Russian pop star Lolita thanks gays for her "inner freedom" and proud of being called a "gay icon"

"I am proud that I am a gay icon. I have many gay friends, they taught me freedom, an inner freedom. This is something that in our country and other countries, including America, had never been encouraged. [...]", says Lolita answering the question of Moscow-based famous journalist of Armenian origin Arthur Gasparyan in a TV programme aired on Russian NTV.

'Stop violence’ with... violence. P.S. re recent abuse and violence scandals in Armenia

Starting with the case of that Nubarashen school pedophile teacher, then army and school abuse videos, and then the highly publicised recent domestic violence case, what I noticed - not infrequently - that some people, even among ‘stop violence’ campaigners, in the heat of emotional debate call for lynching of those suspected in abuse or violence. [...]

Let’s take a very recent example of domestic violence in Armenia, that rightly resulted in an outrage, and petition was launched (I supported and signed it) calling for law against domestic violence.

In total, there were 3196 signatures with/without comments, now passed to the prime minister.

A friend of mine disturbed by certain comments posted on the petition 'Armenia Must Pass Domestic Violence Legislation', compiled a list of all of those signatories (28 in total) who "wished bodily violence and death upon the husband and/or mother-in-law of Zaruhi Petrosyan".  He rightly pointed out that “we need to prevent domestic violence, not practice lynch mob rule”. 

It is also disturbing that a person (e.g. petition signatory 3179, screenshot below) would use a slanderous and bigoted term about a sexual minority group to express his anger over a domestic violence issue. This ‘injustice by injustice’ approach totally devalues his own signature.

Armenian gay rights group in LA - GALAS, raised thousands for AIDS Walk Los Angeles


Well done to GALAS members for their successful efforts in raising funds and awareness as part of the AIDS Walk Los Angeles. Many thanks to Haig Boyadjian for pictures. Such a lovely and cute team GALAS!
AIDS Walk Los Angeles is a 10-kilometer (6.2 mile) fundraising walkathon benefiting HIV/AIDS service organisations throughout Los Angeles County. This is an inspirational day filled with energy, excitement, hope, and even celebrities!
Earlier, LA-based independent Armenian publication - IANYAN magazine, posted an extensive reflection - Gay Armenians Raise Thousands for AIDS.

Below are selected extracts from IANYAN:

The Gay and Lesbian Armenian Society of Los Angeles (GALAS) has raised over $5,000  for AIDS Walk Los Angeles and will be walking with thousands of Angelenos in support of the 32 million people worldwide who are living with the disease this Sunday, Oct. 17.

With AIDS still considered taboo in Armenian circles, GALAS seeks to raise awareness and give back to the community. Their support and donation efforts benefit AIDS project Los Angeles, an AIDS service organization dedicated to improving lives of people affected by HIV, reducing HIV infection and advocating for fair and effective HIV-related public policy.

GALAS member Haig Boyadjian has raised $1,000 alone and says he knows a few people whom he loves dearly that are HIV positive. “I feel helpless since there is no cure, this is my way of helping find a cure and raising awareness,” he said. “The dollar amount raised is impressive for a fairly small organization like GALAS.

Chris Garsevanian, another GALAS member  has raised $500, donations that came from a variety of sources including two gay Armenians, one straight Jewish man, a a straight Israeli woman from Manhattan and a straight Iranian woman from the Los Angeles area.

Garsevanian is hopeful for a cure. “I can imagine a world where kids only deal with AIDS in history books,” he said. “I have faith that we will find a cure to AIDS within my lifetime.”

For some, participating in the walk and raising money is all about exposure.
“Our participation in the walk exposes GALAS to not only the general public, but also to LGBT Armenians who thought they were the only ones out there,” GALAS board member H.S., who wanted to be identified by initials only and has raised $575 so far. [...]

GALAS’ participation, as well as the Armenian Gay and Lesbian of New York’s participation over the years in New York’s Gay Pride Parade are relatively recent spotlights on the Armenian LGBT community, which has faced discrimination and ostracization in the Diaspora as well as in Armenia.

GALAS, who offers psychotherapy services to members and non-members alike,  has received threatening and homophobic emails and voicemails in the past.

“I think the notion of gay Armenians existing is taboo, let alone the idea that there might be Armenians who have AIDS,” Boyadjian said. “It’s not really talked about all too much.”

Garsevanian agrees, citing the notion that AIDS in the community as well as LGBT Armenians were considered “folklore” until recently. [...]

“I am hoping that our general membership will be impressed with the amount raised and the time and energy that has been devoted to this cause by all the walkers and sponsors and will in turn be more active next year,” Boyadjian said. “As long as my walking inspires at least one other member to walk next year, then I would be content.”

Can gay couples adopt children in Armenia?


To put it briefly, legally - yes, in practice - no.

Very interesting discussion during the roundtable on trafficking and adoption in Armenia. In response to the question on possibilities for gay couples to adopt children in Armenia, adoption official Yelena Hayrapetyan clarified that legally there are no obstacles for gay couples to adopt children, as Armenia does not want to contradict European norms on human rights. However, there is an “internal agreement” that gay couples will not be allowed to adopt so that “to preserve national values”
Իմ հարցին, թե ի՞նչ չափանիշներով են առաջնորդվում որդեգրողին նախապատվություն տալու հարցում, տիկին Հայրապետյանն ասաց, որ հաշվի է առնվում ամեն ինչ՝ սկսած նյութական-սոցիալական վիճակից, մինչև փսիխո-հոգեբանականը: Իսկ սեռական փոքրամասնություն կազմող մեր հայրենակիցներն ընդհանրապես կարող են չդիմել որդեգրելու համար. «Չնայած մեր օրենսդրությամբ դա չի մերժվում, քանի որ եվրաինտեգրման գործընթացը պահանջում է մարդու իրավունքները ՀՀ-ում համապատասխանեցնել միջազգային նորմերին, սակայն կա ներքին պայմանավորվածություն, ըստ որի՝ նույնասեռական քաղաքացու որդեգրման խնդրանքը մերժում են, ելնելով ազգային արժեքների պահպանումից»:
Փաստորեն, եվրոպաների առջև քաղաքակիրթ ենք խաղում, իսկ մարդիկ, ովքեր կցանկանային ծնողներ լինել, մերժվում են միայն սեռական կողմնորոշման պատճառով:

Ազգային անվտանգության մակարդակի հասցված, պետական մակարդակով «ներքին պայմանվորվածությամբ» անհադուրժողականությունը պատիվ չի բերում երկրին։
This is not surprising and a clear reflection of the widespread tactics employed by officials in Armenia: in papers, Armenia follows all human rights and anti-discrimination directives. But the reality is far from what papers may suggest.

However, I am glad that this question was raised and discussed, perhaps for the first time in Armenia on such a level.

There is one number presented during the roundtable that surprised me a lot. As per official’s data, there are only 70 orphans in Armenia who are eligible for the adoption. So few?
Այսօր մենք ունենք շուրջ 200 ՀՀ քաղաքացի, ովքեր ուզում են երեխա որդեգրել: Իսկ որդեգրման՝ առանց ծնողական խնամքի մնացած երեխաները 70-ն են, որոնցից միայն 15-ն են առողջ, նրանց մեծ մասը 10 տարեկանից մեծ են, որը ևս դժվարացնում է նրանց տեղավորման ամենանախապատվելի ձևը՝ որդեգրումը հայրենիքում: Հիվանդ երեխաներին հաճույքով որդեգրում են արտերկրացիները (որոնց մեծ մասը նույնպես ազգությամբ հայ են), եթե նրանց երկրներում կա այդ երեխաներին բուժելու հնարավորություն:

Austrian ballerina of Russian-Armenian origin sacked for nude photo shoot


Photos appeared in the September issue of the Austrian men's fashion and lifestyle magazine WIENER. Reports say that Karina Sarkissova was previously warned over similar photos in Penthouse magazine.
VIENNA — The management of the Vienna State Opera and its ballet company says it has fired a ballerina for posing in the nude after she was warned not to do it again. The management of the prestigious institutions says solo dancer Karina Sarkissova was axed Aug. 23 after a series of provocative photos of her appeared in the September issue of the Austrian men's fashion and lifestyle magazine "Wiener." A statement Friday said she had already been reprimanded in May for nude shots that were taken in the opera house without permission and published in the June edition of "Penthouse."
News were reported by Tert.am, Utro.ru, Telegraph, AFP and other agencies too.

Karina Sarkissova considers this case discriminatory. WIENER magazine that published her photo shoot, posted a nude picture of Vienna ballet director Manuel Legris, that appeared on a photo book cover, and was not resulted in disciplinary actions.

No-show Government, ‘phantom’ Ombudsman (Re: IWPR roundtable on LGBT rights in Armenia)

Lack of participation from governmental agencies/ministries was the most disappointing part of the IWPR roundtable set to discuss the current state of LGBT rights in Armenia.
Representatives of Armenia’s Ombudsman office, police, ministries of justice and labor and social affairs, government officials, as well as representatives of local and international human rights organizations, media and LGBT community are invited to take part in the round table discussion.
Several ministries (as per above) were invited to the roundtable, and were given their initial OK to participate. However, they were all a no-show during the day. Our government made a good progress in endorsing international human rights documents on LGBT rights. And I always commended it. However, while signatures are important, MUCH MORE important is to make practical steps to implement the human rights obligations. With missing such an opportunity, relevant ministries failed to show that they take those obligations seriously, leaving an impression that the signatures are for external consumption only.

The scandalous behaviour of the representative from the Ombudsman’s office (see below) is beyond any further commentary. It’s a clear illustration of how serious the human rights Ombudsman is in defending those very human rights in Armenia. I wonder if they will keep repeating that they are unaware of problems faced by LGBT people.

Live tweeting from the event, Lara Aharonian of the Women’s Resource Centre confirmed that no government officials were present: “apparently they sent invitation to government officials, they said they will come but didn't; the representative from the ombudsman office came, registered and left very early, at the beginning.”

Another participant of the event Adrineh commented on this blog:

“As mentioned elsewhere in Facebook, Sara from IWPR said the Ombudsman rep came, registered and left, saying that another rep from their office would come along shortly, but of course that "other rep" never came.
Sara also mentioned that both the Ministry of Health and Ombudsman office, when they first received the invites for the event, said "What does this have to do with us?" Can you believe it?!”

Unfortunately, I can believe it....

And here is what PINK Armenia reported on their website:

“Representatives of Armenia’s Ombudsman office, police, ministries of justice and labor and social affairs, government officials, as well as representatives of local and international human rights organizations, media and LGBT community were invited to take part in the round table discussion.

Three ministries promised to send representatives but their promises never came true. It is not the first time in our experience  that Ministry of Health refused to take part in the discussion with regard to this issue; both MOH and Ombudsman office reaction was: “What does this have to do with us?” Anyway we were informed that Eduard Pilatov from the Human Rights Defender office arrived, registered, then left for smoking and disappeared as a phantom.”

Profile of president Obama’s Armenian classmate Mark Momjian - highly respected lawyer, champion of LGBT civil rights

The Armenian Mirror-Spectator published a profile of well known Armenian American lawyer Mark Albert Momjian who is a highly regarded authority in the field of family law and was involved in a number of high-profile cases.

To my pleasant surprise, I discovered that he was prominently involved in a legal defence of LGBT civil rights in the US too.

I do not know the full details of those LGBT related cases, but the outline of activities and distinctions looks impressive, indeed.

He is also involved in Armenian community affairs and visited Armenia with his wife and two sons.

Among his distinctions:
Recipient of the 2005 Pro Bono Service Award by the Center for Lesbian and Gay Civil Rights, presented for significant efforts to achieve equality by the LGBT community of Pennsylvania.

Recipient of the 2004 Cheryl Ingram Advocate for Justice Award, presented by the Philadelphia Bar Association Committee on the Legal Rights of Lesbians and Gay Men, in recognition of extraordinary contributions in promoting civil rights.

Honored as the 2002 Pro Bono Attorney of the Year by the Center for Lesbian and Gay Civil Rights, given in recognition of dedicated efforts in defending the civil rights of the LGBT community.

Among his community activities:
First Chair, Rainbow Endowment, a nonprofit corporation distributing funds generated by the Rainbow Card, an affinity credit card promoted by tennis legend, Martina Navratilova and supporting projects of national scope in the areas of HIV-AIDS prevention and women’s health care.

Co-Chair, Armenian Church Earthquake Fund, which raised more than one-half million dollars to aid homeless survivors of the 1988 Armenian earthquake.

[...] After graduating from Columbia College (where he was a classmate of President Barack Obama) and the Columbia University School of Law, Mark Momjian worked for more than 25 years with his father, primarily in the large Philadelphia law firm of Schnader Harrison Segal and Lewis, before starting a specialized family law firm named Momjian Anderer this year. Momjian has written more than 50 articles on family law topics for many legal journals, and he also co-authored with his father the reference work Pennsylvania Family Law Annotated (Thomson/West), now in its ninth edition. [...]

He handled an important case involving civil rights for the Lesbian Gay Bisexual and Transgender (LBGT) community in 2002 before the Pennsylvania Superior Court (an intermediate appellate). Momjian explained, “This was the first case in the US that imputed a child support obligation on a former domestic partner. The biological parent successfully sued her former partner for child support, even though the former partner had never adopted the child.”

Momjian is particularly interested in the intersection between family law and biotechnology — different methods of reproduction, gestational surrogacy, DNA distribution and frozen embryos. With modern technology, family law is a rapidly changing field. Momjian lectures nationally on these and other issues of family law, and teaches at area law schools in Philadelphia. He is also an adjunct faculty member at Drexel University’s College of Medicine, teaching mental health law.

His public service work focuses on problems facing non-traditional families, as well as victims of abuse and domestic violence. He is a member of the board of directors of both the Homeless Advocacy Project and Philadelphia VIP (an organization working for equal justice for the poor). [...]

Forced out. Gay hater Moscow mayor Luzhkov sacked. Finally

At last. Bigot No. 1 in Russia, homophobic Moscow mayor Yuri Luzhkov got sacked by Russia president Medvedev. Interestingly, president’s decree uses strongest possible words for the occasion and humiliatingly straightforward for Luzhkov (‘due to lost of confidence’):
Russian President Dmitry Medvedev has fired Moscow's powerful mayor, Yuri Luzhkov. Mr Luzhkov, 74, was being removed because he had lost "the trust of the president of the Russian Federation", a presidential decree said. [...]
On Monday, after returning from a week's holiday in Austria, Mr Luzhkov said he would not stand down voluntarily.
His decades in the office were marked by blatant homophobia. He infamously referred to gays as “satanists” and "faggots". He constantly denied Moscow gay activists the right to peaceful actions, including crackdown on Gay Pride events.

Of course, the real reasons behind the sacking of Luzhkov are outside the human rights context, and rather an outcome of internal battles on the highest levels of power in Russia. Still, feels good for now. And I can only commend Russia president for such decision.

Prominent Russian gay activist Nikolai Alexeyev expressed hope that next mayor will be a person with “European mentality”.

Այսօր Պատերազմի եւ խաղաղության լուսաբանման ինստիտուտի հայաստանյան գրասենյակում նույնասեռական անձինք բարձրաձայնում էին իրենց խնդիրների մասին, որոնց մասին երբեւիցե չեն համարձակվել խոսել: Պատճառները, նրանց ասելով` շատ են: Ի դեպ, այսօրվա քննարկմանը եկել էին բազմաթիվ հայ լեսբուհիներ եւ գեյեր:

Նույնասեռական անձինք կամ ինչպես իրենք են ասում` ԼԳԲՏ համայնքը (լեսբուհի, գեյ, բիսեքսուալ, տրանսգենդեր-խմբ.) խնդիրներ են ունենում բոլոր բնագավառներում: Պատասխանելով «Ա1+»-ի հարցին` «Հանրային տեղեկատվություն ու գիտելիքի կարիք» ՀԿ-ի ղեկավար Մամիկոն Հովսեփյանը նշեց, որ այսօր իրենց համայնքի ներկայացուցիչները աշխատանք հիմնականում կարողանում են գտնել սպասարկման ոլորտում, մյուս դեպքերում ամեն ինչ կախված է հիմնարկի տնօրենից:

Հիմնական խնդիրները, ըստ քննարկման մասնակիցների, ծագում են իրավապահ մարմինների հետ շփման ժամանակ: Շատ հաճախ էլ իրավապահ մարմինները գումար են կորզում նույնասեռական անձանցից` վախեցնելով, թե հակառակ դեպքում հարազատներին կասեն: Դա, ըստ Մամիկոն Հովսեփյանի, առավել ակնհայտ է բանակում, երբ հայտնաբերելով, որ ծառայողներից մեկը նույնասեռական է, նրան ենթարկում են բռնության, հոգեբանական ճնշման, ինչպես նաեւ` լինում են բռնաբարության դեպքեր ոչ միայն զինծառայողների, այլեւ հրամանատարների կողմից:

Նրա ասելով` նույնասեռական զորակոչիկի նկատմամբ ծաղրուծանակը սկսվում է անմիջապես բժշկական ստուգման ժամանակ. «Ես մինչ օրս ոչ մի գրականության մեջ չեմ հանդիպել, որ մարդու սեռական կողմնորոշումը կարող է դալտոնիզմի աստիճանով որոշվել: Չգիտեմ` ինչ-որ ներվային հիվանդություններ են փորձում ստուգել. ասում են` ձեռքդ պարզի. աչքերդ փակ քթիդ փորձի հասնել, եթե ստացվեց, ուրեմն հիվանդ ես»: Դրանից հետո Մամիկոն Հովսեփյանի փաստարկներով` նույնասեռական զորակոչիկին ուղարկում են հոգեբուժարան` որպես հոգեկան հիվանդ բուժման:

ԼԳԲՏ համայնքի ներկայացուցիչ Լուսինե Վայաչյանն էլ նշեց, որ տրանսսեքսուալներն էլ իրենց սեռը փոխելու համար ստիպված են լինում դիմել բազմաթիվ խորամանկությունների, քանի որ բացակայում են այն իրականացնելու օրենսդրական հիմքերը: Իրենց խնդիրների միակ լուծումը նրանց կարծիքով` կլինի այն ժամանակ, երբ կլինեն համապատասխան օրենսդրական նորմեր եւ հասարակության իրազեկումը:

IWPR roundtable - 'I would rather be labeled crazy than be raped in the army’: gay men in Armenia (survey)

The roundtable on LGBT issues in Armenia organized by the Institute for War and Peace Reporting (IWPR) Armenia took place today. IWPR representative Sara Khojoyan opened the session by introducing the organization’s activities and mentioning that this roundtable was organized as a sort of follow-up to an article she had written earlier which described some of the issues LGBT people face in Armenia.

Then, Mamikon Hovsepyan from PINK Armenia (Public Information and Need of Knowledge) NGO introduced the research his organization had conducted and presented in May this year.

The project, called “We and Our Rights,” aimed to collect data concerning cases of discrimination and rights violation toward LGBT (lesbian, gay, bisexual, transgender) people in Armenia and to find out to what extent legislation of Republic of Armenia regulates LGBT rights protection and their responsibilities.

Hovsepyan mentioned that discrimination against LGBT people occurs in all facets of life: at school and at work, in military service, while seeking healthcare services, and so on. He also mentioned that discrimination also occurs in the media — through news stories that ridicule, criticize and demean the lives and experiences of LGBT people in Armenia.

The PINK Armenia representative also referred to incidents of rape and violence in Armenia’s armed forces. Despite the fact that the World Health Organization (WHO) removed homsexuality from their list of mental disorders in 1990, according to Hovespyan, Armenia does not prescribe to the WHO criteria and still labels homosexuality as a mental disorder. Thus, gay men in Armenia can be exempt from military service if they state their sexual orientation.

According to the men surveyed in the report (as women in Armenia don’t serve in the military), they would rather be labelled “crazy” than be subject to rape or violence at the hands of their fellow soldiers or officers.

Though Armenia signed the UN Declaration Against Discrimination Based on Sexual Orientation and Gender Identity in December 2008, there are still no actual laws in Armenia that protect the rights of LGBT people and prohibit discrimination based on sexual identity and gender orientation, said Mamikon Hovsepyan from PINK Armenia (Public Information and Need of Knowledge) NGO at a roundtable on LGBT issues organized by the Institute for War and Peace Reporting (IWPR) Armenia today.

Hovsepyan also added that Armenia, along with Azerbaijan, didn’t sign (adopt) the April 2010 Parliamentary Assembly of the Council of Europe (PACE) Resolution on discrimination on the basis of sexual orientation and gender identity.

The PINK Armenia representative also discussed the research the organization had conducted on discrimination and rights violation toward LGBT people in Armenia.

Hovsepyan noted that the majority of respondents noted that they have never and will never go to the police and law enforcement bodies for protecting their rights, since not only do they not resolve the issues at hand, but they also become cause for new issues to arise.

Hovsepyan recalled an occasion when a group of officers had called out derogatory terms referring to gays to a man on the street who had then actually filed a complaint with the Ombdusman on July 1, 2009 (complaint no. 1–0508). However, the RA Police also sent a letter to the police in which they described the incident much more mildly saying the man was simply brought in for questioning for 5 minutes and had his identity checked by checking his passport. According to Hovsepyan, the Ombudsman believed the police’s word over the victim’s even though the man didn’t even have his passport on him that day.

“Why do they trust the letter by the police and not by the citizen?” Hovsepyan asked.

Furthermore, he said that when IWPR representative Sara Khojoyan asked the Ombudsman if there were any complaints by LGBT people registered with their office, the Human Rights Defender had said no. Drawing on the incident he mentioned, Hovsepyan said, “Let them not say there were no complaints.”

Բոլորս էլ սխալական ենք, այդ թվում նաեւ Աստված

Նորայր, Գագիկ, Կառլեն…

Էռնա, Նատա, Կատյա, Էլյա, Լորենա, Լայմա, Վիկա, Քրիստինա, Սիլվա…

Սրանք այն տրանսսեքսուալներն են, որոնց ես անձամբ ճանաչում եմ, որոնք իմ ընկերներն են, ծանոթներն ու Հայաստանի Հանրապետության քաղաքացիները: Շատ-շատերը կան, որ չեմ ճանաչում: Նրանք ներքուստ մի սեռի էության զգացողություն ունեն, սեռական ու սոցիալական վարքագիծ՝ հակառակ սեռի մարմնի ու սոցիումով պարտադրված դերի մեջ բանտարկված, ու սեփական երկրում չունեն սեռափոխության վիրահատություն անցնելու հնարավորություն:

Մենք գետերի հուներ ենք փոխում, տափաստաններ ենք ծաղկեցնում, մենք դեմքեր ենք «հավաքում» մեզ դուր չեկած սեփականների տեղ, արհեստական ինտելեկտ ու բանականություն ենք ստեղծում ու օգտագործում, մենք հսկայական հեկտարներով գենետիկորեն փոփոխված բույսեր ենք աճեցնում ուտում, արհեստական արեւային վաննաներ ենք ընդունում, մենք երեխաներ ենք ստանում կոլբաների միջից, շուտով երեւի արհեստական մարդ էլ կկլոնավորենք…

Աշխարհում ամենուր մարդիկ սեռ էլ են փոխում, բայց ոչ Հայաստանում: Ինչո՞՚ւ մեր սիրելի դերասանուհի Շերի դստեր որդի դառնալը մենք ընդունում ենք, բայց մեր մեջ ապրող տրանսսեքսուալների նույն սեռափոխությունը հայերիս թվում է սրբապղծություն, իսկ օրենսդրական բյուրոկրատական ապարատն ու հնացած բժշկական մոտեցումներն այն անհնար են դարձնում Հայաստանում:

Տրանսսեքսուալիզմը (փոխսեռականություն) շատ երկրներում դասվում է գենդերային՝ սեռական իդենտիֆիկացիայի՝ նույնականացման հիվանդությունների շարքին, որի միակ բուժումը սեռափոխության վիրահատությունն է: Հայաստանում, ցավոք, դա հնարավոր չէ իրականացնել: Մեր տրանսսեքսուալները սեռը փոխելու համար պետք է դիմեն զանազան խորամանկությունների, քանի որ մեզ մոտ չկա ո´չ օրեսնդրական, ո´չ առողջապահական հիմք այդ կարգի վիրահատություններն օրինական դաշտում իրականացնելու համար:

Նրանք պետք է գնան արտասահման, օրինական կամ զարտուղի ճանապարհներով, երկար ճանապարհ անցնեն նախ քաղաքացիություն ստանալու համար, հետո էլ զանազան հոգեբանական հետազոտություններ անցնեն, փող գտնեն հորմոնային թերապիայի ու վիրահատության համար, և եթե ամեն բան ստացվի, փոխեն սեռը` համապատասխան իրենց գենդերային ինքնազգացողության ու հետո առհավետ մոռանան հայրենիք վերադառնալու մասին, քանի որ փաստաթղթեր չկան. այստեղ նրանք ոչ ոք են՝ ոչ էն սեռի են, որով գնացել են, ոչ էլ նոր:

Պարզվում է` մենք ունենք օրենսդրությամբ նախատեսված այսպիսի մի կետ.

Հոդված 70. Քաղաքացիական կացության ակտի գրառման մեջ ուղղում կամ փոփոխություն կատարելու մասին ՔԿԱԳ մարմնի եզրակացությունը Քաղաքացիական կացության ակտի գրառման մեջ ուղղում կամ փոփոխություն կատարելու մասին ՔԿԱԳ մարմնի եզրակացությունը կազմվում է հետեւյալ դեպքերում.

գ) Հայաստանի Հանրապետության օրենսդրությամբ սահմանված կարգով բժշկական կազմակերպությունը տվել է սեռի փոփոխության մասին սահմանված ձեւի փաստաթուղթ:

Այստեղ խնդիր է ծագում արդեն բժիշկների հետ: Ողջ աշխարհում տրանսսեքսուալիզմն ախտորոշվում է մեկ-երկու տարիների ընթացքում, որի ընթացքում մարդն ապրում է իրեն ցանկալի գենդերային դերում: Հետո, եթե այլ հոգեբանական շեղումներ չեն գրանցվում, ախտորոշվում է տրանսսեքսուալիզմ: Հայաստանում այդպիսի բժշկական հաստատություններ չկան: Այստեղ մաքսիմում կարող են ուղարկել կարիոտիպի անալիզի, հետազոտել քրոմոսոմային կապերն ու ըստ դրա որոշել` բիոլոգիապես կի՞ն է, թե՞ տղամարդ, թե՞ երկսեռ է: Նույնիսկ այդ դեպքում պլաստիկ վիրաբույժն իրավունք չունի վիրահատելու. օրինական թույտվություն չունի, չեն տալիս: Իսկ եթե քրոմոսոմները չունեն երկսեռական կապեր, ապա մարդուն ուղղակի ուղարկում են հոգեբույժի մոտ` «բուժվելու» ու «նորմալ» մարդ դառնալու:

Մեր բժիշկները կամ չգիտեն, կամ չեն ուզում իմանալ, որ երկսեռն ու փոխսեռը տարբեր բաներ են: Ողջ հանրապետությունում չկան մասնագիտացված էնդոկրինոլոգներ ու հոգեբույժներ, ովքեր կարող են տալ այդ ախտորոշումը:

Նորայրը տղամարդու իր էությամբ գոյատեւում է կանացի մարմնի մեջ: Նա շատ երկար ճանապարհ է անցել, փնտրել է հոգեբաններ, այլ ինստիտուտներ, որտեղ կարող է անցնել այդ հետազոտությունն ու ստանալ փաստաթուղթ, որ նա տրանսսեքսուալ է ու իրավունք ունի վիրահատվելու: Ժամանակին կապվել է Մոսկվայի քաղաքային հոգեբանության ու էնդոկրինոլոգիայի կենտրոնի (այդ կառույցը եւ Ռուսատանի մի շարք այլ կառույցներ իրավասու են տալ այդպիսի փաստաթուղթ ) ղեկավար Ստեփան Մաթեւոսյանի հետ: Նա ասել էր, որ Հայաստանում նման ինստիտուտ չկա, բայց ուզում էր բացել: Որոշ ժամանակ անց ասաց՝ քանի որ նման մարդիկ Հայաստանում քիչ են, ապա ինքն էլ դրանով չի զբաղվում:

Երեւանում Նորայրը հանձնել է կարիոտիպային անալիզ, որը ցույց է տվել կանացի քրոմոսոմային կապեր: Նրան ասել են, որ ինքը բիոլոգիապես կին է, եւ էնդոկրինոլոգը նրան խորհուրդ է տվել «բուժվել» սեքսոպաթոլոգ-հոգեթերապեւտ Վրեժ Շահրամանյանի մոտ, որը չգիտես ինչ բժշկական մեթոդներով հանձն է առնում «բուժել» ողջ ԼԳԲՏ հայությանը: Երբ Նորայրն ասել է, որ Առողջապահության համաշխարհային ասոցիացիան վաղուց է հանել տրանսսեքսուալիզմը հոգեկան հիվադությունների շարքից, ու ինքը նման բուժման կարիք չունի, բժիշկը հասկացել է, որ նա քաջատեղյակ է, եւ ի պատասխան դրան` առաջարկել է մեկնել Ռուսաստան` ասելով, որ Հայաստանում այլ բուժման ձեւ չկա:

Հիմա Երեւանից ու Հայաստանից հույսը բոլորովին կտրել է, բայց արտերկրում էլ, եթե երկրի քաղաքացի չես, շատ բարդ է այդ ամենի իրականացումը: Կարող ես միայն մեկնել Թայվան կամ այլ երկիր, ուր անլեգալ կատարում են նմանատիպ վիրահատություններ: Ասում է, որ մենք իրավականորեն ունենք այդ կետը, որով կարելի է անձնագիր փոխել: Ասում է նաեւ, որ մեր բժիշկները տգետ են, ու քանի որ եթե ունես բժշկական փաստաթուղթ, բայց ձեւը պարզ չէ, ու պարզ էլ չէ, թե ումից կարելի է պարզել, նրանք մի մասնագետից մյուս մասնագետի մոտ են ուղարկում մարդուն:

Մեկը մյուսից տեղյակ չեն, բժիշկները հղում են տալիս օրենսդրական բացերին, օրենքն էլ ասում է՝ բերեք բժշկական փաստաթուղթ: Բժիշկներն էլ ի՞նչ կարող են տալ, եթե անգամ տրանսսեքսուալիզմն ու հերմոֆրոդիտիզմն իրարից չեն տարբերում: Եթե քեզ մոտ XX46 է, անկախ նրանից դու քեզ ինչ սեռի ես զգում, դու կին ես ու վիրահատության կարիք չունես: Վիրաբույժը վերջինն է այս շղթայի մեջ, նա չի կարող որևէ բան անել առանց օրինական թույլտվության ու հոգեբանի, էնդոկրինոլոգի ու սեքսոպաթոլոգի եզրակացության:

Միջազգային պրակտիկայում ընդունվել է F64.0 տրանսսեքսուալիզմ ախտորոշումը, իսկ Հայաստանում ոչ մի կառույց դա չի անում: Նորայրը դեռ ոչ մի հայ բժշկի չի հանդիպել, ով գիտի, թե իրականում ինչ է տրանսսեքսուալիզմը: Նորայրը հարցի մասին բավականին ինֆորմացիա ունեցող գրագետ մարդ է, բայց չէ՞ որ կան այնպիսիները, որ չգիտեն ոչինչ, վաղ հասակում են դիմում բժշկի, նրանց սխալ ուղու վրա են դնում, ուղարկում «բուժվելու», համարում են հոգեկան հիվանդ` դրանով իսկ առավել բարդացնելով նրանց բաժին ընկած առանց այդ էլ դժվար կյանքը…

Նորայրը կարծում է, որ սեռափոխության վիրահատության մասին խոսելիս պետք է ամենավերջում անդրադառնալ վիրաբույժներին: Մինչեւ նրանց հասնելը շատ բան կա մեզ մոտ, որ պետք է անել:

Մենք Նորայրի հետ միասին փորձեցինք ինչ-որ բանից սկսել, ինչ-որ քայլեր անել, որպեսզի կարողանանք իմանալ, թե ինչն է անհնարին դարձնում նման վիրահատությունների իրականացումը Հայաստանում, եւ ո՞ւմից ի՞նչ ենք պահանջում:

1. Պետք է բժշկական ուսումնական հաստատություններում, ուր ամեն ինչ շատ հին է, սկսած դասագրքերից վերջացրած «սովետական» դասախոսներով ու մենթալ հայկական բարքերով, ուշադրությունը սեւեռել գենդերային նույնականացման գիտական մոտեցումների ու խնդիրների վրա:

2. Պետք է բժիշկներին իրազեկել՝ մի խումբ էնդոկրինոլոգների, հոգեբանների ու հոգեվերլուծողների, սեքսոպաթոլոգների ու էնդոկրինոլոգների ուղարկել` միջազգային նորմերին համապատասխան վերապատրաստվելու:

3. Մեզ պետք է կառույց, ինստիտուտ, հիվանդանոց, ուր մարդիկ կկարողանան դիմել, հետազոտություն անցել ու ստանալ ախտորոշում:

4. Պետք են բարձրակարգ էնդոկրինոլոգներ, ովքեր գիտեն, թե ինչ է պետք տրանսսեքսուալներին, ու կկարողանան նրանց ճիշտ բուժում նշանակել, եւ քանի որ սեռափոխությունից հետո էլ հորմոնային թերապիան ցմահ է, կարողանան տրանսսեքսուալներին ճիշտ սպասարկել:

5. Եւ վերջում միայն, այդ ամենից հետո, ըստ բնականոն պահանջարկի կհայտնվեն վիրաբույժներ, ովքեր պատրաստ կլինեն իրենց ծառայություններն առաջարկել:

6. Պարզաբանել ու հստակեցնել հոդված 70 գ. կետում խոսվող «սեռի փոփոխության մասին սահմանված ձեւի փաստաթղթի» ձեւն ու բովանդակությունը:

Եթե առաջիկայում հնարավոր լինի այս քայլերն իրականացնել, բավականին մեծ առաջխաղացում կունենանք Հայաստանում սեռափոխության վիրահատությունները հնարավոր դարձնելու հարցում:

Transsexual (TS) men and women have no constitutional rights or options for seeking healthcare services, said Lusine Vayachyan, a journalist and LGBT community representative at a roundtable on LGBT issues held today and organized by the Institute for War and Peace Reporting (IWPR).

According to her, TS men and women have to go abroad; secure funds for travel, accomodation, visas and surgery; and then see a psychiatrist before they can be eligible for sex reassignment surgery (SRS). And then they have to forget about returning to Armenia because “here they are no one, neither their former sex nor their current sex,” she said.

She further added that doctors in Armenia either don’t know or don’t want to know the difference between transsexuals and “hermaphrodites” (intersex people).

Vayachyan recalled a friend of hers, Norayr, a citizen of Armenia who wants to change his sex from female to male, who went to see an endocrinologist who, after running chromosomal tests determind Norayr as having female chromosomes, advised him to go see a psychiatrist for “treatment.”

When Norayr mentioned that being transsexual is no longer considered a mental disorder and he does not need to be “treated,” the endocrinologist advised him to go to Russia.

Vayachyan mentioned that Norayr has “never met a doctor in Armenia who knows what it is to be transsexual.”
