Istanbul Gay Pride: my diary of a powerful LGBT civil rights march

Last year Istanbul Pride was violently dispersed. This year it was banned altogether.

I dedicate this post to all the activists who struggle for human rights in Turkey. In solidarity with LGBT people in Istanbul.

I was lucky enough to be in Istanbul on 29 June 2014, with my Armenian friends. We witnessed and participated in perhaps the biggest and unfortunately the last peaceful Pride event happened there.

It was a great inspirational Pride event, a powerful civil rights march. Very political. Very colourful. Very diverse. Like in previous years, there was an abundance of posters in Armenian too.

There was police presence there too, but in contrast to last two years, police was there to protect, not to attack.

Participants of the march were quite critical against increasingly autocratic Erdogan rule. I witnessed quite a few anti-Erdogan messages, slogans and anti-Erdogan mocking during the march. No surprises that Turkey president Erdogan could not bear such displays of freedom, and started crackdown on Istanbul Pride using the full force of his repressive regime.

[...] I was lucky this year to be in Istanbul for gay pride. It was my first time in the city that is so close to Yerevan and yet so far. My girlfriend and I, along with a couple of our gay Armenian friends, planned a short, four-day visit not only to see the city, but also to be there for the pride march. Because unlike other cities where I’ve been that celebrate Pride (Toronto, Montréal, New York, Reykjavik, Dublin), it wasn’t a parade but a march. And there’s a clear difference between the two.

It reminded me of the origins of Pride, of what was fought for and what was gained. And it reminded me of how far we still have to go. […]

Just thousands and thousands of people of all stripes marching, holding signs in Armenian and Turkish (probably in Kurdish too) and so many rainbow flags. […]

And the music that stayed with me the most was the beat of the drums. Men and woman playing various types of drums at different points in the march. This is the sound of a struggle, and this is how you know that what we saw, what we were swept up in (my gay Armenian friends and I) was a march for human rights. [...]

It is therefore with great sadness I note how quickly and to what a devastating effect the situation with human rights has been deteriorated in Turkey, with each passing day under the Erdogan rule.

Police in Karabakh target trendy haircuts to ‘prevent teenagers from turning gay’

Remember 5 or so years ago, police in Armenia targeted emo teenagers? [Degradation and stupidity. Police in Armenia hunts down perceived emo teenagers, confiscates ‘weapons of mass destraction’, oh, sorry, souvenirs]

I also remember that years ago some in Armenia used to say ‘there are no gays in Armenia’, sending me angry messages to change my blog’s name. They no longer make such absurd claims.

Now it’s Karabakh’s turn to get over this farce.

Reports from Karabakh say local police enter hair salons ordering barbers not to make trendy haircuts for teenagers to ‘prevent them turning gay’.
Լեռնային Ղարաբաղում, մասնավորապես մայրաքաղաք Ստեփանակերտում, կարծես թե որոշել են լրջորեն պայքարել նույնասեռականության դեմ եւ այդ գործը սկսել են ոստիկաններին գեղեցկության սրահներ գործուղելով: Իրավապահները վարսավիրներից պահանջում են դեռահասներին աբստրակտ սանրվածքներ չանել` փաստորեն համոզված լինելով, որ մազերի զուսպ ու դասական կտրվածքն է, որ անհրաժեշտության դեպքում կարող է նրանց հետ պահել ոչ ճիշտ ճանապարհից:

If you thought that the absurdity of this situation ends here, you are wrong.

Police spokesman denied reports by saying… ‘there are no gay people in Karabakh’, because apparently people in Karabakh live at frontline and defend borders, that's why they cannot be gay. Killing logic, indeed.
Բայց ահա Լեռնային Ղարաբաղի Հանրապետության ոստիկանության լրատվական ծառայության ղեկավար Ֆելիքս Հարությունյանը կտրականապես հերքեց, թե ոստիկաններն իրենց առջեւ նման խնդիր են դրել: «Բացարձակապես հերյուրանք է, ոստիկանությունը նման գործողություններ չի կատարում, իսկ ինչ վերաբերում է ձեր նշած՝ իբր Ղարաբաղը լցվում է եսիմինչ բնույթի սեռական կողմնորոշում ունեցող մարդկանցով, ապա դա ինձ թվում է, բացարձակ ապատեղեկատվություն է: Ղարաբաղցին 50 կիլոմետր հեռավորության վրա դիրքեր է պահում, այդպիսի երեւույթ չկա, այդպիսի բան չկա Ղարաբաղում, բացառվում է»,- ասաց նա:
What is encouraging here, at least some barbers rejected police demands outright stating that they will continue making haircuts according to their customers' preferences.

Regime manipulates lack of awareness and unsubstantiated fears to attempt at enforcing totalitarian rule, a kind of absurdistan, where they control everything from your body to beyond.

Good to see how much Karabakh police actions are being ridiculed on Armenian social networks. Because their actions are laughable. Their arguments are laughable. They are laughable.

Hate crime in Yerevan: targeted in homophobic attack, then mocked by medical staff

2 staff members of PINK Armenia were among 5 LGBT activists who were attacked in downtown Yerevan by 3 young men on 15 February 2016. The case was reported to the police, although I could not find reference to it on police.am website. As per reports, police is very slow to act on this case.

The attackers first targeted and started beating up a person who they perceived as gay.

As if the hate crime in itself was not bad enough, what is equally disturbing is reported attitude of some medical staff at hospital No.1 where the victim of assaults went seeking medical assistance.

Reports say that medical personnel at hospital No.1 did not provide all the necessary medical assistance. Instead, they mocked the victim of hate crime, suggesting carrying out tests to determine his “deviation”.
Five LGBT activists were beaten on February 15 in Yerevan and were subsequently shown disrespect and treated badly by the staff of the Heratsi hospital complex, Public Information and Need of Knowledge NGO (PINK Armenia) executive director Mamikon Hovsepyan told Epress.am Wednesday, branding the incident a “hate crime.” 
The activists, Hovsepyan said, were attacked by a group of 3-4 unknown assailants Monday evening on a central Yerevan street. In addition to beating the activists, the group shouted profanities related to the sexual orientation of one of the victims.  
In the hospital following the attack, the speaker added, the most seriously injured activist was subjected to mockery and ridicule by the medical staff: “Let's get you a blood test and see if you have any abnormalities we could cure,” Hovsepyan cited a staffer as saying. The hospital also failed to conduct a proper medical examination: “They demanded money, otherwise refusing to treat [the victim]. They carried out some external exams, drew up protocols, and discharged him,” Hovsepyan said. The victims have filed a police report in connection with the attack. They also intend to complain against the medical treatment to the Health Ministry.

Հիվանդանոց դիմած տուժողներից մեկին, Հովսեփյանի փոխանցմամբ, շատ վատ են վերաբերվել: «Արի արյան անալիզ վերցնենք, տեսնենք շեղում ունես, շեղումներդ բուժենք», – ըստ Հովսեփյանի՝ ԼԳԲՏ ակտիվիստին ասել է բժշկական անձնակազմի անդամներից մեկը: ՀԿ֊ի նախագահը նշել է նաև, որ հիվանդանոցում լիարժեք զննում չեն անցկացրել. «Ասել են՝ փող տուր, թե չէ հետազոտություն չենք անի: Արտաքին մի քանի զննում են արել, արձանագրություն գրել են, բայց նրան չեն տվել»։
PINK Armenia issued a statement condemning attack that targeted “5 LGBT activists, including 2 staff members of PINK Armenia”.

It is not clear if the attackers specifically targeted LGBT activists. However, taking into account anti-gay profanities shouted by attackers, PINK Armenia rightly considers this incident as hate crime. In their statement, PINK Armenia indicates that the atmosphere of impunity and inaction by Armenian legal system against previously filed but subsequently discarded hate speech instances and threats contributes to increasing wave of hate crimes in Armenia.

In a strongly worded statement Bekum Democracy Support Centre condemned the attack, as well as police inaction and behaviour of medical staff “which violated the available Armenian legislation and medical ethics”. They demanded that police take immediate actions to find the attackers and to hold them accountable according to the law, and for the Ministry of Health to rectify the unacceptable behaviour of the medical personnel. “We call on civil society groups, human rights activists and international community in Armenia to comprehensively follow up the developments of this case.”

Coalition to Stop Violence against Women issued statement condemning culture of violence:

STATEMENT

The Armenian Gay and Lesbian Association of New York is alarmed that in August 2013 the Armenian police proposed a ban on “promoting non-traditional sexual relationships”, which would effectively target LGBT people in Armenia with prejudice. We call for the President, Prime Minister, and Parliament to strike down any further attempts to legislate discrimination against LGBT Armenians.

After the DIY bar bombing and attack on a cultural diversity march in Yerevan in May of 2012, it was clear that intervention was needed to guarantee human rights. But little has been done. Some LGBT Armenians, productive members of society, have been forced to leave Armenia after the events of last May in order to escape threats to their lives. The DIY firebombers have been sentenced with little more than a slap on the wrist. Recent violent threats against organizations that work for gender equality indicate the need for more protection, not persecution.

The police proposed Article 47.7 to the Administrative Violations Code, which threatened the civil rights of LGBT people and any individual or organization who would discuss LGBT issues in public. Though the bill was withdrawn, it seems it was only because it was poorly drafted, suggesting the motivation was merely an expression by the police of prejudice. The fact that the wording of the bill echoes legislation in Russia is even more disturbing, given the levels of violence waged against LGBT people there since its passage. Now that Armenia has signed on to a Customs Union with Russia, it seems the situation is dire, and that continuing emulation of Russian laws will follow.

AGLA NY and members of the Diaspora have been watching signs of human rights violations in Armenia with growing concern. We now ask the government to follow its own constitution in guaranteeing the rights of all its citizens by taking a stand against any future attempts to legislate against LGBT people.

Նյու-Յորքի հայ գեյերի եւ լեսբուհիների ասոցիացիան (ԱԳԼԱ Նյու-Յորք) մտահոգ է այն փաստով, որ 2013թ. օգոստոսին սկզբում Հայաստանի ոստիկանությունը արգելք առաջարկեց «ոչ ավանդական սեռական հարաբերությունների վերաբերյալ քարոզչության» համար, ինչն արդյունավետ կերպով նախապաշարմունքներով կթիրախավորեր Հայաստանում ԼԳԲՏ մարդկանց: Մենք կո ́չ ենք անում Նախագահին, Վարչապետին եւ ԱԺ- ին վերջ դնել ԼԳԲՏ հայերի նկատմամբ խտրականության օրինականացման ցանկացած այլ փորձի:

2012թ. մայիսին Երեւանում DIY բարի պայթեցումից եւ մշակութային բազմազանության երթի վրա հարձակումից հետո պարզ էր, որ մարդու իրավունքների երաշխավորման համար անհրաժեշտ էր միջամտություն: Բայց շատ քիչ բան արվեց: Մի քանի ԼԳԲՏ հայեր, հասարակության օգտակար անդամներ ստիպված եղան լքել Հայաստանը անցյալ մայիսին կատարված իրադարձություններից հետո` խուսափելու համար իրենց կյանքին սպառնալիքներից: DIY-ը պայթեցնողները դատապարտվեցին դաստակի ապտակից մի փոքր ծանր պատժով: Գենդերային հավասարության համար աշխատող կազմակերպությունների նկատմամբ վերջերս տեղի ունեցեղ բռնի սպառնալիքները ցույց են տալիս, որ կա ավելի շատ պաշտպանության, այլ ոչ թե հալածանքի կարիք:

Ոստիկանությունը Վարչական իրավախախտումների վերաբերյալ ՀՀ օրենսգրքում նախաձեռնել էր Հոդված 47.7-ը, ինչը սպառնում էր ԼԳԲՏ անձանց քաղաքացիական իրավունքներին եւ ցանկացած այլ անհատի կամ կազմակերպության, եթե նրանք հանրայնորեն քննարկեին ԼԳԲՏ խնդիրները: Թեեւ օրինագիծը հետ կանչվեց, թվում է, որ դա արվեց միայն այն պատճառով, որ շատ վատ էր մշակված եւ արտահայտում էր ոստիկանության նախապաշարմունքային դրդապատճառները: Այն փաստը, որ օրինագծի ձեւակերպումը Ռուսաստանի օրենսդրության ընդօրինակումն է, շատ ավելի մտահոգիչ է, հաշվի առնելով օրենքի ընդունումից հետո այնտեղ ԼԳԲՏ անձանց նկատմամբ կատարվող բռնության մակարդակը: Հիմա, քանի որ Հայաստանը ցանկություն է հայտնել միանալ Ռուսաստանի հետ Մաքսային Միությանը, թվում է, որ իրավիճակը սոսկալի է, եւ որ Ռուսաստանի օրենքների կրկնօրինակման գործընթացը կշարունակվի:

ԱԳԼԱ Նյու-Յորքը եւ սփյուռքի ժողովուրդը մտահոգությամբ նկատում են Հայաստանում աճող մարդու իրավունքների ոտնահարուման դեպքերը: Մենք հիմա խնդրում ենք Կառավարությանը հետեւել իր սեփական Սահմանադրությանը` երաշխավորելով իր բոլոր քաղաքացիների իրավունքները, միջոցներ ձեռնարկել ԼԳԲՏ անձանց դեմ ուղղված ցանկացած օրենքի ընդունման հետագա փորձի դեմ:

Any measures to limit LGBT peoples’ freedom of expression and assembly on the basis of their sexual or gender identity would further reflect the Armenian government’s noncompliance with its obligations to promote tolerance towards LGBT people and protect them against discrimination. Dear Mr. Sargsyan,
We are writing to express our concern regarding a proposal for legislative amendments that appeared on the website of the Police of the Republic of Armenia on August 5. The proposals sought to add two articles to the Code of Administrative Offenses outlawing the “propaganda of nontraditional sexual relations,” a move that would be in clear violation of freedom of expression and discriminate against lesbian, gay, bisexual, and transgender (LGBT) people.
The police have since removed the proposal from its website, and media reports indicate that there are no immediate plans for parliament to consider it. However, we are concerned that other institutions may seek to introduce similar proposals and ask that you ensure that such measures are forcefully opposed as incompatible with international human rights law and would not advance for parliamentary debate.
The proposal claimed the ban would “protect” Armenian families. It would impose fines of up to 350 times Armenia’s minimum wage on citizens, public officials, and legal entities who breach the law. The proposal did not define “propaganda” or “nontraditional sexual relations.”
The broad wording of the proposal meant that it could have been used to restrict the rights of human rights organizations, civil society groups, or anyone else who works on issues such as the rights of LGBT people or sex workers. It also would have discriminated against LGBT people on grounds of their sexual orientation and gender identity.
Armenian civil society organizations learned of the proposal only when it was published on the website of the Police of the Republic of Armenia.
Measures such as those proposed by the police are illegal under international human rights instruments that Armenia is obliged to uphold. They impose unjustified – and therefore unlawful – restrictions on the freedoms of expression and assembly, in violation of articles 10 and 11 of the European Convention on Human Rights and articles 19 and 21 of the International Covenant on Civil and Political Rights. Armenia is a party to both. They also violate the international prohibition on discrimination, guaranteed by both instruments.
The Committee of Ministers of the Council of Europe has unanimously adopted a set of recommendations (CM/Rec (2010)5) to member states, including Armenia, on measures to combat discrimination on the grounds of sexual orientation or gender identity. The recommendations invite the member states to ensure that the stipulated principles and measures are applied in national legislation, policies, and practices relevant to the protection of LGBT people. Relevant recommendations are:
  1. Examine existing legislative and other measures, keep them under review, and collect and analyze relevant data, in order to monitor and redress any direct or indirect discrimination on grounds of sexual orientation or gender identity;
  1. Ensure that legislative and other measures are adopted and effectively implemented to combat discrimination on grounds of sexual orientation or gender identity, to ensure respect for the human rights of lesbian, gay, bisexual, and transgender persons and to promote tolerance towards them.
Measures such as those in the proposal directly contradict the Council of Europe recommendations.
Civil society organizations in Armenia have expressed concern over the government’s failure to protect the social, economic and political rights of LGBT people. LGBT people continue to face discrimination in accessing employment and healthcare, as well as violence in the army and in families. The government has yet to pass a law banning hate crimes in Armenia, leaving LGBT people vulnerable to abuses such as the repeated homophobic attacks against the DIY pub during May 2012. A draft law currently under consideration by parliament outlawing discrimination on the grounds of sex, ethnicity, and age omits sexual orientation from its considerations.
Any measures to limit LGBT peoples’ freedom of expression and assembly on the basis of their sexual or gender identity would further reflect the Armenian government’s noncompliance with its obligations to promote tolerance towards LGBT people and protect them against discrimination. They could also possibly condone homophobia and transphobia, which contributes to a climate of hatred and violence.
We call on the Armenian government to support LGBT peoples’ human rights and take actions to curb the passage of any measures that violate the European Convention on Human Rights and other international instruments to which Armenia is party.

Scandalous: Armenia human rights ombudsman targets trans sex workers and cites neo-nazi website as a basis for his statement

Apparently, Armenia human rights ombudsman Karen Andreasyan has solved all the pressing human rights issues in Armenia and now calling for the police... to eliminate prostitution and target in particular trans sex workers and gay cruising area.

It is simply astonishing to see the type of language human rights ombudsman is using, full of discrimination and references to the notion of “morality”.
"It is necessary to eliminate such moral perversity because it is not only immoral, but also illegal" - just an example of kind of wording that the human rights ombudsman (!) using in his statement.
It’s as if in past he was at least trying to act in accordance to his position, but now with Armenia’s decision to join Russia sponsored customs union, ombudsman came out the real self, in full disgrace.

Տևական ժամանակ է, ինչ քաղաքացիները մեզ բողոքում են, իսկ հանրությունը վրդովված է, որ մի շարք անձինք Կոմայգում պարբերաբար զբաղվում են պոռնկությամբ, ինչպես նաև ունենում սեռական հարաբերություններ հենց մանկական այգու տարածքում:

Testing grounds: anti-gay ‘propaganda’ bill proposed, then swiftly withdrawn in Armenia

Last week, a proposal by Armenia police in a form of amendments to the administrative offenses law was published on police.am website for “public consultations”. As per the amendments, hefty fines would be imposed on individuals, officials, organisations or media for “propaganda of non-traditional sexual relations”.

This was effectively a copycat of the exact same wording in similar Russian law. The latter generated an international outrage and resulted in further deterioration of rights of LGBT people and overall human rights situation in Russia. [Amnesty International’s blog drew parallels between Russia and Armenia re homophobia & so called gay 'propaganda' bills.]

As the author and activist Nancy Kricorian tweeted, right to the point: "ARMENIA acting as Russia's "Mini-Me' in proposing gay "propaganda" ban".  

While technically proposed by police, to say that it's Armenia police draft proposal is to say nothing because everyone knows unless it’s sanctioned by Baghramyan 26 (presidential HQ), or at least one of its competing fractions, police wouldn't think of proposing anything.

I call this testing grounds. A blatant attempt by some Russia connected structures and individuals in Armenia to derail the association agreement with the EU.

Initial reaction to the proposal was predominantly negative full of ridiculing police and the draft law. Even people who you would not necessarily consider gay friendly made fun of the published provisions, and the main topic of discussions within the Armenian segment of Facebook was to define, often humorously, the term "non-traditional sexual relations".

Few further points I'd like to make. Since when Armenia police turned into a ‘morality police’? I mean particularly the published “motivation” for developing such bill, i.e. “protecting traditional family values” and so on. They cited one article of the Armenian Constitution that the basis of Armenian society is family, but there is nothing there to suggest “traditional family” in police interpretation.
“ՀՀ Սահմանադրության 35-րդ հոդվածի համաձայն` ընտանիքը հասարակության բնական և հիմնական բջիջն է: Պետությունն իր հերթին միջոցներ է ձեռնարկում ամուր ընտանիք կազմելուն նպաստելու, ընտանիքի համար բավարար կենսամակարդակի, այդ թվում՝ բնակարանի, ինչպես նաև իր քաղաքացիների կենսապայմանների բարելավման համար: Նորանկախ Հայաստանի Հանրապետության համար առավել քան արդիական է հայ ավանդական ընտանիքի մոդելի պահպանման խնդիրը, քանի որ հենց ավանդական բարոյական արժեքների վրա հիմնված ընտանիքն է հանդիսանում մեր ազգապահպանության հենասյունը: Ինտեգրվելով եվրոպական արժեքներին` մենք, կամա թե ակամա, դարձանք ոչ միայն ժողովրդավարության համամարդկային արժեքների կրողը, այլև միաժամանակ ընդունեցինք հայ ազգային մտածողությանը խորթ երևույթներ: Դրանցից մեկը ոչ ավանդական սեռական հարաբերություններն են, որոնք շատ ժամանակ խրախուսվում են հասարակության կողմից` առանց գիտակցելու տվյալ երևույթի արատավոր և կործանարար ազդեցությունը հայ ընտանիքի կազմավորման, ապագա սերունդների հոգեկերտվածքի ձևավորման, դաստիարակության և այլ հարցերում: Այս երևույթն առավել վտանգավոր է դառնում այն բոլոր դեպքերում, երբ ոչ միայն խրախուսվում է, այլև` քարոզվում: Քարոզչական տարբեր մեթոդների կիրառումը նպաստում է նրան, որ երևույթն ընկալվում է որպես գովազդ և սկսում է դիտարկվել ինչպես օրինաչափ և բնական յուրաքանչյուր երևույթ: Այնինչ, բացասական երևույթների նմանօրինակ եղանակներով հրապարակայնացումն ու քարոզչությունը չեն կարող խրախուսվել մի պետության կողմից, որը դարերն ի վեր գոյատևել է ավանդական արժեքների, կայուն ընտանիքի պահպանման շնորհիվ: Մեր պետության առջև ծառացած այս արատավոր երևույթը և դրա հետագա տարածումը կանխելու նպատակով` նախապատրաստվել է «Վարչական իրավախախտումների վերաբերյալ Հայաստանի Հանրապետության օրենսգրքում լրացումներ կատարելու մասին» ՀՀ օրենքի նախագիծը, որը վարչական պատասխանատվություն է նախատեսում ոչ ավանդական սեռական հարաբերությունների քարոզչության համար: Ընդ որում, օրինագիծն առավել խիստ պատասխանատվություն է նախատեսում ոչ ավանդական սեռական հարաբերությունները զանգվածային լրատվության միջոցների օգտագործմամբ քարոզելու դեպքում:” 
They also conveniently ‘forgot’ article 14.1 of the very Constitution they are supposedly basing their proposal on. Let’s then ditch the Constitution altogether and start living under “traditional” laws, whatever that means. And btw, I do not think it’s a police job to interpret the Constitution. Luckily, Armenia is not considered a police state... yet.

Within a matter of one day this draft bill already managed to hurt Armenia's image.  News gone viral internationally and immediate pressure exhorted to withdraw the draft bill from circulation.

The following day police chief withdrew the draft bill citing “shortcomings” and “no priority”.

This is not the end of the story, however. I suspect attempts to introduce similar bills will continue, particularly via parliament. And if this happens, it will only be because ruling regime decided so. If you know the Armenian pyramid of power, you know that Baghramyan 26 controls the parliament and no such decision could be made without president’s ok.

Part II: LGBT activists under attack in Tbilisi: Georgian police and politicians

“Police did a good job”, says Minister of Justice. The reality is they failed to protect the rights of citizens and gave in to the priest lead mob. According to the Public Defender Ucha Nanuashvili, the police failed to take “proper measures” to secure holding of a rally by gay rights activists.

“Considering the sheer number of counter demonstrators, their violent actions and the risk to human safety, Transparency International Georgia considers the police's strategy as wholly inadequate.”

A group of six civil society and watchdog organisation said in a joint statement that "the police failed to take measures to prevent violence, that erupted after thousands of Orthodox activists thwarted gay rights rally in downtown Tbilisi, and accused law enforcement officer of being reluctant to secure holding of rally against homophobia."
It says that the police lacked coordination and their actions to protect anti-homophobia rally from attacks of counter demonstrators were often meager.
“Impression was that the Interior Ministry was more focused on safe evacuation of [anti-homophobia rally] participants from the scene, instead of protecting the rally itself. The police did not show enough efforts to provide security of the participants in the process of the rally,” the statement reads.
“Attitude of police towards participants of rally against homophobia and transphobia was especially alarming. Observers confirm that in conversations between each other policemen were referring to the participants of the rally cynically and derogatively and to some extent were sympathizing with counter demonstrators. Such stance was also felt in their actions,” the statement says. 
Earlier, Georgia PM was highly praised (including on this blog) for standing up for the rights of all citizens, regardless of sexual orientation. But head of parliamentary majority (PM’s coalition) was quick to put blame on LGBT activists and their “donors” and effectively sided with the mob: “Earlier today on Rustavi 2 the Leader of Parliamentary Majority, Davit Saganelidze, stated that Identoba and their donors are responsible for the violent developments that erupted today at the the International Day Against Homophobia: "they, who arranged this provocation, who were sitting in the buses calmly and are responsible for what happened".

Here is a video of the mob attack towards bus escorting LGBT activists. Video shows clearly of what was happening towards those who “were sitting in the buses calmly”. Disgusting, nauseous display of hatred in the heart of Tbilisi. Approved by some politicians, as above.

Georgia’s serving president Saakashvili condemned acts of anti-gay violence in Tbilisi. And now this issue turned into a matter of political battles between Saakashvili and Ivanishvili camps, blaming each other for “provocations” and violence that happened.

"This is a shameful and alarming day for the whole of Georgia and Georgian society. Violent offenders who attacked and severely beaten people planning to express their protests against violence are enemies of Georgia's freedom and statehood. They are offenders and must be punished," National Security Council Secretary Giga Bokeria said on 17 May. "The key problem is the climate in the country.” He then continued that some of the participants in counter-demonstration and their leaders were the ones who were "detained previously for violence but released later from prisons as political prisoners".

PM Ivanishvili said that those who committed violence will be held responsible. Until I see this happens, including priests who were leading the attacks, I will not believe his words on equality and rights of citizens.
PM Bidzina Ivanishvili has condemned violence, that erupted after anti-gay protesters, led by Orthodox clergy, thwarted a rally against homophobia in downtown Tbilisi, and vowed that perpetrators “will be dealt with according to the law”. PM Ivanishvili’s English-language written statement reads: “The right to gather peacefully and to freely express one's opinion is fundamental to our democracy. Every Georgian citizen benefits fully and equally from this right. Acts of violence, discrimination and restriction of the rights of others will not be tolerated, and any perpetrators of such acts will be dealt with according to the law.”

Reported hate crime: trans sex workers beaten by group of youth in downtown Yerevan cruising park

Local media reported Armenia police press release that group of youth attacked [“beaten up”] trans sex workers in downtown Yerevan cruising park (Kom aygi, or pleshka) on 25 September 1.10am. Attackers being questioned by police. Motives of the attack were not explicitly stated in the press release. However, the way the info was presented implies homophobic hate crime. No more details are known, as of now.

Interesting to point out the following: 1. police formally reported the incident. 2 police used acceptable non-discriminatory wording to refer to gay people in Armenian “նույնասեռական”, even though the victims may not necessarily be gay per se, but rather trans sex workers. 3. victims of the crime reported the incident to the police.

What would be more important to find out, however, if the attackers will get formally charged with the crime and persecuted according to the law. This will be a testimony of changes, if any.

Reports of hate crime in Yerevan against transvestite sex workers

News.am reports (confirmed by police) that last night shots were fired from the air gun towards transvestite sex workers in downtown Yerevan’s cruising park Kom aygi (also called Pleshka), in front of the Yerevan municipality. Minor injuries were reported. Suspects - two young guys - were swiftly identified, detained and questioned by police. Investigation is underway.

Media reports presented this crime within the context of latest anti-gay violence in Armenia. Although it has not been confirmed yet that the motives were indeed hate crime, considering the circumstances, it is more than likely. Of course, I cannot exclude the possibility of personal client/sex worker related incident.

In any case, two positive aspects I’d like to point out:

1. Sex workers reported the incidence to the police (in absolute majority of similar cases in past, crimes remained unreported).
2. Police acted swiftly to identify suspects.

Of course, it’s a completely different matter re: how the investigation will be carried out, and whether those who committed the crime will be held accountable before the law.

Neo-nazi attack Diversity march in Armenia capital Yerevan calling it "gay pride"

To mark United Nation's World Day of Cultural Diversity, PINK Armenia and Women's Resource Centre announced a variety of events as part of the Diversity Week. The week should have kicked off with the Diversity march on 21 May to call for respect of... yes, diversity in Armenia.

But the notion of diversity was once again attacked in Armenia in an organised provocation by neo-nazi elements and their supporters. To gain a wider support among masses, they dubbed Diversity march a "gay pride" and fuelled aggression towards marchers by intentionally spreading misleading information.

Neo-nazi elements  attacked marchers encouraged by endorsement of homophobic hysteria and anti-gay violence on a very high state level that followed firebombing of DIY bar. Interestingly, while some participants praised police action during the march, others are of different opinion [Not in my name]. All this happened amid new confirmed reports of attacks towards DIY bar.

Discrimination towards lesbian, gay, bisexual, and transgender people begins with the family. Discrimination towards LGBTs by family members manifests itself through breaking off all contact, kicking them out of the house and disowning them.

Afterwards, discrimination continues in nearly all stages and facets of life: study and work, military service, healthcare and other services, media, entertainment, and so on. Cases of violating anonymity and confidentiality, which more often take place in establishments that provide healthcare services and psychological support, legal bodies or military, are not uncommon.

Intolerance towards LGBT people more so relies on unwritten norms, customs and social memory.

There are cases of rape and even death of LGBT people in Armenia. The majority of LGBTs say that they have never and will never go to the police or law enforcement bodies for protecting their rights, since they not only don’t resolve the issues at hand, but also become the cause for new issues to arise.

Nevertheless, it’s also important to note that the public and the state must take into account its citizens’ individual right to live freely and without violating other people’s rights. However, the more an individual’s external appearance or the way he carries himself reveals his sexual orientation or gender identity, the more serious the level of discrimination can become. Discrimination can manifest itself not only through articulating offensive statements, but also by carrying out physical, sexual and psychological violence.

There is a lack of trust towards professionals in different spheres. For example in healthcare, to overcome the situation, they avoid seeking professional help (a fear of not preserving anonymity and confidentiality). Some LGBT people, if not attempted then at least had thoughts of committing suicide.

On the topic of legal resolution, legislation and international documents that regulate or are connected to eliminating all forms of discrimination against LGBT people, encouraging public tolerance, and protecting LGBT rights were examined. Not only is the justice system that regulates the sector in which LGBT people’s rights should be protected in the Republic of Armenia not united, but also legislative definitions within the boundaries of understanding and the legislation connected to this sector, which would guarantee the possibility of protecting their rights, are actually absent from legislation.

Neo-Nazi movement in Armenia is spreading hate and intolerance toward LGBT people, distributing tracks and disseminating heinous messages to the citizens, which content seek to reject homosexuality. Those movements promote also hate crimes and they have never been banned by the Government or legal bodies.

Police attack gay and trans people in the streets, taking them to police stations. There are many cases when GT people were physically violated at police station or in the streets by policemen. Police also blackmails them and take money for not informing their relatives about their sexual orientation and gender identity.

Gay, bisexual and trans men can be exempted from military service, though not all of them come out with their orientation and instead they go to the army. Violations towards GBT people in the army are committed by their peer and officers usually. There are cases of physical abuse, rape and psychological pressure, and those cases have never been reported by the Ministry of Defense.

In mass media, the cases of pedophilia between adult and underage men is considered as homosexuality, while pedophilia between adult man and underage girl in considered only pedophilia.

Mass media remains as a main hate promoter among society, usually comparing homosexuality with prostitution, sects, diseases, and bringing negative examples while talking about LGBT people.

Armenian Church is one of the homophobic institutions in Armenia. Usually they organize meetings and discussion in Grigor Lusavorich Church and often they use the opportunity to touch the topic of homosexuality, to blame LGBT people. There were cases when participants promoted hate crimes during the meeting and it was accepted by the organizer priests as a right action. During press conferences and interview, regardless of what the interview is about (religious minorities, prostitution, addictions), priests use the opportunity to touch the topic of homosexuality and blame LGBT people.

In 2011, more than 200 LGBT people used services provided by PINK Armenia. Big problem - unreported hate crimes

In an interview with News.am (AM), Marine Margaryan, Project Coordinator at PINK Armenia, sums up the main headlines of their annual report on LGBT situation in Armenia (full report in English - here).

According to Marine, in 2011 more than 200 LGBT people, mainly men, used services provided by PINK Armenia, including legal advice in case of violence and hate crimes.

As an example of unreported hate crimes in Armenia, Marine mentioned recent case of physical and psychological abuse at one of Yerevan bars, when a customer recognised and approached one gay guy there, then spit next to him and broke his nose. However, fearing disclosure and interrogation, the victim of hate crime refused to report the case to the police.
«Փինք Արմենիա» ՀԿ-ի ծրագրի համակարգող Մարինե Մարգարյանը, բերելով բռնության դեպքերից մեկի օրինակը, նշեց, որ վերջերս, երբ գեյ տղան բարում է եղել, հաճախորդներից մեկը, ով իմացել է, որ նա գեյ է, մոտեցել է նրան, կողքը թքել ու հարվածելով կոտրել քիթը: Գեյ երիտասարդը ելնելով նրանից, որ ոստիկանությունում այդ ամենը պետք է բացատրեր եւ մանրամասն նկարագրեր, չի դիմել ոստիկանություն:

Հարցին, թե ավելի շատ տղամարդի՞կ, թե՞ կանայք են բռնության ենթարկվում, Մարինե Մարգարյանը պատասխանեց. «Մեզ ավելի շատ դիմում են տղամարդիկ բռնության դեպքերով: Այսպես ասեմ. մեզ դիմում են տարբեր հարցերով, թե սեռական առողջության հիմնախնդիրներով, թե պահպանակներ ստանալու, թե իրավաբանական խորհրդատվություն ստանալու համար: Իսկ առհասարակ դիմումների թիվը ինչպես նշեցի մոտավորապես 200-ից ավելի է 2011թ-ի ընթացքում»:

Ոստիկանություն

Ոստիկանության կողմից նույնասեռական և տրասվիստիտ անձանց իրավունքների խախտումները հիմնականում տեղի են ունենում այգում, որտեղ հավաքվում են նույնասեռական և տրանսվիստիտ մարդիկ: Ոստիկանությունը պարեկային ծառայություն է կատարում այգու տարածքում: Անցորդների կողմից նույնասեռական կամ տրանսվեստիտ անձանց բռնության ենթարկելու դեպքում ոստիկանությունը չի ձեռնարկում որևէ գործողություն այն դադարեցնելու և բռնություն կիրառողին պատասխանատվության համար: Նույնասեռական և տրասվեստիտ անձինք, որոնք սովորաբար գնում են այդ այգի, նշել են, որ ոստիկանությունում ֆիքսել են իրենց հեռախոսահամարները, և երբ իրենք զանգահարում են բռնության կամ ծեծի դեպքում, ոստիկանությունը չի պատասխանում: Կան գրանցված դեպքեր, երբ ոստիկանները անհանգստացնում են այգում գտնվող նույնասեռականներին և տրանսվեստիտներին: Ոստիկանությունը նրանց պրովոկացիայի է ենթարկում և ապա բռնության:

Դեպք
Քաղաքացու հագուստով մի ոստիկան ոստիկանական մեքենայով մոտեցել է այգու մոտ կանգնած մի տրանսվեստիտ անձնավորության և սկսել հայհոյել և հարցնել, թե ինչ էր անում նա այնտեղ` օգտագործելով վիրավորական և նվաստացուցիչ խոսքեր: Ոստիկանը դուրս է եկել մեքենայից և սկսել ծեծել նրան: Ապա նա վերադարձել է իր մեքենան և հեռացել: Զոհը գնացել է ոստիկանական բաժանմունք` բողոք ներկայացնելու, սակայն ոստիկանությունում հրաժարվել են ընդունել իր բողոքը: Թեև տուժողին տրամադրվել է իրավաբանական ծառայություն ՀԿ-ի կողմից, նա հրաժարվեց շարունակել գործը, քանի որ վախենում էր ոստիկանության գործողություններից, որոնք կարող էին նախաձեռնվել հետագայում:

Ոստիկանությունը այգում հետևում է նույնասեռական և տրասվեստիտներին, և երբ տեսնում են նրանց տղամարդու հետ, սպառնում են այդ անձին, որ եթե իրենց գումար չտա, ապա կզանգեն նրա բարեկամներին, կայցելեն հարևաններին և բոլորին կասեն, որ նա այգում է եղել նույնասեռականի կամ տրանսվեստիտի հետ: Չնայած տուժողները գիտակցում են, որ ոստիկանները ոտնահարում են իրենց իրավունքները` նրանք վախենում են բողոքարկեն, քանի որ չունեն անվտանգության երաշխիքներ: Բացի այդ, եղել է նաև դեպք, երբ տրանսվեստիտը բողոք է ներկայացրել ընդդեմ ոստիկանի, և ոստիկանը նրան գումար է առաջարկել իր բողոքը ետ վերցնելու համար: Չնայած, որ տուժողը չի վերցրել գումարը, նա հետ է վերցրել իր բողոքը կրկին անվտանգության երաշխիքներ չունենալու պատճառով:

Բացի վերոնշյալ դեպքերից, կան նաև դեպքեր, երբ առանց որևէ իրավաբանական հիմնավորման նույնասեռական կամ տրանսվեստիտ անձանց տարել են ոստիկանական բաժանմունք: Այնտեղ նրանց պահում են մի քանի ժամ, և բաց են թողնում այն ժամանակ, երբ տուժողները նրանց կաշառք են տալիս: Սովորաբար ոստիկանության այս գործողությունները ուղեկցվում են բանավոր և ֆիզիկական
բռնությամբ: Տեղեկություններ չկան, թե արդյոք ոստիկանության այդ գործողությունները հավանություն են ստացել բարձրաստիճան պաշտոնյաների կողմից, թե նրանք դա անում են սեփական նախաձեռնությամբ: Իրենց իրավունքների պաշտպանության նպատակով ՀԿ-ն գրանցում է մարդու իրավունքների ոտնահարման
այսպիսի դեպքերը և փորձում է կանխել դրանք ջատագովության միջոցով, քանի որ իրավունքների պաշտպանությունը հնարավոր չէ իրականացնել դատական կարգով` այս պահին տուժողների կողմից պաշտոնական դիմումների բացակայության պատճառով:

2011թ.-ի դեկտեմբերին ոստիկանությունը 10 տրանսվեստիտների բերման է ենթարկել մաշկային և վեներական հիվանդությունների դիսպանսեր` սեռական ճանապարհով փոխանցվող վարակների նկատմամբ հարկադիր ստուգման: Ստուգումից հետո նրանցից 3-ը ազատ են արձակվել, իսկ մյուսները բերման են ենթարկվել ոստիկանական բաժանմունք, որտեղ նրանք պահվել են մինչև առավոտ: Ոստիկանները տուժողներին ներկայացրել են, որ կատարում են վերադաս մարմիններից ստացված հրամանն, այն է` ստիպեն նույնասեռական և տրանսվեստիտ անձանց լքել այգին և չհավաքվել այտեղ, և որ սա նպատակին հասնելու առաջին քայլն էր: Չնայած, որ տուժողները չհամաձայնեցին բողոք ներկայացնել` ՀԿ-ն դիմում է ուղարկել Մարդու իրավունքների պաշտպանի գրասենյակ և Գլխավոր դատախազություն: Երկու
հաստատությունների պատասխանն այն էր, որ նրանք դեպքը ուղղորդել են Հայաստանի Հանրապետության ոստիկանություն: Տվյալ դեպքը դեռ ընթացքի մեջ է:

Այս դեպքը հիմք ծառայեց ԶԼՄ-ների տարածած այն տեղեկատվությանը, որ Երևան քաղաքի նոր քաղաքապետ Տարոն Մարգարյանը որոշոլ է "մաքրել այգին և վերադարձնել այն <<նորմալ>> քաղաքացիներին: Չնայած, որ քաղաքապետի կողմից նման պաշտոնական հայտարարություն չի արվել` քաղաքապետարանի կողմից այլ տեղեկատվություն չի տրամադրվել, որը կհաստատեր կամ կմերժեր այն, և կներկայացներ քաղաքապետի իրական դիրքորոշումն այս հարցի շուրջ: Քաղաքապետարանը հրաժարվում է լրագրողներին տալ ցանկացած մեկնաբանություն: Բացի այդ ՀՀ ոստիկանության պետ Վովա Գասպարյանը հարցազրույց է տվել, որի ժամանակ լրագրողների այն հարցին, թե ինչ է նա անելու այգում հավաքվող նույնասեռական և տրանսվեստիտ անձանց հետ, նա պատասխանել է, որ դեռ չի անրադարձել, բայց կանրադառնա այդ հարցին և ասել է լրագրողներին, որ ինքն աջակցում է այս մարդկանց դեմ նրանց պայքարին:

ԶԼՄ-ներ

ԶԼՄ-ների ներկայացուցիչները մեծ հետաքրքություն ունեն ԼԳԲՏ համայնքի նկատմամբ: Ցավոք, շատ դեպքերում ԼԳԲՏ հիմնահարցերի վերաբերյալ կողմնակալ լուսաբանումները` հիմնված լրագրողների նախապաշարմունքների և կարծրատիպերի վրա, չունեն գիտական հիմք և ձևակերպված են սկանդալային ոճով: ԼԳԲՏ մարդկանց հիմնահարցերը շոշափվում են բոլոր տեսակի ԶԼՄ-ների կողմից: Շատ հաճախ այս թեման իր լուսաբանումն է գտնում էլեկտրոնային լրատվամիջոցներում:

Ընդհանուր առմամբ, զանգվածային լրատվամիջոցներում ԼԳԲՏ համայնքին վերաբերող հարցերը լուսաբանվում են վիրավորական կերպով, ինչը հաստատում է գոյություն ունեցող կարծրատիպերն ու նախապաշարմունքները ԼԳԲՏ համայնքի նկատմամբ: Տրամադրված տեղեկատվությունը հիմնված չէ փաստերի վրա, չունի ապացույցներ և շատ հաճախ կարող է լինել ասեկոսների և ապատեղեկացվածության արդյունք:

Բացի այդ, ԼԳԲՏ մարդկանց, սեռական կողմնորոշման, գենդերային ինքնության մասին ոչ հուսալի և սուբյեկտիվ տեղեկատվության տարածումը հոդվածների, հեռարձակումների, հեռուստատեսային ծրագրերի միջոցով ստորացնում են ԼԳԲՏ մարդկանց և նպատակ ունեն ագրեսիա տարածել նրանց նկատմամբ:

Մեծամասամբ ԼԳԲՏ անձանց հիմնահարցերը ներկայացված են որպես մի երևույթ, որը դեմ է հայկական ավանդույթներին, արժեքներին, և չի կարող ունենալ իր տեղը հասարակության մեջ: Ավելին, շատ հաճախ այն դիտարկվում է ազգային անվտանգության շրջանակներում:

Այն դեպքում, երբ լուսաբանվում են մանկապղծության և սեռական բռնությունների հետ կապված հարցեր, լրագրողները փորձում են կապել դրանք նույնասեռականության և ԼԳԲՏ մարդկանց հետ և մեղադրել նրանց նման տեսակի գործողությունների մեջ: ԶԼՄ-ները ներկայացնում են ԼԳԲՏ մարդկանց որպես մանկապիղծներ և մեղադրում են նրանց սեռական բռնության մեջ:

Մի շարք դեպքերում հարցազրույց վերցնելիս լրագրողները չեն պահպանել ԼԳԲՏ մարդկանց գաղտնիությունը, և անտեսել են այդ անձի ձայնը փոխելու և դեմքը ցույց չտալու մասին նախնական պայմանավորվածությունը: Այս դեպքերից ոչ մեկում լրագրողները չեն պատժվել, քանի որ այդ մարդիկ վախենում էին հրապարակայնությունից:

Համեմատած այլ տեսակի ԶԼՄ-ների հետ, հեռուստատեսությունը ամենահոմոֆոբն է: ԼԳԲՏ մարդկանց հետ կապված բոլոր հեռարձակումները տարածում են ատելության կոչեր և խթանում են նրանց նկատմամբ ատելության ոճիրների իրագործումը:
