն է բղավում` բռնեք գողին” [the thief screams first - catch the thief]

The Velvet Revolution was an incredible event of historic significance for Armenia when people succeeded to change corrupt illegitimate regime. But in order for the Velvet Revolution to succeed, it needs to get transformed into a revolution in the minds.

Recent events culminated by Nikol Pashinyan’s speech effectively launched that very phase of the Revolution. Difficult road ahead but hopeful if successful - for all Armenia citizens, whether champion or not.

History in the making: for the first time in Armenia parliament, transgender woman addresses the state of trans people in the country

History was made in Armenia on Friday 5 April 2019, when during parliamentary hearings on the UN UPR (Universal Periodic Review - the process of a review of the human rights records of UN member states), for the first time ever, transgender woman Lilit Martirosyan, head of Right Side NGO, addressed MPs, members of Armenian civil society about the state of trans people in the country.

It was a powerful speech, right to the point, very well delivered. As subsequent reactions on Armenian FB and media illustrated, such level of visibility shocked the system. Instead of discussing the content of her speech, the main talking point on FB was the very fact that transgender woman was ‘allowed’ to enter and deliver speech in the parliament.

Parliamentary human rights committee chair Naira Zohrabyan of BHK party was ‘outraged’ by Lilit’s speech, citing ‘agenda hijacking’. She described Lilit’s speech “disrespectful” towards her personally, towards human rights committee and the parliament. Number of activists left the hearings as a protest re Naira Zohrabyan reaction.

What kind of ‘agenda’ you are talking about, MP Zohrabyan? Agenda that includes only convenient for you and your party topics? Agenda that excludes LGBT people from human rights discussions? If this is the agenda you are referring to, then it only deserves being ‘hijacked’.

To remind, Naira Zohrabyan became chair of human rights committee in the Armenian parliament solely as part of their party’s quota. She (and the party she represents) has no comprehension of the notion of human rights whatsoever and should be challenged constantly. They are so at odds with the ideals of the Velvet Revolution.

To complete the picture, suffice to say that following the hearings there were death threats on Armenian FB against Lilit Martirosyan, LGBT rights activists and… flowers for Naira Zohrabyan.

But hey, back to the positive news, well done Lilit !! Big respects !!

“Dear members of parliament, colleagues and guests,

We are making history today. Even a few months ago, it was impossible to even imagine what is today a reality in the post-Revolution Armenia.

I am delivering this speech to you from Armenian parliament podium, as a transgender woman. But I ask you to see me as a collective figure. Being a member of the Armenian transgender community, and the president of the Right Side human rights NGO, I encompass in myself tortured, raped, kidnapped, subjected to physical violence, burned, immolated, knifed, subjected to murder attempt, killed, emigrated, robbed, subjected to stigma and discrimination in social, medical, legal, economic areas and in every aspect of a dignified life, unemployed, poor and morally abandoned, Armenian transgender’s image.

Up until 2018, we have registered 283 similar cases against transgender people, and I don’t know what is scarier - this number or the fact that only a minor part of these cases were registered by the police or by other competent bodies? And if you take the above number “283” as the number of transgender people in Armenia, whose rights were violated, then, for me, it means that there are 283 criminals living next to me and you. And who knows, maybe the 284th will commit their crime just tomorrow. What is also concerning is that people who defend transgender people are also subjected to physical violence and persecution. In just one month, some people had cut the throat of a transgender person and have violently beaten the other one in their own apartment. And completely burned down the apartment including their personal belongings. Think about this, gentlemen.

I call upon you, including the representatives of transgender people, to get involved in the implementation of policies and legislative reforms related to gender equality and ensuring human rights in general. And we are ready to support you in building democracy in our homeland.

Adamantine - gay-themed animated film set in Uzbekistan, directed by Art Arutyunyan

The animation itself is not outstanding, but it’s fun to watch. What caught my attention was the setting and background behind it:

Gay-themed fairytale animation… set in rural Uzbekistan… directed by Armenian-American filmmaker.

Quite a mixture, eh?! Btw, that guy who was turned into a rock in Adamantine looks very Armenian :)) See trailer below.


The official synopsis reads: “In this gay fairytale set in rural Uzbekistan, a young shepherd longs to find his true love; but an evil mountain witch might stand in the way of his happily-ever-after.”

No much information is available about Art Arutyunyan, other than he is a head of production and development at Together Magic Films.

LA-based Together Magic Films produced number of other LGBT-themed films, including trans-themed Funeral, HIV/AIDS-related Undetected and other films, directed and/or produced by Art Arutyunyan (here is a link to his IMDb page).

Says Art Arutyunyan: “We are proud to share LGBT stories that anyone can enjoy.”

His frequent collaborator is a filmmaker Armand Petri (very scarce information about him too, he is mentioned in one article as head of operations at Together Magic Films).

I want to see this film. At least based on trailer and reading about the film here and there, seems worth watching. And it's being showcased in a number of film festivals, including LGBT film festivals.

Hope it will be released soon in London or on VOD platform. And importantly in Armenia too.

NEFUIL: new initiative by Armenian LGBT activist

NEFUIL is an initiative by one of Armenia's well known LGBT activists, Sevak Kirakosyan. It's an acronym that stands for "Nest For Understanding And Improving Life".

Unzipped: Gay Armenia asked Sevak to describe the initiative:

"It all started with struggling to understand my own sexuality. Later I felt like as if I transcended many borders along the way and it all culminates with the foundation of NEFUIL."

For the past 5+ years Sevak has volunteered for LGBT rights and other causes. He used to work and still volunteering with PINK Armenia, the country's leading LGBT rights group, being targeted, along with fellow activists, by various conservative, homophobic elements. Currently he is part of a new NGO to address rights of transgender people in Armenia - Right Side NGO.

The website of NEFUIL (very basic, as of now) has only three offerings so far, and two of them LGBT related.

A short oeuvre, in Armenian, entitled "Holy and Filthy: Homosexuality and Transgenderness in World Religions” reflects how various religions treat homosexuality and gender identity across time and cultures. Sevak stresses that 50% of the income from this sale will be invested back into a new initiative to support LGBT movement and empower LGBT+ individuals in Armenia: ”Most probably we'll make a new fund for supporting LGBT+ individuals thrive".

The other bilingual article (available in English and Armenian) is entitled "LGBT in USSR, ASSR & III RA” [“ԼԳԲՏ Պատմություն. ԽՍՀՄ և Հայաստան”] and “unearths unique stories from USSR, Soviet and modern Armenia, some of which were never told before.”

Says Sevak: ”We hope to establish physical "nests" around Armenia and later in the region to help transform Armenian-Azerbaijani conflict and bring more peace and harmony into the region and the world."

“Women are different”: Celebration of LGBT-inclusive diversity as Armenia’s Feminist Platform marks International Women’s Day in Yerevan

“Women are different” - this was the main slogan Armenia’s Feminist Platform group chose to mark International Women’s Day.

The invitation to join the march was for everyone regardless of age, marital status, sexual orientation, gender identity, disability, whether local or foreigner, from village or city, to “celebrate different ways of being a woman”.

Not every day you see such a public celebration of diversity - for real (!) - in Armenia capital Yerevan, especially inclusive of LGBT people.

Posters during march read: “women are different”, “lesbian”, “bisexual”, “transgender”, “scientist”, “virgin”, “sex worker”, “woman living with HIV”, “cleaner”, “entrepreneur”, “mother”, “single mother”, “model”, “soldier”, “not married”, “footballer / weightlifter”, “woman with disability” [agree with @Mushegh1 re original Armenian term used on poster “հաշմանդամ”] and more…

Of course, as Epress.am reports, not everyone were happy to see such march in the heart of Yerevan:

Most passersby reacted positively to the march and showed interest in what they heard and read. Some people, however, mostly young males, were visibly aggravated by the march and even stopped to inform the marchers that such public actions “are shameful and ugly phenomena.” 

“One might think that women’s rights in this country are totally violated. Who says women have no rights? Sure they do, but that doesn’t mean I should take posters and start protecting people’s rights,” Epress.am reporters overheard one of the young men saying to a female marcher. “These people have the same rights as anyone else. They have the right to freedom of assembly. Besides, the law might provide for equal rights between men and women, but it’s on paper only,” the girl replied. 

The young man was not convinced and proceeded to complain that the marchers were “advocating homosexuality, and that’s not normal.” “I don’t care what they do among themselves, but let them not take to the streets and preach it. They have no right to a family,” he said, adding that “it’s like allowing people to marry animals if they want to.”

Hate crime in Yerevan: targeted in homophobic attack, then mocked by medical staff

2 staff members of PINK Armenia were among 5 LGBT activists who were attacked in downtown Yerevan by 3 young men on 15 February 2016. The case was reported to the police, although I could not find reference to it on police.am website. As per reports, police is very slow to act on this case.

The attackers first targeted and started beating up a person who they perceived as gay.

As if the hate crime in itself was not bad enough, what is equally disturbing is reported attitude of some medical staff at hospital No.1 where the victim of assaults went seeking medical assistance.

Reports say that medical personnel at hospital No.1 did not provide all the necessary medical assistance. Instead, they mocked the victim of hate crime, suggesting carrying out tests to determine his “deviation”.

Five LGBT activists were beaten on February 15 in Yerevan and were subsequently shown disrespect and treated badly by the staff of the Heratsi hospital complex, Public Information and Need of Knowledge NGO (PINK Armenia) executive director Mamikon Hovsepyan told Epress.am Wednesday, branding the incident a “hate crime.” 

The activists, Hovsepyan said, were attacked by a group of 3-4 unknown assailants Monday evening on a central Yerevan street. In addition to beating the activists, the group shouted profanities related to the sexual orientation of one of the victims.  

In the hospital following the attack, the speaker added, the most seriously injured activist was subjected to mockery and ridicule by the medical staff: “Let's get you a blood test and see if you have any abnormalities we could cure,” Hovsepyan cited a staffer as saying. The hospital also failed to conduct a proper medical examination: “They demanded money, otherwise refusing to treat [the victim]. They carried out some external exams, drew up protocols, and discharged him,” Hovsepyan said. The victims have filed a police report in connection with the attack. They also intend to complain against the medical treatment to the Health Ministry.

Հիվանդանոց դիմած տուժողներից մեկին, Հովսեփյանի փոխանցմամբ, շատ վատ են վերաբերվել: «Արի արյան անալիզ վերցնենք, տեսնենք շեղում ունես, շեղումներդ բուժենք», – ըստ Հովսեփյանի՝ ԼԳԲՏ ակտիվիստին ասել է բժշկական անձնակազմի անդամներից մեկը: ՀԿ֊ի նախագահը նշել է նաև, որ հիվանդանոցում լիարժեք զննում չեն անցկացրել. «Ասել են՝ փող տուր, թե չէ հետազոտություն չենք անի: Արտաքին մի քանի զննում են արել, արձանագրություն գրել են, բայց նրան չեն տվել»։

PINK Armenia issued a statement condemning attack that targeted “5 LGBT activists, including 2 staff members of PINK Armenia”.

It is not clear if the attackers specifically targeted LGBT activists. However, taking into account anti-gay profanities shouted by attackers, PINK Armenia rightly considers this incident as hate crime. In their statement, PINK Armenia indicates that the atmosphere of impunity and inaction by Armenian legal system against previously filed but subsequently discarded hate speech instances and threats contributes to increasing wave of hate crimes in Armenia.

In a strongly worded statement Bekum Democracy Support Centre condemned the attack, as well as police inaction and behaviour of medical staff “which violated the available Armenian legislation and medical ethics”. They demanded that police take immediate actions to find the attackers and to hold them accountable according to the law, and for the Ministry of Health to rectify the unacceptable behaviour of the medical personnel. “We call on civil society groups, human rights activists and international community in Armenia to comprehensively follow up the developments of this case.”

Coalition to Stop Violence against Women issued statement condemning culture of violence:

Tangerine: transgender revenge story, intertwined with Armenian storyline

Tangerine was premiered this week in London as part of the London Film Festival.

Transgender revenge story, raw, realistic, filled with elements of comedy and drama, with Almodovar-like touch, and played by transgender people.

Intertwined with that was a story of a typical Armenian family in LA who moved there from Armenia capital Yerevan. Any Armenian will be able to identify at least partly with that family, whether in reference to their own family, relatives or friends.

Highly recommended. And very relevant to the National Coming Out Day.

And to note that this film was shot using an iPhone !! You would never realise that unless you read about it. Great achievement by director and the whole cast and crew.

Following Q&A, I received a poster of the film and asked director Sean Baker and one of the lead actresses Mya Taylor to sign it for me.

“We Are Among You” campaign by LGBT group in Azerbaijan

Via Gay.az, the aim of “We Are Among You” campaign by Azeri group Nefes LGBT (“Free LGBT”) is to send a message to the public in this largely homophobic country that LGBT people are an integral part of the Azerbaijani society.

As part of the campaign, LGBT activists posted stickers “before you, a lesbian [or gay/bi/trans person] sat [or stood] here” in various parts of the capital Baku.

По словам общественной организации «Свободные ЛГБТ» (Nefes LGBT), общество ошибочно полагает, что представители ЛГБТ никогда не жили в Азербайджане и появились в результате изменения образа жизни после обретения Азербайджаном независимости, в результате активной интеграции в Европу.

«Мы, как и гетеросексуалы, являемся неотъемлемой частью азербайджанского общества. Мы не больны, и наравне с гетеросексуалами активно участвуем в общественной жизни страны». С этой целью в различных частях столицы ЛГБТ активистами были расклеены стикеры «До тебя тут сидел гей», «До тебя тут сидела лесбиянка».

Sona Avedian: Former US Marine of Armenian origin chronicles coming out as a trans woman on YouTube

Via BuzzFeed, this personal story of former US Marine of Armenian origin - Sona Avedian, who chronicles her coming out as a trans woman on YouTube.

“I was born in 1982, in a boy’s body,” recalls Sona Avedian. “Ashamed of myself, I hid behind the mask of a U.S. Marine”, trying to “man up”, then marry and start a family [“I met my bride while visiting family in Armenia…"], to live “normal life”…

Feeling isolated and alone, Sona requested to be stationed in Japan for 4 years. It wasn’t until 2001 that Sona stumbled upon the term “transgender” on the internet. Although the discovery was an immense relief, the urge to live a “normal” life was even stronger. “I was taking it to my grave,” Sona recalls.

Finishing up with the U.S. Marine Corps in 2005, Sona worked as a contractor overseas and even started a family. “I thought getting married would help me cope.” […]

In November of 2012 Sona finally came out to her friends and family, making the decision to begin transitioning.

Sona’s parting message: “This is not about passing, it never was. It’s about being YOU, no matter what society thinks – and that is beautiful.”

Armenian trans guy T.J. Jourian named in the Trans 100 (2014)

The Trans 100 is an annual listing of 100 trans individuals from all over the US who are currently alive and active in the work of making the lives of trans people better. It is a curated listing, with nominations from the general public. [FB page] 

The Advocate: The Trans 100 is compiled through a year-long process, which begins with a call for nominations that may be submitted by anyone. This list of nominations is then narrowed by a team of curators, who research the accomplishments of the proposed names and hold them to a list of standards. This criteria entails that a candidate must identify as transgender and work to positively affect the trans community.

The final selectees […] are announced […] on the International Transgender Day of Visibility [31 March], which celebrates the worldwide transgender population and raises awareness of issues related to discrimination.

Included in the 2014 list of Trance 100 is T.J. Jourian, Lebanese-born Armenian and Middle Eastern transmale activist (raised in Cyprus).

He is the author of Hye Trent blog (invited readers only), cast member of the Sundance docu-series TransGeneration (2005)  [Wikipedia page]. “Produced by World of Wonder and aired on the Sundance Channel and LOGO, TransGeneration chronicled an academic year in the lives of 4 trans-identified college students as they grapple with issues of transition, academics, family, relationships, and discrimination.”

There were lots of congratulatory tweets for T.J. Jourian.

Human Rights Watch: World Report 2014 on LGBT rights violations in Armenia and Georgia, silence re Azerbaijan

Unfortunately, no similar section (Sexual Orientation and Gender Identity) is available within the country specific Human Rights Watch report for Azerbaijan. This is regrettable, as in a country with the poorest rights record in the South Caucasus, there is no doubts about violation of rights based on sexual orientation and gender identity too. Subsequently, without more publicity, LGBT rights in the country are moving even more underground and the issue is becoming even less visible while the rights abuses continue in Azerbaijan. Of course, the situation is exacerbated with the lack of active groups such as PINK Armenia (Yerevan) and Identoba (Tbilisi) in Baku.

Armenia

Sexual Orientation and Gender Identity

Local lesbian, gay, bisexual, and transgender (LGBT) rights activists have expressed concern for the alarming level of homophobia in Armenia. According to PINK Armenia, a local rights group, transgender women who engage in sex work are frequently assaulted and receive no police protection when they report abuse. PINK Armenia also reported that the LGBT population continues to experience employment discrimination, obstacles to health care, and physical and psychological abuse in the army, in public, and in families.

According to an August Amnesty International report, government officials frequently condone violent attacks against LGBT people, characterizing the violence as an expression of “traditional values.” In July, the Armenian police made a proposal to amend the code of administrative offenses to establish a fine of up to US$4,000 for promoting “nontraditional sexual relationships.” The proposal was subsequently withdrawn.

Also in July, a Yerevan court convicted two people for damage to property stemming from a bomb attack in May 2012 against DIY, a bar frequented by LGBT and women’s rights activists. Graffiti identified LGBT people as targets of the attack. One attacker was sentenced to 19 months in prison and the other received a two-year suspended sentence. They were both amnestied in October. Local human rights groups expressed frustration that the sentence was too lenient. Armenia does not have hate speech legislation.

Georgia

Sexual Orientation and Gender Identity

On May 17, 2013, a peaceful gathering to mark International Day Against Homophobia was violently disrupted by thousands of counter-demonstrators, including some Orthodox clergy. The day before, the patriarch of the Georgian Orthodox Church publicly urged the authorities not to allow the gathering, calling it an “an insult” to Georgian traditions. Police had to evacuate the LGBT activists to safety, but they failed to contain the mob, which attacked a van carrying the activists, throwing stones and other objects; one journalist was hit on the head and briefly hospitalized. Authorities charged two Orthodox priests and three other men with obstructing freedom of assembly and petty hooliganism. The Tbilisi City Court ordered that charges be dropped against one priest. At time of writing, the trials against the others were ongoing.

Identoba, a local LGBT rights group, reported 34 incidents of violence and intimidation against LGBT people during and after the May 17 incident. The group noted that many victims do not report homophobic violence due to fear of retribution and police failure to investigate adequately.

Nazik Armenakyan’s “The stamp of loneliness” - book launch and multimedia exhibit on life of Armenia trans people

Great report from Yerevan - by CivilNet (AM) - of unique book launch and multimedia exhibit by Nazik Armenakyan reflecting life of Armenian trans people - “The stamp of loneliness”.

Over years, Nazik has been working on LGBT art/photography/multimedia project (see also previous posts on this blog), focusing mainly on transgender and transvestite sex workers.

What makes Nazik’s works outstanding is that she avoids sensationalism, focusing on people, on their stories, an insight she gained access to by the trust of very individuals she portraits.

Many thanks to Nazik for her work, especially considering Armenian realities and circumstances. It’s very telling re the latter that the launch was not public and by private invitations only.

 

Armenia human rights ombudsman uses anti-gay undertones to beg for more money from state budget

Here we are. Not only Armenia human rights ombudsman flirts with neo-nazi but uses anti-gay undertones to ask for more money from the state budget.

Responding to journalists questions, after trying to secure more money for his agency from the state budget, he reiterated his intention to be consistent to get rid of “moral perversion”. Once again, he was referring to trans sex workers and gay cruising area. Exploitation of this issue in Armenia is simply used to fuel anti-gay prejudice and discrimination. Ombudsman knows this pretty well, and wants to re-invent himself as a fighter for “morality”. Ha!

Օմբուդսմենը լրագրողների հետ զրույցում խոսել է նաև Կոմայգու խնդրից՝ հայտնելով, որ իրենք հետևողական են լինելու, որպեսզի մանկական այգին ազատվի այլասերվածությունից։  «Եթե առաջիկա շաբաթներին և ամիսներին չտեսնենք գործընթացներ, դուք նորից մեզնից կլսեք մեր պահանջի մասին»,- ասել է Կ․Անդրեասյանը։

As I mentioned in my earlier post [Scandalous: Armenia human rights ombudsman targets trans sex workers and cites neo-nazi website as a basis for his statement], couple of weeks ago, ombudsman Karen Andreasyan issued a statement full of discriminatory language and references to “morality” as opposed to human rights.

What was worse, as a ground for his statement he cited neo-nazi web site (!) and their article full of homophobia and hatred.

In past, I did have hopes that this ombudsman may have devotion to human rights. But apparently he was simply playing a role at a time when Armenia was seemingly on a path to European integration. Now, with the decision to join Russia led Customs Union, there is no longer need to play a ‘human rights devotee’.

The institute of human rights ombudsman is supposed to be an important body to safeguard human rights of citizens. However, if this institute is led by people like Andreasyan, whether we have such institute or not, will not be making any difference.

Either human rights ombudsman has to be someone who is devoted to the notion of human rights, or I’d say ditch the institute altogether and divert the state budget money to other areas, e.g. pension. I would also advise international human rights bodies and foreign embassies in Armenia to stop taking ombudsman Karen Andreasyan seriously and not wasting their time and resources on him.

He is not an ombudsman. He is a joke.

Nouvelles d'Arménie on discrimination of trans people & LGBT rights violations in Armenia

While Armenia human rights ombudsman, conveniently ‘forgetting’ what his position is all about, targets trans sex workers and uses neo-nazi website to justify his discriminatory statement, the October issue of prominent French Armenian magazine Nouvelles d'Arménie publishes an extensive report on discrimination of trans people in Armenia, with a reflection of LGBT rights violations in general.

Below is a brief outline in English, accompanied by pictures of original French article. Many thanks to Adrineh for translation.

"Denounced by their own family. Banned by an army that considers them mentally ill. Violated and beaten without the police coming to their aid. Armenia is a hostile land for homosexuals, bisexuals, and, a fortiori, for transsexuals and transvestites. Many of them choose exile where they benefit from refugee status."

Then the article mentions a few details of a few of the trans sex workers. These sex workers are violated, beaten but the police don't help them, and in fact, says it's their fault. "Each night, we go out never knowing if we will be alive tomorrow," says Aram. Transsexualism is not recognised in Armenia and even less accepted, liked to a psychological pathology and mixed up with homosexuality.

The article cites PINK Armenia's 2011 survey in Yerevan, Gyumri and Vanadzor: 72.1% of those asked have a negative perception of homosexuality and 71.5% believe the state should take measures to "combat it". They cite a psychologist named Davit Galstian: "There's a real phobia of homosexuals in our society; they are considered like beasts". Also cites an Armenian AIDS Center statistic that "only 2%" of AIDS cases were identified as being "related to homosexual practices".

Next section talks about the work of PINK Armenia: not only promoting sexual health and education, but also protecting the rights of the LGBT community. Head of PINK Armenia Mamikon Hovsepyan is cited. Mamikon mentions that though sex between two men was decriminalised in 2003, thus fulfilling one of the conditions of Armenia joining the Council of Europe and though in 2008, Armenia ratified the UN declaration on sexual orientation and gender identity, no legislation exists today to condemn discrimination, the inciting of violence or hate crimes or [hate] speech against people because of their sexual orientation. This legal vacuum was illustrated in May 2012 with the attack on gay-friendly bar DIY.

This fuelled a rise in violence against the LGBT community, not only by political actors from all sides, overtly oppressive, denouncing them (LGBT) as unacceptable and a menace to Armenian society, but also by religious authorities and local media, which relay messages of homophobic impunity.

The article mentions the Diversity March, 21 May 2012, and the counter-demonstrators who said "Send the homosexuals to Baku" and "Armenia without homosexuals". Article mentions Parada film screening which had to be postponed and finally cancelled because of extremist groups.

"In this context, there is hardly any other choice for many than exile." Article concludes by saying that many go abroad (get a visa for Europe), notably France, get refugee status under the category of being persecuted because of sexual orientation in Armenia.

Scandalous: Armenia human rights ombudsman targets trans sex workers and cites neo-nazi website as a basis for his statement

Apparently, Armenia human rights ombudsman Karen Andreasyan has solved all the pressing human rights issues in Armenia and now calling for the police... to eliminate prostitution and target in particular trans sex workers and gay cruising area.

It is simply astonishing to see the type of language human rights ombudsman is using, full of discrimination and references to the notion of “morality”.

"It is necessary to eliminate such moral perversity because it is not only immoral, but also illegal" - just an example of kind of wording that the human rights ombudsman (!) using in his statement.

It’s as if in past he was at least trying to act in accordance to his position, but now with Armenia’s decision to join Russia sponsored customs union, ombudsman came out the real self, in full disgrace.

Even more scandalous is the fact that as a 'basis' to his statement ombudsman Karen Andreasyan cites neo-nazi Armenian Aryan Union website's utterly homophobic, full of hate link. [see below screenshot and full statement in Armenian - with a reference to the link on hayary(dot)org]

Karen Andreasyan, you are such a loser. You suck. Big time.

Reported hate crime: trans sex workers beaten by group of youth in downtown Yerevan cruising park

Local media reported Armenia police press release that group of youth attacked [“beaten up”] trans sex workers in downtown Yerevan cruising park (Kom aygi, or pleshka) on 25 September 1.10am. Attackers being questioned by police. Motives of the attack were not explicitly stated in the press release. However, the way the info was presented implies homophobic hate crime. No more details are known, as of now.

Interesting to point out the following: 1. police formally reported the incident. 2 police used acceptable non-discriminatory wording to refer to gay people in Armenian “նույնասեռական”, even though the victims may not necessarily be gay per se, but rather trans sex workers. 3. victims of the crime reported the incident to the police.

What would be more important to find out, however, if the attackers will get formally charged with the crime and persecuted according to the law. This will be a testimony of changes, if any.

A few trans sex workers came to the editorial offices of Epress.am earlier this week to protest two recent stories published by local daily Hraparak.

In the conversation which ensued, the guests spoke about their relationship with the police and the consequences of publishing material without verifying the facts, which could very well endanger their lives.

The photos in the video were supplied by the individuals in the photos and are published here with their consent. They did not, however, wish to have their faces visible in the video. The dialogue is in Armenian only.

"I'm the only trans Vika, I did not give any information to the paper Hraparak. I don't know who could've done something like this against me," said local Armenian cross-dresser Vika, commenting on a story published by local daily Hraparak in which a transvestite by the name of Vika threatened a businessman by the name of Hovik. The paper informed Epress.am that the story was prepared on the basis of a telephone conversation. The editors say that a transvestite named Vika called Hraparak and described the incident, which they subsequently published. Visiting the editorial office of Epress.am along with two other gay cross-dressers, Vika Swarovski insists that he's the only known transvestite Vika in Armenia, and those sources who presented themselves as such aim to endanger him.

Epress.am spoke with Hraparak assistant editor Vahagn Tevosyan and asked him to comment on Vika's statement.

"I am officially saying, not only one, but also a few dozen Vika's can contact you and say that they're not the Vika who called you, but we don't insist, that's that trans Vika who contacted you," he said.

"Whoever wrote that, let them prove it; if there's been a phone conversation, let them tell us the number," said Vika, adding that if they don't reveal who did this, he is prepared to take Hraparak to court.

"If they don't clarify who did it, I'll take them to court. I'm ready to complain. The one who presented himself as Vika and the one who wrote the open letter [referring to another story published by Hraparak] are the same person. They invented it and wrote it," said Vika, visibly upset.

"Let him take us to court, but this is all so absurd. What is he going to say, he's going to say that he's not the Vika who called us, and then?" said Tevosyan.

Recall that on Dec. 7, Hraparak published an open letter signed by "a group of homosexuals," which, according to another trans sex worker Lorena Madonna Diva, couldn't have been written by them, since, for example, the Armenian word "hamaseramol" is used in the letter which is a derogatory term. Further, according to Lorena, the statement in the letter that trans sex workers pay $100 to local police in order to work in the Children's Park (near Yerevan City Hall) is untrue. Also, the license plate number of the police vehicle noted in the letter is unfamiliar to them. Note that the community of trans sex workers in Yerevan is quite small and it's unlikely for them not to know each other or that another group of "homosexuals" who also work in the park would have written the letter.

Upon Epress.am's request, Hraparak also commented on the open letter they published.

"The eighth page of our paper is called publication of free speech. There we reserve space for such anonymous open letters," said Tevosyan.

According to Lorena, a targeted campaign has launched against them in the press recently. "They can't cook up anything [new], it began with writing against the Jehovah's Witnesses, then the emos and now us," she said.

"Every day, pedestrians, people, come and assault us, in quite a perverse way, they want us, having an interest, they begin to hit us, drive over us with their cars. We go to the police, but they respond to the case of whoever they can get money from. There are incidents where they beat, they kill in front of the eyes of the police, and the police say, that's too little for you, they have to burn you, pour gasoline and burn you," said Lorena.

Speaking to the two stories published by Hraparak, Lorena denies that any one of them could have written the letter or called in the incident. "Definitely it wasn't one of us, it was those publishers, they improvised. And all this to our detriment, police will get agitated at us, they'll come and shoot us, they'll take us to special departments at the police station, they'll hit us so hard... I know many such cases. Don't I have a right in Armenia, in my country, to express myself freely? I've told the police a thousand times, let's be friends, let's understand each other. They don't want to understand," she said.

Speaking to Epress.am, PINK Armenia President Mamikon Hovsepyan explained the situation: "Perhaps someone called [Hraparak] and informed them, but the issue is you can't generalize and write on behalf of a group. That's unacceptable. With this, they want to create tension between the police and transvestites. By disseminating such inaccurate information and different false opinions, a tense situation is created among the public. Now they're trying to attune the public against transvestites, endangering the lives of the members of this vulnerable community."

Hovsepyan noted that the Human Rights Defender isn't engaged in such issues. "They cover up the complaints; they don't even include them in their annual reports. When incidents happen, they don't appeal to the Ombudsman — they've lost hope." [...]

Էռնա, Նատա, Կատյա, Էլյա, Լորենա, Լայմա, Վիկա, Քրիստինա, Սիլվա…

Սրանք այն տրանսսեքսուալներն են, որոնց ես անձամբ ճանաչում եմ, որոնք իմ ընկերներն են, ծանոթներն ու Հայաստանի Հանրապետության քաղաքացիները: Շատ-շատերը կան, որ չեմ ճանաչում: Նրանք ներքուստ մի սեռի էության զգացողություն ունեն, սեռական ու սոցիալական վարքագիծ՝ հակառակ սեռի մարմնի ու սոցիումով պարտադրված դերի մեջ բանտարկված, ու սեփական երկրում չունեն սեռափոխության վիրահատություն անցնելու հնարավորություն:

Բոլորս էլ սխալական ենք, այդ թվում նաեւ Աստված:

Մենք գետերի հուներ ենք փոխում, տափաստաններ ենք ծաղկեցնում, մենք դեմքեր ենք «հավաքում» մեզ դուր չեկած սեփականների տեղ, արհեստական ինտելեկտ ու բանականություն ենք ստեղծում ու օգտագործում, մենք հսկայական հեկտարներով գենետիկորեն փոփոխված բույսեր ենք աճեցնում ուտում, արհեստական արեւային վաննաներ ենք ընդունում, մենք երեխաներ ենք ստանում կոլբաների միջից, շուտով երեւի արհեստական մարդ էլ կկլոնավորենք…

Աշխարհում ամենուր մարդիկ սեռ էլ են փոխում, բայց ոչ Հայաստանում: Ինչո՞՚ւ մեր սիրելի դերասանուհի Շերի դստեր որդի դառնալը մենք ընդունում ենք, բայց մեր մեջ ապրող տրանսսեքսուալների նույն սեռափոխությունը հայերիս թվում է սրբապղծություն, իսկ օրենսդրական բյուրոկրատական ապարատն ու հնացած բժշկական մոտեցումներն այն անհնար են դարձնում Հայաստանում:

Տրանսսեքսուալիզմը (փոխսեռականություն) շատ երկրներում դասվում է գենդերային՝ սեռական իդենտիֆիկացիայի՝ նույնականացման հիվանդությունների շարքին, որի միակ բուժումը սեռափոխության վիրահատությունն է: Հայաստանում, ցավոք, դա հնարավոր չէ իրականացնել: Մեր տրանսսեքսուալները սեռը փոխելու համար պետք է դիմեն զանազան խորամանկությունների, քանի որ մեզ մոտ չկա ո´չ օրեսնդրական, ո´չ առողջապահական հիմք այդ կարգի վիրահատություններն օրինական դաշտում իրականացնելու համար:

Նրանք պետք է գնան արտասահման, օրինական կամ զարտուղի ճանապարհներով, երկար ճանապարհ անցնեն նախ քաղաքացիություն ստանալու համար, հետո էլ զանազան հոգեբանական հետազոտություններ անցնեն, փող գտնեն հորմոնային թերապիայի ու վիրահատության համար, և եթե ամեն բան ստացվի, փոխեն սեռը` համապատասխան իրենց գենդերային ինքնազգացողության ու հետո առհավետ մոռանան հայրենիք վերադառնալու մասին, քանի որ փաստաթղթեր չկան. այստեղ նրանք ոչ ոք են՝ ոչ էն սեռի են, որով գնացել են, ոչ էլ նոր:

Պարզվում է` մենք ունենք օրենսդրությամբ նախատեսված այսպիսի մի կետ.

Հոդված 70. Քաղաքացիական կացության ակտի գրառման մեջ ուղղում կամ փոփոխություն կատարելու մասին ՔԿԱԳ մարմնի եզրակացությունը Քաղաքացիական կացության ակտի գրառման մեջ ուղղում կամ փոփոխություն կատարելու մասին ՔԿԱԳ մարմնի եզրակացությունը կազմվում է հետեւյալ դեպքերում.

գ) Հայաստանի Հանրապետության օրենսդրությամբ սահմանված կարգով բժշկական կազմակերպությունը տվել է սեռի փոփոխության մասին սահմանված ձեւի փաստաթուղթ:

Այստեղ խնդիր է ծագում արդեն բժիշկների հետ: Ողջ աշխարհում տրանսսեքսուալիզմն ախտորոշվում է մեկ-երկու տարիների ընթացքում, որի ընթացքում մարդն ապրում է իրեն ցանկալի գենդերային դերում: Հետո, եթե այլ հոգեբանական շեղումներ չեն գրանցվում, ախտորոշվում է տրանսսեքսուալիզմ: Հայաստանում այդպիսի բժշկական հաստատություններ չկան: Այստեղ մաքսիմում կարող են ուղարկել կարիոտիպի անալիզի, հետազոտել քրոմոսոմային կապերն ու ըստ դրա որոշել` բիոլոգիապես կի՞ն է, թե՞ տղամարդ, թե՞ երկսեռ է: Նույնիսկ այդ դեպքում պլաստիկ վիրաբույժն իրավունք չունի վիրահատելու. օրինական թույտվություն չունի, չեն տալիս: Իսկ եթե քրոմոսոմները չունեն երկսեռական կապեր, ապա մարդուն ուղղակի ուղարկում են հոգեբույժի մոտ` «բուժվելու» ու «նորմալ» մարդ դառնալու:

Մեր բժիշկները կամ չգիտեն, կամ չեն ուզում իմանալ, որ երկսեռն ու փոխսեռը տարբեր բաներ են: Ողջ հանրապետությունում չկան մասնագիտացված էնդոկրինոլոգներ ու հոգեբույժներ, ովքեր կարող են տալ այդ ախտորոշումը:

Նորայրը տղամարդու իր էությամբ գոյատեւում է կանացի մարմնի մեջ: Նա շատ երկար ճանապարհ է անցել, փնտրել է հոգեբաններ, այլ ինստիտուտներ, որտեղ կարող է անցնել այդ հետազոտությունն ու ստանալ փաստաթուղթ, որ նա տրանսսեքսուալ է ու իրավունք ունի վիրահատվելու: Ժամանակին կապվել է Մոսկվայի քաղաքային հոգեբանության ու էնդոկրինոլոգիայի կենտրոնի (այդ կառույցը եւ Ռուսատանի մի շարք այլ կառույցներ իրավասու են տալ այդպիսի փաստաթուղթ ) ղեկավար Ստեփան Մաթեւոսյանի հետ: Նա ասել էր, որ Հայաստանում նման ինստիտուտ չկա, բայց ուզում էր բացել: Որոշ ժամանակ անց ասաց՝ քանի որ նման մարդիկ Հայաստանում քիչ են, ապա ինքն էլ դրանով չի զբաղվում:

Երեւանում Նորայրը հանձնել է կարիոտիպային անալիզ, որը ցույց է տվել կանացի քրոմոսոմային կապեր: Նրան ասել են, որ ինքը բիոլոգիապես կին է, եւ էնդոկրինոլոգը նրան խորհուրդ է տվել «բուժվել» սեքսոպաթոլոգ-հոգեթերապեւտ Վրեժ Շահրամանյանի մոտ, որը չգիտես ինչ բժշկական մեթոդներով հանձն է առնում «բուժել» ողջ ԼԳԲՏ հայությանը: Երբ Նորայրն ասել է, որ Առողջապահության համաշխարհային ասոցիացիան վաղուց է հանել տրանսսեքսուալիզմը հոգեկան հիվադությունների շարքից, ու ինքը նման բուժման կարիք չունի, բժիշկը հասկացել է, որ նա քաջատեղյակ է, եւ ի պատասխան դրան` առաջարկել է մեկնել Ռուսաստան` ասելով, որ Հայաստանում այլ բուժման ձեւ չկա:

Հիմա Երեւանից ու Հայաստանից հույսը բոլորովին կտրել է, բայց արտերկրում էլ, եթե երկրի քաղաքացի չես, շատ բարդ է այդ ամենի իրականացումը: Կարող ես միայն մեկնել Թայվան կամ այլ երկիր, ուր անլեգալ կատարում են նմանատիպ վիրահատություններ: Ասում է, որ մենք իրավականորեն ունենք այդ կետը, որով կարելի է անձնագիր փոխել: Ասում է նաեւ, որ մեր բժիշկները տգետ են, ու քանի որ եթե ունես բժշկական փաստաթուղթ, բայց ձեւը պարզ չէ, ու պարզ էլ չէ, թե ումից կարելի է պարզել, նրանք մի մասնագետից մյուս մասնագետի մոտ են ուղարկում մարդուն:

Մեկը մյուսից տեղյակ չեն, բժիշկները հղում են տալիս օրենսդրական բացերին, օրենքն էլ ասում է՝ բերեք բժշկական փաստաթուղթ: Բժիշկներն էլ ի՞նչ կարող են տալ, եթե անգամ տրանսսեքսուալիզմն ու հերմոֆրոդիտիզմն իրարից չեն տարբերում: Եթե քեզ մոտ XX46 է, անկախ նրանից դու քեզ ինչ սեռի ես զգում, դու կին ես ու վիրահատության կարիք չունես: Վիրաբույժը վերջինն է այս շղթայի մեջ, նա չի կարող որևէ բան անել առանց օրինական թույլտվության ու հոգեբանի, էնդոկրինոլոգի ու սեքսոպաթոլոգի եզրակացության:

Միջազգային պրակտիկայում ընդունվել է F64.0 տրանսսեքսուալիզմ ախտորոշումը, իսկ Հայաստանում ոչ մի կառույց դա չի անում: Նորայրը դեռ ոչ մի հայ բժշկի չի հանդիպել, ով գիտի, թե իրականում ինչ է տրանսսեքսուալիզմը: Նորայրը հարցի մասին բավականին ինֆորմացիա ունեցող գրագետ մարդ է, բայց չէ՞ որ կան այնպիսիները, որ չգիտեն ոչինչ, վաղ հասակում են դիմում բժշկի, նրանց սխալ ուղու վրա են դնում, ուղարկում «բուժվելու», համարում են հոգեկան հիվանդ` դրանով իսկ առավել բարդացնելով նրանց բաժին ընկած առանց այդ էլ դժվար կյանքը…

Նորայրը կարծում է, որ սեռափոխության վիրահատության մասին խոսելիս պետք է ամենավերջում անդրադառնալ վիրաբույժներին: Մինչեւ նրանց հասնելը շատ բան կա մեզ մոտ, որ պետք է անել:

Մենք Նորայրի հետ միասին փորձեցինք ինչ-որ բանից սկսել, ինչ-որ քայլեր անել, որպեսզի կարողանանք իմանալ, թե ինչն է անհնարին դարձնում նման վիրահատությունների իրականացումը Հայաստանում, եւ ո՞ւմից ի՞նչ ենք պահանջում:

1. Պետք է բժշկական ուսումնական հաստատություններում, ուր ամեն ինչ շատ հին է, սկսած դասագրքերից վերջացրած «սովետական» դասախոսներով ու մենթալ հայկական բարքերով, ուշադրությունը սեւեռել գենդերային նույնականացման գիտական մոտեցումների ու խնդիրների վրա:

2. Պետք է բժիշկներին իրազեկել՝ մի խումբ էնդոկրինոլոգների, հոգեբանների ու հոգեվերլուծողների, սեքսոպաթոլոգների ու էնդոկրինոլոգների ուղարկել` միջազգային նորմերին համապատասխան վերապատրաստվելու:

3. Մեզ պետք է կառույց, ինստիտուտ, հիվանդանոց, ուր մարդիկ կկարողանան դիմել, հետազոտություն անցել ու ստանալ ախտորոշում:

4. Պետք են բարձրակարգ էնդոկրինոլոգներ, ովքեր գիտեն, թե ինչ է պետք տրանսսեքսուալներին, ու կկարողանան նրանց ճիշտ բուժում նշանակել, եւ քանի որ սեռափոխությունից հետո էլ հորմոնային թերապիան ցմահ է, կարողանան տրանսսեքսուալներին ճիշտ սպասարկել:

5. Եւ վերջում միայն, այդ ամենից հետո, ըստ բնականոն պահանջարկի կհայտնվեն վիրաբույժներ, ովքեր պատրաստ կլինեն իրենց ծառայություններն առաջարկել:

6. Պարզաբանել ու հստակեցնել հոդված 70 գ. կետում խոսվող «սեռի փոփոխության մասին սահմանված ձեւի փաստաթղթի» ձեւն ու բովանդակությունը:

Եթե առաջիկայում հնարավոր լինի այս քայլերն իրականացնել, բավականին մեծ առաջխաղացում կունենանք Հայաստանում սեռափոխության վիրահատությունները հնարավոր դարձնելու հարցում:
