Head of PINK Armenia on LGBT discrimination in the Armenian army and possible implications of joining Russia sponsored customs union

According to Mamikon Hovsepyan, head of Pink Armenia, about 10 LGBT Armenians a year let them know of being exempted from serving in the army by the MoD order under the article 8(b) (‘mental health problems’). Of course, the real number of such exemptions could be much higher, as many people simply “do not inform us or are not aware of us”, says Mamikon in an interview with newsbook.am.

This is a controversial issue, as when LGBT people disclose their orientation, the army representatives tell them that the sexual orientation is not a ground for being exempted from serving in the army, hinting that perhaps ‘we will discover other health problems’, i.e. mental health, so that to fit the article 8(b).

On one hand, it is outrageous that for army purposes the sexual orientation is being equalled to having a mental health problem. On the other hand, as Mamikon rightly pointed out, while the issue of violence and bullying in the Armenian army applies to recruits of all orientations, including “traditional orientation”, LGBT recruits are much more vulnerable and subjected to more violence, bullying and isolation after their sexual orientation (real or perceived) become known.

US State Department highlights LGBT discrimination in Armenia, DIY bombing and officials’ endorsement of anti-gay attacks

US State Department published its annual country-specific human rights reports, including Armenia related. In the chapter that highlights discrimination based on sexual orientation and gender identity, the report specifically describes firebombing of gay friendly DIY bar in downtown Yerevan, attacks on Diversity march, as well as endorsement by ARF Dashnaktsutyun party and ruling Republican party MPs and officials, including vice-speaker of Armenian parliament, spokesman of ruling Republican party Eduard Sharmazanov and prominent ARF Dashnaktsutyun MP Artsvik Minasyan.

Societal Abuses, Discrimination, and Acts of Violence Based on Sexual Orientation and Gender Identity

No antidiscrimination laws apply to sexual orientation or gender identity. Societal attitudes toward LGBT persons remained highly negative, with society generally viewing homosexuality as an affliction. Societal discrimination based on sexual orientation and gender identity negatively affected the employment, family relations, and access to education and health care of sexual minorities.

On May 8, three men firebombed the DIY Bar in Yerevan, a popular spot for activists who promoted equal rights for women and minorities, including LGBT persons. Although there were no injuries, the bar was destroyed. Police were summoned but arrived 12 hours after firefighters extinguished the fire. The bar owner identified three suspects, of whom police arrested two, the brothers Hampig and Mkrtich Khapazyan. Legislators from the opposition Armenian Revolutionary Federation, Artsvik Minasyan and Hrayr Karapetyan, posted bail for one suspect and police released the other after he promised not to leave the country. A number of other National Assembly members, including Eduard Sharmazanov and Hovhannes Sahakyan from the ruling Republican Party, praised the actions of the Khapazyan brothers as a justified defense of the Armenian nation. Vandals spray-painted swastikas and threats against the owner of the destroyed bar on May 17 and 21.

Also in May the efforts of several NGOs to hold a “diversity march,” which local nationalists dubbed a gay parade, were thwarted by youths who shouted antigay slogans and tried to block the entrance to a building where a diversity exhibition was scheduled. Police ensured that there was no violence between the marchers and the nationalists and that the marchers were able to enter the exhibition while the protesters remained outside. The NGOs alleged that those who attempted to block the march were the same persons as those involved in the DIY bar bombing.

Openly gay men were exempt from military service, purportedly because of concern fellow service members would abuse them. However, the exemption required a medical finding, based on a psychological examination, that an individual had a mental disorder; this information was stamped in the individual’s personal documents.

According to human rights activists, sexual minorities were frequent targets for humiliating discrimination in prisons, where they were forced to perform degrading labor and were separated from the rest of the prison population.

Challenges faced by Armenia's LGBT people to be discussed at "Armenians and Progressive Politics" conference in New York

"The Armenians and Progressive Politics" conference focusing on Armenia at 21 (referring to the 21th anniversary of independence from the Soviet Union) will be held at Columbia University on 28-29 September 2012. [http://www.armeniansandtheleft.com]

For the first time, head of PINK Armenia Mamikon Hovsepyan will participate in the conferences to talk about "LGBT Rights in Armenia – Silenced Reality." He will be on the "Emergence of Social Movements, NGOs, and the Rise of a New Identity Politics" panel. The following is the abstract of his talk (via Armenians and Progressive Politics FB page):

In the shadow of societal and institutional discrimination, gay, lesbian, bisexual, and transgender people in Armenia face tremendous struggles in achieving equality, both at the personal and organizational levels. Although the Armenian government has signed and ratified most of the UN, Council of Europe and OSCE covenants, treaties, and other instruments, including a partnership and cooperation agreement with the European Union, in practice, those commitments have not been met with regard to human rights pertaining to sexual orientation and gender identity.

In Armenia, homophobia is widespread and deeply ingrained in society. Visibility of the LGBT community is limited. Individuals face discrimination and human rights violations in virtually all spheres of society due to their sexual orientation and gender identity. Most seriously, LGBT individuals can be bullied in educational institutions or become victims of psychological and physical abuse while serving in the Armenian army.

Hate crimes and their promotion are supported by the majority of society and politicians, under the pretext of “patriotism” and “Christianity.” As a result, extremist groups of young people and their sponsors have deliberately spread misinformation to disrupt Armenia’s diversity march, considering it a gay parade, and have subjected its participants to violence. This spring, a fascistic group bombed a bar patronized by supporters of diversity and multiculturalism. This talk will examine these profound challenges faced by Armenia’s LGBT community.

Armenia LGBT rights record to be scrutinised before UN Human Rights Committee

PINK Armenia in cooperation with the Heartland Alliance for Human Needs & Human Rights, ILGA-Europe and the George Washington University Law School International Human Rights Clinic has prepared and submitted a shadow report focusing on "Human Rights Violations of Lesbian, Gay, Bisexual and Transgender (LGBT) People in Armenia" for consideration at the 105th Session of the Human Rights Committee. This is the first time such a comprehensive LGBT report has been submitted as part of the review of Armenia human rights commitments before the UN.

The purpose of this report is to highlight the widespread and systematic human rights violations experienced by lesbian, gay, bisexual and transgender (LGBT) individuals in Armenia. These violations have become all the more concerning in light of the recent upsurge in violent attacks against the LGBT community, and speech inciting such attacks in the month of May 2012. In particular, the report draws the attention of the Committee to the following breaches of the Covenant:

Background summary
• The State of Armenia remains deeply oppressive toward LGBT individuals, as reflected by public officials’ statements against the LGBT community.
• The Armenian State fails to protect LGBT individuals from public stigma and hate speech because it has failed to enact laws that criminalize hate speech, including against LGBT persons.
• Individuals in Armenia are subject to discrimination on the basis of their sexual orientation and/or gender identity by both State and non-State actors, including in access to education, employment opportunities, and healthcare.
• Though inadequate reporting makes exact numbers uncertain, local human rights groups report an alarming number of non-combat deaths in the army each year, including deaths of LGBT individuals. Gay and bisexual men serving in the army may be particularly at risk. The Armenian State fails to adequately prevent, investigate, and/or prosecute incidents of gender and sexual orientation-based killings, including against LGBT individuals.
• Gay and bisexual men in Armenia suffer cruel, inhuman, and degrading treatment while serving in the army or detained in prison. In some instances, the State is responsible for this abuse or fails to adequately prevent, investigate, and/or prosecute incidents of violence toward LGBT individuals.
• The Armenian State refuses to recognize the gender identity of transgender persons. By denying transgender individuals appropriate identity documents, the State withholds from them the status of legal personhood.

Recommendations
The State of Armenia must adopt legislative, administrative, and judicial measures to ensure respect, protection, and promotion of, and minimize violation of, human rights without any distinction based on an individual’s sexual orientation or gender identity. To that end, the Human Rights Committee should recommend:

1. Armenia should adopt anti-discrimination legislation that condemns discrimination based on sexual orientation or gender identity.
2. Armenia should take appropriate measures to end all discrimination against individuals on the basis of their sexual orientation and gender identity by adopting comprehensive anti-discrimination legislation. In particular, the State party should introduce a comprehensive system of laws that criminalize hate speech and discourage statements by public officials that foster discrimination against LGBT people.
3. Armenia should take action to end all violence committed against individuals on the basis of their sexual orientation and/or gender identity in the Armenian army or who are detained in prison. In particular, the State party should protect LGBT persons from discrimination, physical and mental torture, and degrading treatment. The State party should revise the military code and put in place measures to fully investigate alleged crimes on the basis of sexual orientation and/or gender identity, and where appropriate, ensure that such crimes are properly prosecuted and punished.
4. Armenia should take appropriate measures to ensure that all persons have the enjoyment of their rights and are entitled to access basic services, such as education and employment, without discrimination on the basis of their sexual orientation and gender identity. In particular, the State Party should pay special attention to undertake these efforts outside of the capital city of Yerevan.
5. Armenia should take steps to improve its public health campaign to end discrimination against LGBT persons infected with HIV/AIDS.
6. Armenia should adopt appropriate laws that permit transgender persons to legally transition, and to receive identity documents that reflect an individual’s identified gender.

2. What is the State party doing to address hate speech and homophobic statements by public officials, which are detrimental to the full exercise of the right to freedom of expression?

Anatomy of violence, or Armenia MP (president of Football Federation) Ruben Hayrapetyan slaughterhouse

Military doctor severely beaten by bodyguards of Armenia MP, president of Football Federation Ruben Hayrapetyan (aka 'Nemets Rubo') has died on 29 June. Video above details some of the 'heroic' pages from the history of violence of disgraced Armenia MP, president of Football Federation, oligarch Ruben Hayrapetyan, nicknamed 'Nemets Rubo'.

Posting this video, Hetq Online reminds how 'Nemets Rubo' threatened and/or enacted violence towards journalists, drug addicts, and (more recently) gays. The author righty points out that after all the violent rhetoric and actions, there should be no surprise that we witnessed yet another violence, this time with more tragic consequences. To remind, following recent firebombing of gay friendly bar DIY in Yerevan, ‘Nemets Rubo‘ said he “condemns terrorism” but “in favour of punishing gays and ready to do it myself”. “We should think of another way of punishing to eradicate them from our society.”

Other high profile MPs from ruling Republican party who supported firebombers and encouraged anti-gay violence include vice-speaker of the Armenian parliament, spokesman of the ruling Republican party Eduard Sharmazanov, and MP, (now) secretary of Republican party parliamentary group Hovhannes Sahakyan.

Last night, there was a candlelight vigil in Yerevan in memory of beating victim Vahe Avetyan. People gathered in front of the restaurant where the violence took place [Harsnaqar restaurant belongs to 'Nemets Rubo'] Many held 'I am Vahe Avetyan' posters condemning violence, calling for boycott of oligarch MP businesses and his resignation as MP and president of Football Federation.

Among protesters rightly condemning violence, I noticed two well known personalities who have their share of moral responsibility for this atmosphere of hatred and violence.

Armenian MP from the ARF Dashnaktsutyun party Armen Rostomyan said nothing when his colleagues from the ARF party, and in particular Artsvik Minasyan, Hrayr Karapetyan and Artur Aghabekyan supported firebombers and at least in case of Artsvik Minasyan (+ here) and Artur Aghabekyan openly encouraged anti-gay violence.

Larisa Alaverdyan, former MP and ex-Ombudsman, effectively sided with homophobes during TV programme discussing attacks towards gay friendly bar and Diversity march.

Discrimination towards lesbian, gay, bisexual, and transgender people begins with the family. Discrimination towards LGBTs by family members manifests itself through breaking off all contact, kicking them out of the house and disowning them.

Afterwards, discrimination continues in nearly all stages and facets of life: study and work, military service, healthcare and other services, media, entertainment, and so on. Cases of violating anonymity and confidentiality, which more often take place in establishments that provide healthcare services and psychological support, legal bodies or military, are not uncommon.

Intolerance towards LGBT people more so relies on unwritten norms, customs and social memory.

There are cases of rape and even death of LGBT people in Armenia. The majority of LGBTs say that they have never and will never go to the police or law enforcement bodies for protecting their rights, since they not only don’t resolve the issues at hand, but also become the cause for new issues to arise.

Nevertheless, it’s also important to note that the public and the state must take into account its citizens’ individual right to live freely and without violating other people’s rights. However, the more an individual’s external appearance or the way he carries himself reveals his sexual orientation or gender identity, the more serious the level of discrimination can become. Discrimination can manifest itself not only through articulating offensive statements, but also by carrying out physical, sexual and psychological violence.

There is a lack of trust towards professionals in different spheres. For example in healthcare, to overcome the situation, they avoid seeking professional help (a fear of not preserving anonymity and confidentiality). Some LGBT people, if not attempted then at least had thoughts of committing suicide.

On the topic of legal resolution, legislation and international documents that regulate or are connected to eliminating all forms of discrimination against LGBT people, encouraging public tolerance, and protecting LGBT rights were examined. Not only is the justice system that regulates the sector in which LGBT people’s rights should be protected in the Republic of Armenia not united, but also legislative definitions within the boundaries of understanding and the legislation connected to this sector, which would guarantee the possibility of protecting their rights, are actually absent from legislation.

Neo-Nazi movement in Armenia is spreading hate and intolerance toward LGBT people, distributing tracks and disseminating heinous messages to the citizens, which content seek to reject homosexuality. Those movements promote also hate crimes and they have never been banned by the Government or legal bodies.

Police attack gay and trans people in the streets, taking them to police stations. There are many cases when GT people were physically violated at police station or in the streets by policemen. Police also blackmails them and take money for not informing their relatives about their sexual orientation and gender identity.

Gay, bisexual and trans men can be exempted from military service, though not all of them come out with their orientation and instead they go to the army. Violations towards GBT people in the army are committed by their peer and officers usually. There are cases of physical abuse, rape and psychological pressure, and those cases have never been reported by the Ministry of Defense.

In mass media, the cases of pedophilia between adult and underage men is considered as homosexuality, while pedophilia between adult man and underage girl in considered only pedophilia.

Mass media remains as a main hate promoter among society, usually comparing homosexuality with prostitution, sects, diseases, and bringing negative examples while talking about LGBT people.

Armenian Church is one of the homophobic institutions in Armenia. Usually they organize meetings and discussion in Grigor Lusavorich Church and often they use the opportunity to touch the topic of homosexuality, to blame LGBT people. There were cases when participants promoted hate crimes during the meeting and it was accepted by the organizer priests as a right action. During press conferences and interview, regardless of what the interview is about (religious minorities, prostitution, addictions), priests use the opportunity to touch the topic of homosexuality and blame LGBT people.

Public TV in Armenia and pop singers in PR disaster over Eurovision

Let me start from the very beginning of this story. A story that quickly turned into farce. Perhaps, one of the most spectacular yet tragic PR disasters of Armenia’s Public TV & co.

Group of initially unnamed Armenian pop singers issued a ‘statement’ on 23 February 2012, in which they urged country’s public broadcaster to boycott the Eurovision song contest in Baku. As a more immediate trigger for such decision, the ‘statement’ cited the news that “20-year-old solder Albert Adibekyan was shot by an Azerbaijani sniper on the Line of Contact between Azerbaijan and the disputed Republic of Nagorno-Karabakh.”

“Theatre of absurdist Eurovision related propaganda continues.” - this was my immediate reaction that was subsequently quoted by AFP.

It was instantly obvious that this "group of singer/songwriters" was used as a propaganda tool and as a pretense so that Armenia’s Public TV will have an excuse to announce their “no”. The wording of the ‘statement’ left little to imagination as to the real authors behind such ‘creation’. State propaganda machine.

Entertainment website bravo.am, immediately after the release of the 'statement', tried approaching those "well known and famous" (yet unnamed!) singers, only to discover that many of them had no idea about the “written statement”, and contrary to what was indicated in some outlets ('all previous Armenian Eurovision singers signed it in') at least Andre said that in fact he would like to perform in Baku. Basically, Armenian propaganda people prepared and distributed the 'statement' first, then started asking singers to sign in. Tragic and laughable at the same time.

In a further evidence that this spectacle was coordinated by Public TV, one of the signatories - singer Artur Ispiryan - admitted in an interview with Yerkir Media that it was them (Public TV) who called him asking whether he thinks Armenia should participate in Baku or not. He said he was not aware of the accompanying text.

Following eventual 'disclosure' of signatories, I was glad to notice that Sirusho (the most successful Armenian Eurovision entrant so far) and Dorians (the band I like and favor for this year’s Eurovision) were not among them. Ironically, none of the signatories were even considered for this year’s Eurovision.

Many on social networks, in particular Facebook, and media, condemned the move as unacceptable exploitation of soldier’s death for personal and political propaganda purposes, especially by those singers who tarnished their reputation during 2008 post-election bloodshed by keeping silent or siding with the authorities.

And here is just one of the reasons why I respect Dorians:
Addressing the reason cited by the artists for refusing to perform in Baku (Adibekyan’s death), Dorians’ producer [Vahagn Gevorgyan] said:
“The saddest part is that the soldier’s death yesterday is tied up with Eurovision and more uproar was evoked than the deaths of other soldiers. Not now, but long ago we should’ve reflected on the cause of [these] deaths in the army, who is to blame that soldiers are being killed. Of course, they say, the Azeris, but I don’t think that we don’t have problems within our own army,” he said.
The situation evolved into spectacular yet tragic PR disaster when first ArmeniaNow, then other news outlets (with the confirmation by Ministry of Defense) admitted that the soldier whose death was exploited for propaganda purposes and as an excuse to withdraw from the Eurovision was in fact killed by his fellow Armenian serviceman [read: Mis-Information: Army says Azeri sniper killed soldier, but new information contradicts and confirmation by MoD in News.am and RFE/RL]
Conscript Albert Adibekyan, who died on February 23 in a military base near Chinar village, Tavush province, according to new information, was killed not by an Azeri sniper, as it was officially reported, but rather by an Armenian serviceman. [...]
Helsinki Association expert Ruben Martirosyan told ArmeniaNow that yesterday at the meeting with Yura Badalyan, head of the Central Apparatus at the Ministry of Defense Investigative Service, Badalyan told him that they “had managed to find out that the killer was not an Azeri sniper but was an Armenian [serviceman].”
“So there is a new way of calling the murders committed in border military bases - to hide the case, attributing the blame to a [Azeri] sniper, to gain dividends in front of the international community. Parents will be comforted believing that their child has died as a hero. But this will simply destroy our army,” Martirosyan says. 

During 2012, eight soldier deaths have been registered. Only two were from enemy fire.
Where are your voices now? Where is the statement condemning death of the Armenian soldier killed by his fellow serviceman? Where is the outrage of our super-patriotic singers? I can’t hear you.

P.S. There are quite a few genuine reasons that Armenia’s Public TV may have considered to withdraw from the competition, without resorting to above. Among them, I would like to highlight the underrated fact of virtual impossibility of Armenian fans (apart from being part of delegation or media) to travel to Azerbaijan capital Baku for Eurovision. I genuinely believe that Eurovision should not be held in a country where there are obstacles for participating fans. Because Eurovision is not only about songs, singers and country delegations. It's equally or more so about fans too. I will not even go into the issue of widespread and systematic human rights abuses in Azerbaijan (see the very latest example highlighted by the Human Rights Watch). And as if Armenian Public TV / pop stars‘ ridiculousness was not enough, now Azerbaijan’s Eurovision winner Nigar Camal resorted to propaganda language stirring anti-Armenian hysteria by exploiting the anniversary of tragic events during Karabakh war on Twitter. This is not the language that supposedly welcoming host should have used.

“Official” Eurovision-related decision by Armenia’s Public TV [participate - Yes/No; if Yes - the entry] will be announced by 18 March 2012.

In 2011, more than 200 LGBT people used services provided by PINK Armenia. Big problem - unreported hate crimes

In an interview with News.am (AM), Marine Margaryan, Project Coordinator at PINK Armenia, sums up the main headlines of their annual report on LGBT situation in Armenia (full report in English - here).

According to Marine, in 2011 more than 200 LGBT people, mainly men, used services provided by PINK Armenia, including legal advice in case of violence and hate crimes.

As an example of unreported hate crimes in Armenia, Marine mentioned recent case of physical and psychological abuse at one of Yerevan bars, when a customer recognised and approached one gay guy there, then spit next to him and broke his nose. However, fearing disclosure and interrogation, the victim of hate crime refused to report the case to the police.
«Փինք Արմենիա» ՀԿ-ի ծրագրի համակարգող Մարինե Մարգարյանը, բերելով բռնության դեպքերից մեկի օրինակը, նշեց, որ վերջերս, երբ գեյ տղան բարում է եղել, հաճախորդներից մեկը, ով իմացել է, որ նա գեյ է, մոտեցել է նրան, կողքը թքել ու հարվածելով կոտրել քիթը: Գեյ երիտասարդը ելնելով նրանից, որ ոստիկանությունում այդ ամենը պետք է բացատրեր եւ մանրամասն նկարագրեր, չի դիմել ոստիկանություն:

Հարցին, թե ավելի շատ տղամարդի՞կ, թե՞ կանայք են բռնության ենթարկվում, Մարինե Մարգարյանը պատասխանեց. «Մեզ ավելի շատ դիմում են տղամարդիկ բռնության դեպքերով: Այսպես ասեմ. մեզ դիմում են տարբեր հարցերով, թե սեռական առողջության հիմնախնդիրներով, թե պահպանակներ ստանալու, թե իրավաբանական խորհրդատվություն ստանալու համար: Իսկ առհասարակ դիմումների թիվը ինչպես նշեցի մոտավորապես 200-ից ավելի է 2011թ-ի ընթացքում»:

Ոստիկանության կողմից նույնասեռական և տրասվիստիտ անձանց իրավունքների խախտումները հիմնականում տեղի են ունենում այգում, որտեղ հավաքվում են նույնասեռական և տրանսվիստիտ մարդիկ: Ոստիկանությունը պարեկային ծառայություն է կատարում այգու տարածքում: Անցորդների կողմից նույնասեռական կամ տրանսվեստիտ անձանց բռնության ենթարկելու դեպքում ոստիկանությունը չի ձեռնարկում որևէ գործողություն այն դադարեցնելու և բռնություն կիրառողին պատասխանատվության համար: Նույնասեռական և տրասվեստիտ անձինք, որոնք սովորաբար գնում են այդ այգի, նշել են, որ ոստիկանությունում ֆիքսել են իրենց հեռախոսահամարները, և երբ իրենք զանգահարում են բռնության կամ ծեծի դեպքում, ոստիկանությունը չի պատասխանում: Կան գրանցված դեպքեր, երբ ոստիկանները անհանգստացնում են այգում գտնվող նույնասեռականներին և տրանսվեստիտներին: Ոստիկանությունը նրանց պրովոկացիայի է ենթարկում և ապա բռնության:

Դեպք
Քաղաքացու հագուստով մի ոստիկան ոստիկանական մեքենայով մոտեցել է այգու մոտ կանգնած մի տրանսվեստիտ անձնավորության և սկսել հայհոյել և հարցնել, թե ինչ էր անում նա այնտեղ` օգտագործելով վիրավորական և նվաստացուցիչ խոսքեր: Ոստիկանը դուրս է եկել մեքենայից և սկսել ծեծել նրան: Ապա նա վերադարձել է իր մեքենան և հեռացել: Զոհը գնացել է ոստիկանական բաժանմունք` բողոք ներկայացնելու, սակայն ոստիկանությունում հրաժարվել են ընդունել իր բողոքը: Թեև տուժողին տրամադրվել է իրավաբանական ծառայություն ՀԿ-ի կողմից, նա հրաժարվեց շարունակել գործը, քանի որ վախենում էր ոստիկանության գործողություններից, որոնք կարող էին նախաձեռնվել հետագայում:

Ոստիկանությունը այգում հետևում է նույնասեռական և տրասվեստիտներին, և երբ տեսնում են նրանց տղամարդու հետ, սպառնում են այդ անձին, որ եթե իրենց գումար չտա, ապա կզանգեն նրա բարեկամներին, կայցելեն հարևաններին և բոլորին կասեն, որ նա այգում է եղել նույնասեռականի կամ տրանսվեստիտի հետ: Չնայած տուժողները գիտակցում են, որ ոստիկանները ոտնահարում են իրենց իրավունքները` նրանք վախենում են բողոքարկեն, քանի որ չունեն անվտանգության երաշխիքներ: Բացի այդ, եղել է նաև դեպք, երբ տրանսվեստիտը բողոք է ներկայացրել ընդդեմ ոստիկանի, և ոստիկանը նրան գումար է առաջարկել իր բողոքը ետ վերցնելու համար: Չնայած, որ տուժողը չի վերցրել գումարը, նա հետ է վերցրել իր բողոքը կրկին անվտանգության երաշխիքներ չունենալու պատճառով:

Բացի վերոնշյալ դեպքերից, կան նաև դեպքեր, երբ առանց որևէ իրավաբանական հիմնավորման նույնասեռական կամ տրանսվեստիտ անձանց տարել են ոստիկանական բաժանմունք: Այնտեղ նրանց պահում են մի քանի ժամ, և բաց են թողնում այն ժամանակ, երբ տուժողները նրանց կաշառք են տալիս: Սովորաբար ոստիկանության այս գործողությունները ուղեկցվում են բանավոր և ֆիզիկական
բռնությամբ: Տեղեկություններ չկան, թե արդյոք ոստիկանության այդ գործողությունները հավանություն են ստացել բարձրաստիճան պաշտոնյաների կողմից, թե նրանք դա անում են սեփական նախաձեռնությամբ: Իրենց իրավունքների պաշտպանության նպատակով ՀԿ-ն գրանցում է մարդու իրավունքների ոտնահարման
այսպիսի դեպքերը և փորձում է կանխել դրանք ջատագովության միջոցով, քանի որ իրավունքների պաշտպանությունը հնարավոր չէ իրականացնել դատական կարգով` այս պահին տուժողների կողմից պաշտոնական դիմումների բացակայության պատճառով:

2011թ.-ի դեկտեմբերին ոստիկանությունը 10 տրանսվեստիտների բերման է ենթարկել մաշկային և վեներական հիվանդությունների դիսպանսեր` սեռական ճանապարհով փոխանցվող վարակների նկատմամբ հարկադիր ստուգման: Ստուգումից հետո նրանցից 3-ը ազատ են արձակվել, իսկ մյուսները բերման են ենթարկվել ոստիկանական բաժանմունք, որտեղ նրանք պահվել են մինչև առավոտ: Ոստիկանները տուժողներին ներկայացրել են, որ կատարում են վերադաս մարմիններից ստացված հրամանն, այն է` ստիպեն նույնասեռական և տրանսվեստիտ անձանց լքել այգին և չհավաքվել այտեղ, և որ սա նպատակին հասնելու առաջին քայլն էր: Չնայած, որ տուժողները չհամաձայնեցին բողոք ներկայացնել` ՀԿ-ն դիմում է ուղարկել Մարդու իրավունքների պաշտպանի գրասենյակ և Գլխավոր դատախազություն: Երկու
հաստատությունների պատասխանն այն էր, որ նրանք դեպքը ուղղորդել են Հայաստանի Հանրապետության ոստիկանություն: Տվյալ դեպքը դեռ ընթացքի մեջ է:

Այս դեպքը հիմք ծառայեց ԶԼՄ-ների տարածած այն տեղեկատվությանը, որ Երևան քաղաքի նոր քաղաքապետ Տարոն Մարգարյանը որոշոլ է "մաքրել այգին և վերադարձնել այն <<նորմալ>> քաղաքացիներին: Չնայած, որ քաղաքապետի կողմից նման պաշտոնական հայտարարություն չի արվել` քաղաքապետարանի կողմից այլ տեղեկատվություն չի տրամադրվել, որը կհաստատեր կամ կմերժեր այն, և կներկայացներ քաղաքապետի իրական դիրքորոշումն այս հարցի շուրջ: Քաղաքապետարանը հրաժարվում է լրագրողներին տալ ցանկացած մեկնաբանություն: Բացի այդ ՀՀ ոստիկանության պետ Վովա Գասպարյանը հարցազրույց է տվել, որի ժամանակ լրագրողների այն հարցին, թե ինչ է նա անելու այգում հավաքվող նույնասեռական և տրանսվեստիտ անձանց հետ, նա պատասխանել է, որ դեռ չի անրադարձել, բայց կանրադառնա այդ հարցին և ասել է լրագրողներին, որ ինքն աջակցում է այս մարդկանց դեմ նրանց պայքարին:

ԶԼՄ-ներ

ԶԼՄ-ների ներկայացուցիչները մեծ հետաքրքություն ունեն ԼԳԲՏ համայնքի նկատմամբ: Ցավոք, շատ դեպքերում ԼԳԲՏ հիմնահարցերի վերաբերյալ կողմնակալ լուսաբանումները` հիմնված լրագրողների նախապաշարմունքների և կարծրատիպերի վրա, չունեն գիտական հիմք և ձևակերպված են սկանդալային ոճով: ԼԳԲՏ մարդկանց հիմնահարցերը շոշափվում են բոլոր տեսակի ԶԼՄ-ների կողմից: Շատ հաճախ այս թեման իր լուսաբանումն է գտնում էլեկտրոնային լրատվամիջոցներում:

Ընդհանուր առմամբ, զանգվածային լրատվամիջոցներում ԼԳԲՏ համայնքին վերաբերող հարցերը լուսաբանվում են վիրավորական կերպով, ինչը հաստատում է գոյություն ունեցող կարծրատիպերն ու նախապաշարմունքները ԼԳԲՏ համայնքի նկատմամբ: Տրամադրված տեղեկատվությունը հիմնված չէ փաստերի վրա, չունի ապացույցներ և շատ հաճախ կարող է լինել ասեկոսների և ապատեղեկացվածության արդյունք:

Բացի այդ, ԼԳԲՏ մարդկանց, սեռական կողմնորոշման, գենդերային ինքնության մասին ոչ հուսալի և սուբյեկտիվ տեղեկատվության տարածումը հոդվածների, հեռարձակումների, հեռուստատեսային ծրագրերի միջոցով ստորացնում են ԼԳԲՏ մարդկանց և նպատակ ունեն ագրեսիա տարածել նրանց նկատմամբ:

Մեծամասամբ ԼԳԲՏ անձանց հիմնահարցերը ներկայացված են որպես մի երևույթ, որը դեմ է հայկական ավանդույթներին, արժեքներին, և չի կարող ունենալ իր տեղը հասարակության մեջ: Ավելին, շատ հաճախ այն դիտարկվում է ազգային անվտանգության շրջանակներում:

Այն դեպքում, երբ լուսաբանվում են մանկապղծության և սեռական բռնությունների հետ կապված հարցեր, լրագրողները փորձում են կապել դրանք նույնասեռականության և ԼԳԲՏ մարդկանց հետ և մեղադրել նրանց նման տեսակի գործողությունների մեջ: ԶԼՄ-ները ներկայացնում են ԼԳԲՏ մարդկանց որպես մանկապիղծներ և մեղադրում են նրանց սեռական բռնության մեջ:

Մի շարք դեպքերում հարցազրույց վերցնելիս լրագրողները չեն պահպանել ԼԳԲՏ մարդկանց գաղտնիությունը, և անտեսել են այդ անձի ձայնը փոխելու և դեմքը ցույց չտալու մասին նախնական պայմանավորվածությունը: Այս դեպքերից ոչ մեկում լրագրողները չեն պատժվել, քանի որ այդ մարդիկ վախենում էին հրապարակայնությունից:

Համեմատած այլ տեսակի ԶԼՄ-ների հետ, հեռուստատեսությունը ամենահոմոֆոբն է: ԼԳԲՏ մարդկանց հետ կապված բոլոր հեռարձակումները տարածում են ատելության կոչեր և խթանում են նրանց նկատմամբ ատելության ոճիրների իրագործումը:

Եկեղեցի

Ի տարբերություն նախորդ տարիների, այս տարի եկեղեցին անրադարձավ մեր հասարակությունում ԼԳԲՏ մարդկանց հիմնահարցին և´ ԶԼՄ-ների, և´ մոլությունների թեմայով քննարկման կազմակերպմամբ` այդ թվում ներառելով նույնասեռականությունը որպես մոլուցքի տեսակ: Եկեղեցու ներկայացուցիչների կողմից կազմակերպված քննարկման ընթացքում թմրանյութերի, ալկոհոլի և ծխախոտի նկատմամբ մոլության հետ մեկտեղ գլխավորապես քննարկվեց «արվամոլությունը»: Դրա հիմնական նպատակը քննարկման մասնակիցներին բացատրելն էր, որ նույնասեռականությունը մոլության տեսակ է, և մարդիկ իրենք են ընտրում «ունենալ մոլուցք տղամարդկանց նկատմամբ»: Նույնասեռականությունը ներկայացվում էր որպես անհատի մեղսավոր ընտրություն, ով հակված է նույն սեռի այլ անձի նկատմամբ մոլուցք ունենալ:

Քննարկումից բացի քահանաները տարբեր հարցերի շուրջ տրված հարցազրույցների և կազմակերպված մամլո ասուլիսների ժամանակ հայտարարություններ են կատարել: ԶԼՄ-ների միջոցով եկեղեցու ներկայացուցիչները ներկայացնում են ԼԳԲՏ մարդկանց որպես սպառնալիք մեր երկրի համար` նշելով, որ դա «Եվրոպական արժեքների ու ավանդույթների» ուղղակի հետևանք է: Եկեղեցու մոտեցումը նույնասեռականների նկատմամբ այն է, որ նրանք Հայաստան են ներխուժել «Արևմտյան ուժերի» միջոցով, որպեսզի ոչնչացնեն հայկական ավանդույթներն ու արժեքները: Թեև լրատվամիջոցների գործունեության հիմնական շեշտը նույնասեռականությունը և դրա հետ կապված հարցերը չեն, եկեղեցու ներկայացուցիչներն օգտագործում են թեման բարձրացնելու այդ հնարավորությունը և ներկայացնում են ԼԳԲՏ մարդկանց որպես հասարակության մեջ առկա մի շարք սոցիալական խնդիրների աղբյուր: Ընդհանուր առմամբ կարող ենք ասել, որ եկեղեցին հակված է ներկայացնելու ԼԳԲՏ մարդկանց որպես մի խումբ, որն արհեստականորեն ստեղծվել է Հայաստանում, և որի հիմնական նպատակն է այլասերել գոյություն ունեցող արժեքները, թուլացնել հասարակության միասնականությունը և տանել հայերին դեպի անբարոյականություն: Եկեղեցու դիրքորոշումն այս հարցում այն է, որ դա մեղք է, բոլոր ԼԳԲՏ մարդիկ մեղսագործ են և ապրում են հակաքրիստոնեական կյանքով: Հիմնական զուգահեռներն անցկացվում են «Սոդոմի և Գոմորի» հետ, և նույնասեռականությունը ներկայացվում է որպես Սոդոմական մեղք:

Կրոնական փոքրամասնությունները ևս սպառնալիք են համարվում հայ ժողովրդի և Հայ առաքելական եկեղեցու համար և նրանց հիմնական նպատակն է խաթարել Առաքելական եկեղեցու դերը: Այս համատեքստում եկեղեցու ներկայացուցիչները օգտագործում են հնարավորությունը զուգահեռներ անցկացնելու ԼԳԲՏ մարդկանց հետ և ներկայացնում են նրանց որպես վտանգ Հայաստանի ազգային անվտանգության
համար, որոնք, կրոնական փոքրամասնությունների հետ միասին Հայաստան եկան այն ոչնչացնելու համար: Եկեղեցին հեղինակություն է հանդիսանում մեր հասարակության մեծամասնության համար: Այսպիսով, եկեղեցու կողմից նման հայտարարությունները խթանում են թշնամանքը ԼԳԲՏ մարդկանց նկատմամբ և հասարակության համար ամուր հիմք են պատրաստում այս սոցիալական խմբի դեմ պայքարելու համար` փաստելով եկեղեցու հեղինակությունը և այդ հաստատության կողմից արված փաստարկները:

Հանրային վերաբերմունք

«Հանրային տեղեկատվություն և գիտելիքի կարիք» (ՓԻՆՔ Արմենիա) ՀԿ-ն անցկացրել է «ԼԳԲՏ անձանց հանդեպ հանրային վերաբերմունքը Երևան, Գյումրի և Վանաձոր քաղաքներում 2011» հետազոտությունը: Ըստ հետազոտության արդյունքների` հարցվածների ընդամենը 6.3%-ն է ԼԳԲՏ անձանց համարում խոցելի խումբ Հայաստանում: Հարցվածների 18.6%-ը համարում է «ոչ ավանդական» սեռական կողմնորոշումը հիվանդություն, և հարցվածների 72,1%-ի մոտ կարող է դիտարկվել բացասական վերաբերմունք այս սոցիալական խմբի նկատմամբ, և այդ հարցվածների մեծամասնության համար ԼԳԲՏ անձ լինելու ընդունելի լինելը նույնպես կախված է ազգային ինքնությունից: Հետևաբար, հարցվածների 52,7%-ը կարծում է որ ԼԳԲՏ անձ լինելը հարիր չէ հայ ազգին, 66,9%-ը կարծում է, որ ԼԳԲՏ անձինք պետք է դատապարտվեն հասարակության կողմից: Հարցվողները, որոնք ունեն անհանդուրժող վերաբերմունք և դիրքորոշում ԼԳԲՏ անձանց նկատմամբ, զերծ են մնում նրանց հետ շփումից: Նրանցից 55.3%-ը, եթե իմանար, որ իր ծանոթը, ընկերը կամ բարեկամը ԼԳԲՏ անձ է, կդադարեցներ նրա հետ շփումը: ԼԳԲՏ անձանց նկատմամբ իրենց վերաբերմունքն արտահայտած հարցվողների 87,6%-ը նշել են, որ չեն օգտվի այն սպասքից, որից նախկինում օգտվել է ԼԳԲՏ անձ:

Հետազոտության արդյունքներից կարելի է եզրակացնել, որ ընդհանուր առմամբ հարցվածների 49,6%-ը հանդուրժող չեն ԼԳԲՏ անձանց նկատմամբ: Հարցվողների 74,5%-ի համոզմամբ պետությունն իրականում ոչինչ չի անում ԼԳԲՏ անձանց նկատմամբ տարվող իր քաղաքականության մեջ, ուստի 71.5%-ը կարծում է, որ պետությունն այդ բացը պետք է լրացնի նրանց դեմ պայքարելու միջոցով: Ուշագրավ է այն, որ այս համատեքստում հարցվողները ոստիկանությանը առավել շատ դիտարկում են ոչ թե որպես իրավապահ, այլ մարդու իրավունքների դեմ պայքարող մարմին: Հարցվողների մեծամասնությունը չունի բավարար գիտելիք սեռական կողմնորոշման և գենդերային ինքնության մասին և ԼԳԲՏ անձանց վերաբերյալ նրանց ունեցած գիտելիքները կարծրատիպային են և դուրս գիտական բացատրությունների շրջանակից: Հարցվողները ԼԳԲՏ անձանց մասին առավել շատ տեղեկատվություն ստանում են հեռուստատեսությունից. ժամանցային ծրագրերից և հաղորդումներից` 31% և 22.6%` տեղեկատվական հաղորդումներից:

ԼԳԲՏ մարդկանց ծաղրում են, նրանք հաճախ ենթարկվում են ոտնձգությունների հասարակական կյանքի գրեթե բոլոր ոլորտներում, հատկապես այն դեպքերում, երբ նրանց արտաքին տեսքը համապատասխանում է ԼԳԲՏ անձանց վերաբերյալ հասարակության մեջ առկա կարծրատիպերին և նախապաշարմունքներին: Հասարակության արձագանքը նրանց նկատմամբ կարող է տատանվել կոպիտ անուններ կոչելուց մինչև ֆիզիկական բռնության կիրառմամբ, որը կարող է դրսևորվել մեկանգամյա գործողությամբ կամ կրի մշտական բնույթ հարևանների կամ բարեկամների, նույն սոցիալական միջավայրի մարդկանց կողմից: Այս դեպքերում բռնության կամ չարաշահումների զոհերը հրաժարվում են դիմել իրավապահ մարմիններին` փաստելով, որ այդ ամենը կշարունակվի այնտեղ: Այսպիսի դեպքերի վկայությունը կարող են գտնվել այն դեպքերում, երբ շահառուները դիմում են ՀԿ-ին իրավաբանական ծառայություններ ստանալու և իրենց իրավունքները պաշտպանելու համար:

ԼԳԲՏ մարդկանց իրավունքների խախտմանը կարելի է ականատես լինել հասարակական կյանքի տարբեր ոլորտներում: ԼԳԲՏ մարդիկ փաստում են, որ իրենց նկատմամբ խտրականություն կա կրթական հաստատություններում և դեպքեր կան, երբ ուսուցիչը սկսել է նրանց ձեռք առնել կանացի (արական սեռին պատկանելու դեպքում) կամ տղամարդկային լինելու համար (իգական սեռին պատկանելու դեպքում), իրենց սեռական կողմնորոշման պատճառով դուրս են թողել համալսարանից: Գիտական հոդվածներն այս հարցի շուրջ ողջունելի չեն, քանի որ դասախոսների դիրքորոշումն այն է, որ դա այլասերվածություն է, և անձը, ով ցանկանում է աշխատել այս թեմայի շուրջ, այլասերված է: Նույնասեռական ուսանողին թույլ չէին տվել աշխատել նույնասեռականության թեմայի շուրջ, քանի որ դասախոսը գտնում էր, որ հաշվի առնելով ուսանողի սեռական կողմնորոշումը, նա չի կարող լինել օբյեկտիվ:

Աշխատանքի անցնելը ԼԳԲՏ մարդկանց համար մնում է կյանքի ամենախնդրահարույց ասպեկտներից մեկը, քանի որ գործատուները հրաժարվում են աշխատանքի վերցնել մեկին, ով չի թաքցնում իր սեռական կողմնորոշումը, կանացի է (գեյ) կամ տղամարդկային (լեսբուհի):

Տրանսգենդեր անձինք հնարավորություն չունեն արտահայտելու իրենց գենդերային ինքնությունը, և չկա համապատասխան օրենք, որը թույլ կտա տրանսսեքսուալ մարդկանց փոխել իրենց սեռը:

Շատ հաճախ ԼԳԲՏ մարդիկ հրաժարվում են անհրաժեշտության դեպքում դիմել առողջապահական հաստատությունների, քանի որ համոզված չեն, որ այնտեղ կպահվի գաղտնիության սկզբունքը: Քաղաքացիական հասարակության կազմակերպություններին կապվելու դեպքում նրանք ուղղորդվում են այն բժիշկների մոտ, ովքեր վստահելի են և կազմակերպությունը նրանց հետ համագործակցության փորձ ունի, հակառակ դեպքում ռիսկը մեծ է, որ անձը կենթարկվի խտրականության և արժանապատվությունը նվաստացնող վերաբերմունքի:

Բանակում գոյություն ունեցող չգրված օրենքների պատճառով, որոնք ԼԳԲՏ խմբի մարդկանց նկատմամբ սերմանում են խտրական մոտեցում, այդ համակարգը դարձնում են ամենախնդրահարույց կառույցներից մեկը:

Հիմնականում լրատվամիջոցների մոտեցումը ԼԳԲՏ մարդանց նկատմամբ կոմնակալ է և հիմնված կարծրատիպերի, նախապաշարմունքների վրա և չունի գիտական կամ ժամանակակից մոտեցում:

Կառավարության կառույցների կողմից չկա քաղաքական կամք` պաշտպանելու ԼԳԲՏ իրավունքները, և շատ հաճախ այդ կառույցները իրենք են հանդես գալիս իրավախախտների դերում:

Քաղաքացիական հասարակության դիրքորոշումը ԼԳԲՏ անձանց նկատմամբ նույնպես միասնական չէ: Չնայած այն հանգամանքին, որ քաղաքացիական հասարակության կազմակերպությունները կարող են աշխատել ԼԳԲՏ մարդկանց իրավունքների պաշտպանության ոլորտում և գործողություններ ձեռնարկեն փոփոխության հասնելու
համար, կառավարության, հասարակության և քաղաքացիական հասարակության մի մասի կողմից չկա որևէ աջակցություն:

Թեև վերոնշյալ ասպեկտներում չկան արմատական փոփոխություններ, այս զեկույցում մենք ուշադրությունը կսևեռենք հասարակական կյանքի մի քանի ոլորտների վրա, և կներկայացնենք Հայաստանի Հանրապետությունում 2011թ-ին գրանցված ԼԳԲՏ անձանց առավել հաճախ պատահող հիմնահարցերն ու խնդիրները:

Helsinki Association Armenia human rights report 2012: LGBT rights

Helsinki Association in Armenia released its annual Human Rights Report 2012. Perhaps, for the first time, discrimination against LGBT people is covered in a detailed, comprehensive way in a separate “LGBT chapter“. This chapter is prepared by PINK Armenia.

Sub-chapters detail discrimination in various fields, such as education, employment, health care, army, church, police, media and so on.

In a series of posts, Unzipped: Gay Armenia is presenting extracts from the ‘LGBT rights’ chapter divided into relevant sub-chapters, as per described fields. Posts are presented in Armenian, as in original report. If or when English version becomes available, it will be posted too.

Overall, this report depicts a very bleak picture of widespread discrimination against LGBT people in all the fields of life. A very shameful picture for Armenia that needs to be tackled urgently, consistently and comprehensively.

!f Istanbul: Rainbow films

A good selection of LGBT-themed films will be on a showcase at !f Istanbul International Independent Film Festival.
The !f Istanbul International Independent Film Festival was founded in 2001 and every February and March it hosts some 70,000 film buffs and celebrated filmmakers from around the world. Dedicated to showcasing the best in contemporary film, !f believes that the shared experience of cinema is a form of activism that has the power to connect people across borders and boundaries of all description. The festival is curated and based on thematic sections, some of which change every year to reflect issues that are gripping the world's - and filmmakers'- imagination.
With each such event, I am becoming more and more convinced that Istanbul (its European part) is perhaps the most vibrant city in the region, and I have to visit it as soon as possible.

The Pink Report



"Homosexuality is a disease and needs to be treated!" stated Selma Aliye Kavaf, ex-Minister of Family Affairs. The Turkish military considers homosexuality to be a 'psychosexual disorder' that could exempt one from mandatory service, and therefore needs to be diagnosed by military physicians. If a psychological examination is inconclusive, doctors are required to use other methods - either an anal examination is called for or the applicant must submit pornographic images of himself engaged in a homosexual act. The Pink Report is an intimate encounter with four men and their moving stories of institutional violence, tremendous fear and the longing for acceptance within a society that considers them to be ill, rotten, disabled.

Circumstance



"In Iran we have the public face and we have the private face." Circumstance is a sensuous melodrama of forbidden love in modern Tehran. Teenagers Atafeh and her best friend, Shireen, are experimenting with their burgeoning sexuality amidst the subculture of Tehran's underground art scene when Atafeh's brother, Mehran, returns home from drug rehab as the prodigal son. Battling his demons, Mehran joins the morality police. As Atafeh falls deeper in love with her best friend, Mehran's disapproval grows. Suddenly, the two siblings are entangled in a triangle of suspense, surveillance, and betrayal. Though Circumstance is an unrelenting look into how religious authoritarianism forces its way into people's intimate lives, it also has an underlying beat that reminds the viewer of that unconquerable desire for personal freedom, and its will to life.

Becoming Chaz



A story of love, courage and being what you need to be. Intimate and nakedly honest, Becoming Chaz follows Chaz Bono's transition from female to male. Growing up as Sonny and Cher's daughter Chastity in a body he felt wasn't his own, Chaz decides to undertake gender transition. As hormone shots give way to top surgery, we follow Chaz and girlfriend Jenny's lives as they watch, question, adapt to, and sometimes rejoice about the changes. For Chaz, this is first and foremost a story of liberation. For Jenny, who fell in love with a woman but is now living with a man, there are questions about the nature of enduring love. For Cher, one can see the struggle, but also the strength involved in accepting life decisions made by loved ones. Told up close and with stunning simplicity, Becoming Chaz is first and foremost a film about courage and open minds.

Armenian Defense Ministry Insists No Sexual Assault Incident at Goris Military Base

Epress.am received news of an incident that took place in one of the military bases in Goris last week: apparently a high-ranking officer, entering the base, witnessed three soldiers sexually assaulting another soldier.

As a form of punishment, the officer allegedly shot at the feet of the abusers.

Epress.am spoke with senior public relations officer of the Special Investigative Service at the RA Ministry of Defense Meri Sargsyan, who noted that no such incident took place.

“This information is not true,” she said.

Societal Abuses, Discrimination, and Acts of Violence Based on Sexual Orientation and Gender Identity

Societal attitudes towards homosexuality remained highly unfavorable, with society generally viewing homosexuality as an affliction.

Persons who were openly gay were exempted from military service, purportedly because of concern they would be abused by fellow servicemen. However, the actual exemption required a medical finding via psychological examination that gays possessed a mental disorder, which was stamped in their documents and could affect their future.

According to human rights activists, lesbians, gays, bisexuals, and transgender persons experienced some of the most humiliating discrimination in prisons, where they were forced to do some of the most degrading jobs and separated from the rest of the prison population.

Societal discrimination based on sexual orientation continued to be a problem with respect to employment, family relations, and access to education and health care for sexual minorities.

In an interview with the Iravunk biweekly that appeared in the newspaper's December 24 to 27 edition, Artur Baghdasarian, secretary of the National Security Council that advises the president on national security matters, answered a question on homosexuality stating that, "Such conduct does not fit in with our society. Family and Armenian traditions prevail for people who were the first to adopt Christianity. Those unnatural things are unacceptable to us. I am against limitations of human rights in general. However, I consider homosexuality is extremely dangerous for Armenia." In an interview in the Hraparak daily on December 6, National Police Chief Alik Sargsyan answered a question on the gathering of homosexuals in one of Yerevan's central parks, stating that, "We try to take them to such a place where they won't be seen, but they like to appear in public. We do not practice any violent measures, do not violate human rights, it is their business, but in our city, it is not appropriate for people…I cannot bear them physically." Այսօր Պատերազմի եւ խաղաղության լուսաբանման ինստիտուտի հայաստանյան գրասենյակում նույնասեռական անձինք բարձրաձայնում էին իրենց խնդիրների մասին, որոնց մասին երբեւիցե չեն համարձակվել խոսել: Պատճառները, նրանց ասելով` շատ են: Ի դեպ, այսօրվա քննարկմանը եկել էին բազմաթիվ հայ լեսբուհիներ եւ գեյեր:

Նույնասեռական անձինք կամ ինչպես իրենք են ասում` ԼԳԲՏ համայնքը (լեսբուհի, գեյ, բիսեքսուալ, տրանսգենդեր-խմբ.) խնդիրներ են ունենում բոլոր բնագավառներում: Պատասխանելով «Ա1+»-ի հարցին` «Հանրային տեղեկատվություն ու գիտելիքի կարիք» ՀԿ-ի ղեկավար Մամիկոն Հովսեփյանը նշեց, որ այսօր իրենց համայնքի ներկայացուցիչները աշխատանք հիմնականում կարողանում են գտնել սպասարկման ոլորտում, մյուս դեպքերում ամեն ինչ կախված է հիմնարկի տնօրենից:

Հիմնական խնդիրները, ըստ քննարկման մասնակիցների, ծագում են իրավապահ մարմինների հետ շփման ժամանակ: Շատ հաճախ էլ իրավապահ մարմինները գումար են կորզում նույնասեռական անձանցից` վախեցնելով, թե հակառակ դեպքում հարազատներին կասեն: Դա, ըստ Մամիկոն Հովսեփյանի, առավել ակնհայտ է բանակում, երբ հայտնաբերելով, որ ծառայողներից մեկը նույնասեռական է, նրան ենթարկում են բռնության, հոգեբանական ճնշման, ինչպես նաեւ` լինում են բռնաբարության դեպքեր ոչ միայն զինծառայողների, այլեւ հրամանատարների կողմից:

Նրա ասելով` նույնասեռական զորակոչիկի նկատմամբ ծաղրուծանակը սկսվում է անմիջապես բժշկական ստուգման ժամանակ. «Ես մինչ օրս ոչ մի գրականության մեջ չեմ հանդիպել, որ մարդու սեռական կողմնորոշումը կարող է դալտոնիզմի աստիճանով որոշվել: Չգիտեմ` ինչ-որ ներվային հիվանդություններ են փորձում ստուգել. ասում են` ձեռքդ պարզի. աչքերդ փակ քթիդ փորձի հասնել, եթե ստացվեց, ուրեմն հիվանդ ես»: Դրանից հետո Մամիկոն Հովսեփյանի փաստարկներով` նույնասեռական զորակոչիկին ուղարկում են հոգեբուժարան` որպես հոգեկան հիվանդ բուժման:

ԼԳԲՏ համայնքի ներկայացուցիչ Լուսինե Վայաչյանն էլ նշեց, որ տրանսսեքսուալներն էլ իրենց սեռը փոխելու համար ստիպված են լինում դիմել բազմաթիվ խորամանկությունների, քանի որ բացակայում են այն իրականացնելու օրենսդրական հիմքերը: Իրենց խնդիրների միակ լուծումը նրանց կարծիքով` կլինի այն ժամանակ, երբ կլինեն համապատասխան օրենսդրական նորմեր եւ հասարակության իրազեկումը:

IWPR roundtable - 'I would rather be labeled crazy than be raped in the army’: gay men in Armenia (survey)

The roundtable on LGBT issues in Armenia organized by the Institute for War and Peace Reporting (IWPR) Armenia took place today. IWPR representative Sara Khojoyan opened the session by introducing the organization’s activities and mentioning that this roundtable was organized as a sort of follow-up to an article she had written earlier which described some of the issues LGBT people face in Armenia.

Then, Mamikon Hovsepyan from PINK Armenia (Public Information and Need of Knowledge) NGO introduced the research his organization had conducted and presented in May this year.

The project, called “We and Our Rights,” aimed to collect data concerning cases of discrimination and rights violation toward LGBT (lesbian, gay, bisexual, transgender) people in Armenia and to find out to what extent legislation of Republic of Armenia regulates LGBT rights protection and their responsibilities.

Hovsepyan mentioned that discrimination against LGBT people occurs in all facets of life: at school and at work, in military service, while seeking healthcare services, and so on. He also mentioned that discrimination also occurs in the media — through news stories that ridicule, criticize and demean the lives and experiences of LGBT people in Armenia.

The PINK Armenia representative also referred to incidents of rape and violence in Armenia’s armed forces. Despite the fact that the World Health Organization (WHO) removed homsexuality from their list of mental disorders in 1990, according to Hovespyan, Armenia does not prescribe to the WHO criteria and still labels homosexuality as a mental disorder. Thus, gay men in Armenia can be exempt from military service if they state their sexual orientation.

According to the men surveyed in the report (as women in Armenia don’t serve in the military), they would rather be labelled “crazy” than be subject to rape or violence at the hands of their fellow soldiers or officers.
