Neo-nazi thugs indulge in same-sex 'action' as they attack Diversity march in Armenia capital


Here we are. Some say this looks more like a picture from 'Nazi Pride Parade'. In reality, they are neo-nazi thugs who attacked Diversity march in Yerevan in an organised provocation.

Reports of hate crime in Yerevan against transvestite sex workers

News.am reports (confirmed by police) that last night shots were fired from the air gun towards transvestite sex workers in downtown Yerevan’s cruising park Kom aygi (also called Pleshka), in front of the Yerevan municipality. Minor injuries were reported. Suspects - two young guys - were swiftly identified, detained and questioned by police. Investigation is underway.

Media reports presented this crime within the context of latest anti-gay violence in Armenia. Although it has not been confirmed yet that the motives were indeed hate crime, considering the circumstances, it is more than likely. Of course, I cannot exclude the possibility of personal client/sex worker related incident.

In any case, two positive aspects I’d like to point out:

1. Sex workers reported the incidence to the police (in absolute majority of similar cases in past, crimes remained unreported).
2. Police acted swiftly to identify suspects.

Of course, it’s a completely different matter re: how the investigation will be carried out, and whether those who committed the crime will be held accountable before the law.

EU statement "on recent expressions of intolerance in the Republic of Armenia"

Following the US embassy, UN and Council of Europe statements, the European Union disseminated their statement "on recent expressions of intolerance in the Republic of Armenia" following firebombing of alternative, gay friendly DIY bar in Armenia capital Yerevan, disruption of Diversity march and homophobic hysteria accompanied by endorsement of anti-gay violence and terrorism by some high level officials. [Read an example: Terrorists as ‘national heroes’? The EU Delegation in Armenia rightly stresses that "discriminatory statements from certain politicians and in particular the proliferation of hate speech are worrying."

In a strongly worded statement, the EU Delegation continues that the "lack of official reaction has the potential to encourage a sense of impunity in radical groups, and even possibly threaten democratic development." They remind Armenia authorities of their international and European human rights commitments and urge them to "uphold their commitments to tolerance and non-discrimination in a manner that adequately addresses intolerance as regards homophobia and transphobia".

Local EU Statement on recent expressions of intolerance in the Republic of Armenia (29/05/2012)

The European Union Delegation issues the following statement in agreement with the EU Members States Heads of Mission in Armenia 

The EU Delegation recalls that human rights apply equally to all human beings and underlines the value of non-discrimination and protection of human rights.

At the same time, the EU Delegation is concerned about recent developments, which endanger non-discrimination and protection of human rights in Armenia. The firebombing of a pub in Yerevan and the subsequent disruption of the Diversity March – both portrayed as an anti-LGBT * action by certain radical groups, as well as discriminatory statements from certain politicians and in particular the proliferation of hate speech are worrying. These developments have sparked a new debate about the extent of discrimination and tolerance in Armenia.

The lack of official condemnation and the perception of ineffective law enforcement have raised concern among Armenian civil society, Human Rights Defenders and international observers. This lack of official reaction has the potential to encourage a sense of impunity in radical groups, and even possibly threaten democratic development.

Armenia has committed itself to the respect of human rights, inter alia, as a member of the Council of Europe, in the EU-Armenia Partnership and Cooperation Agreement of 1999 and in the EU-Armenia Action Plan of 2006

The EU Delegation calls on the Armenian authorities to uphold their commitments to tolerance and non-discrimination in a manner that adequately addresses intolerance as regards homophobia and transphobia.

The EU Delegation welcomes the alignment of Armenia with the Declaration by the EU High Representative, Catherine Ashton, on behalf of the European Union on the occasion of the International Day against Homophobia and Transphobia on 17 May 2012.

Disgraced ARF Dashnaktsutyun MP Artsvik Minasyan, who endorsed anti-gay attackers and violence, approved as member of ARF parliamentary group in Armenia

As I am writing this post, reports say that ARF Bureau in Armenia approved Artsvik Minasyan to be member of their parliamentary group. Here we are, a person who endorsed attackers of alternative, gay friendly bar and encouraged anti-gay violence, once again becoming an MP to represent ARF Dashnaktsutyun in the Armenian parliament. With such representation, ARF stains its reputation. I encourage Armenians in Diaspora and ARF members make their discontent known loud and clear. Artsvik Minasyan should be made "not welcome person" in the Diaspora. I urge foreign embassies in Armenia to refrain from giving visas to Artsvik Minasyan, Eduard Sharmazanov and all those MPs and officials who encourage terrorism in Armenia.

Below is my commentary to Ararat magazine few days ago.

“I am glad to hear all these statements by ARF members and groups from the US. They condemn hate crime and homophobia in Armenia using the strongest possible wording. However, one important issue remains untouched: Those ARF MPs who endorsed the attackers and encourage anti-gay violence in Armenia, particularly Artsvik Minasyan and Artur Aghabekyan. Vahan Hovhannisyan spoke of ‘no phobia’ in the ARF, but like others failed to address the actions of members of the very parliamentary bloc he is chairing. Unless ARF Dashnaktsutyun addresses the issue of their disgraced MPs, all these good statements will remain insufficient and will not rectify the damage done to the party’s reputation. The MPs should be openly reprimanded and resign.”

Armenia 'hate attacks' expose anti-gay hatred

AFP - The acrid stench of burnt plastic still hangs in the air at the devastated basement bar, its walls blackened and fixtures melted by intense heat after the fire-bombers staged their nocturnal raid.

The alleged "hate crime" bombing this month of alternative music bar DIY -- popular with Yerevan's young liberals and gays -- has sparked fear and anger in Armenia's small gay community and highlighted deep-rooted homophobia in the conservative Christian ex-Soviet state.

"By terrorising me, they want to give a lesson to others too," said owner Armine "Tsomak" Oganezova amid the ruin of the once-vibrant underground hotspot.

She alleged that the attack was staged by "members of a fascist organisation" who had repeatedly harassed the bar since it opened.

"It seems that today the life of anyone that is different in our country is under threat," she said.

After being caught on surveillance cameras, two Iranian-Armenian brothers aged 19 and 20 were arrested for alleged arson, police said without specifying any political motives.

But within days of the blaze, extremists attacked the bar again, this time spraying swastikas on the walls and burning "No to Fascism" posters put up by well-wishers.

The scandal quickly turned political when local media reported that two lawmakers from the nationalist Armenian Revolutionary Federation (Dashnaktsutiun) party had paid the bomb suspects' bail.

One of them, Artsvik Minasian, was reported as saying that causing damage was wrong but the attackers 
"acted the right way, in the context of our societal and national ideals".

Minasian later denied the lawmakers paid bail, but told AFP that he did petition the court on the attackers' behalf and accused DIY's owner of trying to "artificially aggravate the situation, to become famous".

The political row escalated when the deputy speaker of parliament, Eduard Sharmazanov, gave an interview to local media that appeared to justify the violence.

"As an Armenian citizen and member of (the ruling) national-conservative party, I find the rebellion of the two young Armenian people against the homosexuals... completely right and justified," he was reported as saying, although he did not respond to AFP's requests for clarification.

Leading blogger Mika Artyan said on his Unzipped: Gay Armenia site that the statement "effectively encourages terrorism".

Rights group Amnesty International meanwhile lamented that "the official response to the firebombing in Yerevan is utterly shocking."

Worryingly for Yerevan's lesbians and gays, extremists seemingly untroubled by the possibility of arrest have kept returning to the gutted bar to spit on the walls and throw cigarette butts.

One of them, 17-year-old Hovsep, wearing a swastika pendant over a death's head T-shirt, said he would keep harassing DIY until "these perverts" leave.

"People like Tsomak (Oganezova) should not live among us. She participated in a gay parade in Turkey. She perverts teenagers," he said.

His friend Vahag, 18, accused the bar of being engaged in "open propaganda" for gay rights and said homosexuals should "be shut in their homes".

Civil rights campaigners say there are serious divisions between the conservative majority and the small liberal minority in the small Caucasus state.

"Our society has created certain criteria of what a human should be like. It despises and does not accept those who diverge a little bit from these criteria," said Mamikon Hovsepian, head of campaign group PINK Armenia.

He said that incidents of gay-bashing were common, but the victims are often too afraid to go to the police.

"In the nation's value system, a man and a woman have defined roles and any deviation provokes alarm and resistance," said Narine Khachatrian, a psychology professor at Yerevan State University.

But she said she did not believe that there were organised neo-Nazi movements in Armenia and the recent attacks were the work of individuals.

However a small march supporting "diversity" in Yerevan this week was stopped by around 100 young nationalists singing patriotic songs and hurling abuse -- even though it was not a gay pride event.

"Do not promote perversion in our country," demanded one. "You are not Armenians," shouted another, before a priest intervened to prevent clashes.

Despite the bombing of her bar and the possibility of further violence, Oganezova vowed to remain defiant.

"It's impossible to scare me," she said. "I will fight."

IWPR: "Gay Rights Under Attack in Armenia". Ombudsman has designed a "strategy"?

"Firebombing of bar, and the approval it met with, are telling indicators of hostility towards sexual minorities." - writes IWPR, rightly stressing on pretty scandalous approval of anti-gay violence and terror on a very high official levels.

My attention grabbed, however, the concluding paragraph re Ombudsman office actions:
The office of Armenia’s official human rights ombudsman has designed a strategy to protect sexual minorities, including legal and procedural reforms ensuring access to justice. It has also proposed ways to prevent violence against homosexuals in prisons, to prevent discrimination in the workplace, and to bar anti-gay propaganda from the media.
I knew that Ombudsman office is working on some of the mentioned issues. However, I am not aware of such a comprehensive "strategy" (I wish!). Forgive my scepticism, but until I see it, and not only in paper but in action, I will treat such information with caution.

Statement: Deliberate misinformation to disrupt Diversity March

On May the 21st, 4:15 PM, the Public Information and Need of Knowledge and Women’s Resource Center Armenia NGOs organized a Diversity March in central Yerevan. The march was organized within the scope of the World Day for Cultural Diversity, in order to demonstrate and value cultural, ethnic, human and fauna diversity in Armenia. They had prepared posters about ethnic, racial and fauna diversity, plurality, and cultural diversity. 

Before the march misinformation was spread on social networks, declaring that the event had a hidden motive: that, in fact, it was meant to be a gay-parade. In this regard extremist groups had gathered near M. Saryan’s statue, in order to subject the participants of the event to violence, under the pretext of “patriotism”.

Various NGOs, civic initiatives, representatives of international organizations, as well as refugees living in Armenia, people of various social backgrounds and civic activists were taking part in the event. Chanting fascist slogans, namely “zieg heil”, with threats, profanities, calls for violence and violent acts, the extremists did everything to obstruct the march, terrorizing the participants of the peaceful event. Even the presence of the RA Police did not prevent the aggressive and bigot masses from continuing their attacks and actions. In this situation the Police hardly ensured the security of the participants of the march.

We consider that criminal acts have taken place, namely, apparent propaganda of hate on the basis of discrimination which is forbidden under the RA Constitution, calls for violence and threats. We have numerous video-recordings and photographs, more can be find in the mass media. We demand that law-enforcement bodies find and call to responsibility the organizers and participants of the attacks.

Council of Europe reminds Armenia authorities of their responsibilities to ensure human rights of LGBT people and speak out against intolerance and homophobia by politicians

Against the background of recent incidents and expressions of intolerance towards individuals and groups in Armenia based on their sexual orientation and gender identity the Council of Europe Office in Armenia would like to remind the statement of the Secretary General of the Council of Europe made on 15 May 2012 which reads as follows:

“LGBT people still face intolerant attitudes and social barriers across most, if not all, Council of Europe member states. Recent judgments of the European Court of Human Rights point at unjustified bans or administrative obstacles imposed on gay pride parades. They underline problems related to discrimination in granting social rights such as the right to employment. A number of applications pending before the Court concern the incrimination of “propaganda of homosexuality” and could lead to violations of freedom of expression. The introduction of such legislation has often started at the local or regional level but in recent months is finding an echo at national level in some countries.

The September 2011 report of the Commissioner for Human Rights on discrimination on grounds of sexual orientation and gender identity in the 47 Council of Europe member states highlights a range of additional issues, such as access to health care and education, gender recognition, and recognition of family life. Homophobic statements by politicians are also pinpointed.

Many member states have taken important steps forward in recent years to secure equality before the law for LGBT people, for example in outlawing discrimination on the grounds of sexual orientation, and in recognising same-sex civil partnerships. At European level we have made significant progress with the adoption two years ago of the Committee of Ministers’ recommendation on the issue, and with the conference organised this March as part of the UK Chairmanship.

In the Council of Europe we are responding through our institutions and through the establishment of an LGBT Unit within the Secretariat. The Council of Europe is now working with six countries – Albania, Montenegro, Italy, Serbia, Latvia and Poland - to put in place projects on this topic, and I encourage other countries to join this initiative.

First and foremost, national authorities have a responsibility to ensure that their countries meet international commitments, including responding to negative steps taken at local or regional level. Political leaders also bear the responsibility to speak out immediately and strongly against any demonstrations or statements of intolerance or homophobia, especially those made by other politicians.

The United Nations in Armenia condemns the recent expressions and acts of violence and intolerance towards individuals and groups in Armenia, based on their sexual orientation and gender identity. Such expressions and acts are never justified under any circumstances, and public office should not be used as a platform for promoting discrimination and intolerance. 

The general principles of the Universal Declaration of Human Rights and other United Nations human rights treaties to which Armenia is party, establish clear obligations on the part of States to protect people from discrimination, including on the basis of sex or other status. Where there is tension between cultural attitudes and universal human rights, universal human rights must always take precedence. 

The United Nations in Armenia urges the Armenian authorities to further address the current atmosphere of impunity by swiftly and thoroughly investigating these acts and to afford all persons the protections guaranteed under national and international law.

US embassy condemns continuous violence against DIY, LGBT people in Armenia, urges zero tolerance re hate crimes

The US embassy in Armenia issued a statement condemning the firebombing of DIY bar in Yerevan. The wording of this statement leaves no doubts that US is pretty critical of Armenian authorities handling this hate crime. "Acts of hate should never be condoned by public officials, let alone praised." - says the embassy statement referring to number of MPs and state officials, including ARF Dashnaktsutyun party reps and ruling Republican party spokesman Edurard Sharmazanov, endorsing the attackers and encouraging anti-gay violence. The US Embassy condemns the firebombing of Yerevan's D.I.Y. Club on May 8, 2012, and the continued acts of vandalism against the club. The crime appears to have targeted a sexual minority group.  Armenia’s own constitution prohibits the incitement and use of violence. Using violence against any minority--racial, religious, ethnic or sexual--is unpardonable. Acts of hate should never be condoned by public officials, let alone praised. Regardless of their minority affiliation, all citizens and foreign guests in Armenia enjoy equal protection under Armenia’s constitution and law, so violence against them should be swiftly and firmly prosecuted and the offenders punished. We urge Armenian officials to adopt a zero tolerance policy against all hate crimes and violence directed at minorities in Armenia, and to fulfill their responsibility for according all citizens protection under the law.

Today, in Washington, D.C., Secretary Clinton is releasing the 2011 Annual Human Rights Reports, which call for tolerance of diversity, all types of diversity, based on internationally accepted standards and principles.   You can watch the live broadcast of the release at http://www.state.gov at 10:30am (6:30pm in Yerevan).

In the meantime, the US State Department released its annual Country Reports on Human Rights Practices for 2011 - Armenia

Report says: "Lesbian, gay, bisexual, and transgender (LGBT) persons were subjected to societal abuse and discrimination by military and prison authorities."
Societal Abuses, Discrimination, and Acts of Violence Based on Sexual Orientation and Gender Identity
Societal attitudes toward LGBT persons remained highly negative, with society generally viewing homosexuality as an affliction. Societal discrimination based on sexual orientation and gender identity negatively affected the employment, family relations, and access to education and health care of sexual minorities. Openly gay men were exempt from military service, purportedly because of concern that fellow servicemen would abuse them. However, the actual exemption required a medical finding, by means of a psychological examination, that an individual had a mental disorder; this information was stamped in the individual’s personal documents. According to human rights activists, sexual minorities were frequent targets for humiliating discrimination in prisons, where they were forced to perform degrading labor and separated from the rest of the prison population.
Other Societal Violence or Discrimination
There were no reports during the year of acts of societal violence or discrimination against persons with HIV/AIDS.

The highest level prize - gold medal - that Armenia should be ashamed of...

Earlier, Amnesty International expressed its shock by official Yerevan reaction following firebombing of alternative, gay-friendly DIY bar.

I'd love to see this Olympics becoming a regular annual feature for the Amnesty. Smart idea.

Homophobia Olympics in the Former Soviet Union

In the sporting world, countries from the former Soviet Union are used to winning medals. But in terms of gay rights, the only accolades these countries are winning are the wrong ones.
olympic medalsShort of outright criminalizing homosexuality as was the norm during Soviet times, Russia and most of its former satellite states are increasingly violating lesbian, gay, bisexual, transgender, and intersex (LGBTI) rights. If a 2012 Eurasia Homophobia Olympics were held today, the “winning” countries trampling on the human rights of LGBTI people would be as follows:
Gold Medal: Armenia, for officially (and utterly shockingly) justifying and defending the firebombing of a gay-friendly bar by self-described young “fascists.”
Silver Medal: The Central Asian countries of Turkmenistan and Uzbekistan for continuing to treat homosexuality (among men) as a crime.
Silver Medal: Belarus, for its authoritarian president’s sinister statement that it’s “better to be a dictator than gay.”
Silver Medal: Russia and Moldova, for making it a crime to spread “homosexual propaganda” (aka organize any public LGBTI event) in several regions and cities, most recently in Russia’s second largest city of Saint Petersburg.
Bronze: Georgia, for not protecting gay marchers from angry counter-protesters, including Orthodox priests, and Ukraine, for failing to stop ultra-right hooligans from putting LGBTI activists at risk and marring the capital’s first-ever Pride parade.
No medals for the Baltic states of Estonia, Latvia, and Lithuania, in part, because their competitors are overachievers.
No medals for Azerbaijan, Kazakhstan, Tajikistan, and Kyrgyzstan. That’s far from a compliment, as LGBTI communities in these countries are so marginalized that there aren’t as many opportunities to publicly violate their human rights as in some of the medal-winning countries.
In lieu of medals and certificates, all participating governments will receive a copy of the Amnesty International Annual State of the World Report 2012, releasing today, where their previous award-winning human rights violations are documented.

Armenia Football Federation president Ruben Hayrapetyan ‘against terrorism’ but ‘ready to punish gays and eradicate from society’

Homophobic hysteria in Armenia continues. Now president of Football Federation, MP of the ruling Republican party Ruben Hayrapetyan, reflecting firebombing of DIY bar, says he “condemns terrorism” but “in favour of punishing gays and ready to do it myself”. “We should think of another way of punishing to eradicate them from our society.” Someone on Facebook proposed new nickname for him - ‘fascist Rubo’.
Այսօր Aravot.am-ը ՀՖՖ նախագահ, ԱԺ պատգամավոր Ռուբեն Հայրապետյանից հետաքրքրվեց, թե DIY ակումբը պայթեցնելու դեպքի մասին ի՞նչ կարծիք ունի եւ ինքը պայթեցնողների՞ կողմնակիցն է, թե՞ ակումբի պաշտպանների: Նա պատասխանեց. «Նախ, ցանկացած ժամանակ տեռորը դատապարտված է իմ կողմից եւ վատ բան է: Իհարկե, դեմ եմ պայթեցնելուն, բայց միասեռականներին պատժելուն ես երկու ձեռով եմ կողմ եւ պատրաստ եմ նույնիսկ անել դա»:   
Պարոն Հայրապետյանը չի ընդունում ակումբը պայթեցնելու միջոցով միասեռականներին եւ լեսբուհիներին պատժելու տարբերակը: Նրա խոսքերով՝ «Դա պատժելու ձեւ չի: Ավելի ուրիշ ձեւ պետք է մտածել՝ նրանց այս հասարակությունից ուղղակի վերացնել: Դրանց դեմ ամեն ձեւ էլ կարելի է պայքարել՝ բացի տրաքացնելուց ու պայթեցնելուց»: 
Երեւանում բազմազանության երթ, որը շատերը «գեյ շքերթ» են համարել, անցկացնելու մասին տեղեկությանը Ռուբեն Հայրապետյանի սիրտը չդիմացավ: Նա բռնեց սիրտն ու ասաց. «Խնդրում եմ ես ձեզ, նենց բաներ եք ասում, որ ես վատանում եմ: Ես այս երկիրն ու ժողովրդին շա՜տ եմ սիրում, վախեցա»: 

Armenia ombudsman "condemns incidents of intolerance and violence against homosexuals and others"

Not the strongest statement and made after days of silence... still good to hear (at last!) statement from someone who is supposed to be the chief human rights defender in Armenia.

Օմբուդսմենը դատապարտում է համասեռականության նկատմամբ եւ այլոց դեմ բռնության եւ անհանդուրժողականության դեպքերը

Ընդհանրապես համասեռականության նկատմամբ եւ այլոց դեմ անհանդուրժողականության, իրավապաշտպանների նկատմամբ դրսեւորված որոշակի բռնության կամ անհանդուրժողականության դեպքերը մենք խստորեն դատապարտում ենք: Այս մասին NEWS.am-ի թղթակցի հետ զրուցում ասաց Մարդու Իրավունքների պաշտպան Կարեն Անդրեասյանը արձագանքելով DIY ակումբի հրկիզմանը եւ դրան հաջորդող իրադարձություններին:

«Նաեւ շատ անընդունելի են տարբեր անձանց դիրքորոշումները, որոնք հնչում են հասարակությունում, ովքեր կամ պաշտպանական կոչերով են հանդես գալիս կամ հավանություն են տալիս բռնություններին եւ այն գործողություններին, որոնք խտրականություն կամ ատելություն են սերմանում տարբեր խմբերի, այդ թվում սեռական, կրոնական փոքրամասնությունների նկատմամբ: Որեւէ կերպ չնպաստելով կամ չցանկանալով որոշակի քարոզչության մասնակցել միեւնույն ժամանակ մենք հասկանում ենք, որ քաղաքակիրթ, քրիստոնյա, Եվրոպական հասարակությունում թշնամանք ու անհանդուրժողականությունը պարզապես անընդունելի է»,- ընդգծեց օմբուդսմենը:

Նա հավաստիացրեց, որ իրենց արագ ահազանգման խումբն ավելի արագ եւ օպերատիվ է արձագանքել DIY ակումբի հրկիզմանը, քան այլ մարմիններ:

«Հիմա մենք ունենք գրավոր բողոք: Այդ բողոքը վարույթում է եւ մենք համապատասխան պետական մարմիններին հարցումներ ենք արել: Իսկ մեր դիրքորոշումը հետեւյալն է, որ բնականաբար ցանկացած բռնություն դատապարտելի է, բայց տվյալ դեպքում մենք սպասում ենք պետական մարմինների դիրքորոշմանը, թե արդյոք կհիմնավորվի, որ բացի միջանձնային հարաբերություններից եղել են այլ մոտիվներ, շարժառիթներ, որոնցով հանցագործություն կատարած անձիք հարձակում են գործել ակումբի վրա: Եվ, եթե լինեն այլ մոտիվներ, քան ուղղակի միջանձնային հարաբերությունները, որոնք կպատժվեն համապատասխան օրենքով` կլինի մեր ավելի կոնկրետ հայտարարությունը այդ խնդիրների վերաբերյալ»,-նշեց Կարեն Անդրեասյանը:

Հարցին, թե ինչ ելք է առաջարկում ստեղծված իրավիճակում, երբ հասարակությունը բաժանվել է հակամարտող խմբերի, ՊԻ պաշտպանը պատասխանեց. «Ես առաջարկում եմ թուլացնել այս էսկալացիան, որը կարծում եմ որոշակի առումով նաեւ արհեստածին է եւ երկու կողմերին կոչ եմ անում, որպեսզի դադարեցնեն սրումը` այն իմաստով, որ կա մեր հասարակությունում ագրեսիվ երկփեղկվածություն: Խնդրում եմ երրորդ կողմերին դադարեցնել խտրականության կամ ատելության մեկնաբանություններն ու հրահրումները: Սպասենք, որպեսզի ոստիկանությունը եւ դատախազությունը օրենքի շրջանակներում անեն նորմալ քննություն եւ պատժեն մեղավորներին»:

Հարցին, թե ինչպես է գնահատում ոստիկանության գործողությունները, որոնք DIY ակումը հրդեհողներին ազատ է արձակել, իսկ ակումբի վրա 2-րդ եւ 3-րդ հարձակումների փաստի առթիվ քրգործեր չի հարուցել, օմբուդսմենն արձագանքեց. «Մենք գիտենք, որ նախապատրաստման փուլում է: Գործով նաեւ գրավ կա: Այսինքն մեղադրյալների հետ աշխատանք տարվում է: Ես ուղակի ի պաշտոնե իրավունք չունեմ միջամտել նախաքննությանը եւ մենք սպասում ենք ոստիկանության եւ դատախազության գործողություններին»:

Անդրադառնալով Երեւանում «Բազմազանության շքերթի» անցկացմանը եւ այն խոչընդոտող խմբի գործողություններին, Կարեն Անդրեասյանն ասաց. «Ես կարծում եմ, որ հասարակության ցանկացած խումբ իրավունք ունի խաղաղ միջոցներով, երթերով, ցույցերով արտահայտել իր դիրքորոշումները, պատկերացումները, ցանկությունները: Միեւնույն ժամանակ այդ պատկերացումների հետ անհամաձայն մարդիկ էլ իրավունք ունեն քաղաքակիրթ ձեւով իրենց դիրքորոշումները արտահատել: Ես դեմ չեմ, որ հանրապետության տարածքում լինեն տարբեր տեսակի հավաքներ, ցույցեր, երթեր այս կամ այն դիրքորոշումների օգտին, բայց այդ ամենը չպետք է անցնի վայրիության, այլոց բարոյականության, այլոց իրավունքների չարաշահման դաշտ եւ ես կարծում եմ, որ բոլոր խմբերը, որոնք իրենց ազատորեն արտահայտում են մեր քաղաքակիրթ երկրում կկարողանան այնպես դա անել, որպեսզի չխախտեն օրենքը եւ մեր միջազգային պարտավորությունները»:

LA-based Gay and Lesbian Armenian Society - GALAS shocked and disturbed by hate crimes towards LGBT people in Armenia, calls for resignation of ARF and ruling party MPs endorsing attackers

Gay and Lesbian Armenian Society of Los Angeles Condemns Recent Hate Crime in Armenia 

The Gay and Lesbian Armenian Society (GALAS), based in Los Angeles, California, is shocked and disturbed by recent acts of hate targeting the gay and lesbian community of Armenia. On May 8, 2012, Molotov cocktails were used to fire-bomb DIY, a gay-friendly bar in the heart of Yerevan, Armenia. This violent act was captured on a nearby security camera, which shows several men vandalizing the building and throwing incendiary devices through the windows. Following this unfortunate event, a stream of acrimonious attacks occurred against the gay and lesbian community of Armenia on social media, namely Facebook and YouTube.

The Board of Directors and the membership of GALAS strongly condemn these hateful attacks; clear examples of discrimination, and oppression based solely on a person’s sexual orientation.

The response by members of The Armenian Parliament has been equally atrocious. Artsvik Minasyan, who represents the Armenian Revolutionary Federation (Dashnaktsutyun), posted bail for one of the suspects who were charged with the fire-bombing. Afterwards, Minasyan said to Panorama news agency that the suspects “…acted the right way, in context of our societal and national ideals.” We reject his actions and call upon the Armenian Parliament and Dashnaktsutyun to reprimand Minasyan and condemn his actions. Furthermore, we seek for his immediate resignation or removal from office for his incitement of homophobia, and his endorsement of hate crimes. We further request a statement from the Armenian Parliament and the Dashnaktsutyun stating that neither organization will stand by those who foster hate and intolerance. Let not those who have faced the reality of intolerance and hatred inflict it upon others, no matter what the “context of our societal and national ideals.”

For the same reasons, GALAS is calling for the immediate resignation or dismissal of Eduard Sharmazanov, spokesperson for Armenia’s ruling Republican Party and Parliament Vice Speaker who told Hayots Ashkharh newspaper that, “As an Armenian citizen and member of [the ruling] national-conservative party, I find the rebellion of the two young Armenian people against the homosexuals … completely right and justified…”

GALAS denounces these reprehensible statements made by officials that fuel discrimination and unjustified crimes against innocent people. Citizens must hold their elected officials accountable for their irresponsible rhetoric that creates hatred and fear, and leads to disastrous consequences.

GALAS stands united with its gay and lesbian brothers and sisters, and all who care for justice and a free society, one that is a model of tolerance and mutual respect of fundamental human rights and freedoms.

Neo-nazi attack Diversity march in Armenia capital Yerevan calling it "gay pride"

To mark United Nation's World Day of Cultural Diversity, PINK Armenia and Women's Resource Centre announced a variety of events as part of the Diversity Week. The week should have kicked off with the Diversity march on 21 May to call for respect of... yes, diversity in Armenia.

But the notion of diversity was once again attacked in Armenia in an organised provocation by neo-nazi elements and their supporters. To gain a wider support among masses, they dubbed Diversity march a "gay pride" and fuelled aggression towards marchers by intentionally spreading misleading information.

Neo-nazi elements  attacked marchers encouraged by endorsement of homophobic hysteria and anti-gay violence on a very high state level that followed firebombing of DIY bar. Interestingly, while some participants praised police action during the march, others are of different opinion [Not in my name]. All this happened amid new confirmed reports of attacks towards DIY bar.

Homophobes bring the reputation of Republic of Armenia into disrepute (discredit) - Lurer.com editorial

Excellent editorial by Armenian online news outlet Lurer.com reflecting last week events following neo-nazi firebombing of alternative, free-spirited gay friendly DIY bar in Armenia capital Yerevan and the reactions that followed. Particularly, number of ARF Dashnaktsutyun and ruling Republican party MPs, including spokesman of the party Eduard Sharmazanov, endorsing firebombers and encouraging anti-gay violence in Armenia. The editorial particularly stresses that these state level officials are in breach of the Armenian  Constitution (and in particular, article 14.1 - see below) and contrary to the letter and spirit of Armenia's international obligations (UN statement against discrimination based on sexual orientation and gender identity and number of other international treaties that Armenia is part of). They bring Armenia's international reputation into disrepute (discredit), says the editorial of Lurer.com.

Article 14.1 Everyone shall be equal before the law.
Any discrimination based on any ground such as sex, race, colour, ethnic or social origin, genetic features, language, religion or belief, political or any other opinion, membership of a national minority, property, birth, disability, age or other personal or social circumstances shall be prohibited.

Ավարտվող շաբաթվա ամեաքննարկվող թեման, համենայնդեպս՝ սոցցանցերում, DIY ակումբի պայթեցումն ու դրա վերաբերյալ տարբեր գործիչների, կազմակերպությունների ու քաղաքացիների հայտարարություններն էին:

Բայց նախ հիշենք իրադարձությունների զարգացման հաջորդականությունը. Նախ DIY ակումբը գիշերով պայթեցվեց, ապա ոստիկանությունը ձերբակալեց պայթեցնողներից երկուսին, հետո ակումբի տնօրեն Ծոմակը հայտարարեց, որ երիտասարդների ազատ արձակման դիմաց գրավը վճարել են ՀՅԴ-ականները, ապա պարզվեց, որ խոսքը ՀՅԴ անդամ Արծվիկ Մինասյանի մասին է: Դրանից անմիջապես հետո DIY ակումբը, որի հիմնական այցելուներն արտասահմանցիներ են, հռչակվեց նույնասեռականների հավաքատեղի և խնդիրը միաժամանակ և՛ քաղաքականացվեց, և ստացավ գաղափարական նշանակություն:

Արծվիկ Մինասյանը ոչ միայն չհերքեց հանցագործություն իրականացրած անձանց ազատության դիմաց գրավ վճարելու մասին լուրերը, այլև հայտարարեց, որ «այդ երիտասարդները շարժվել են մեր հասարակության և ազգային գաղափարաբանության համատեքստում, ճիշտ ձևով»՝ հավելելով, որ «Ծոմակի տեսակը ոչնչացնում է հայ ազգը»:

Facebook-ի օգտատերերի մի մասն Արծվիկ Մինասյանի հայտարարությունները միանգամից որակեց «ֆաշիստական» և «նացիստական» (ի դեպ, ակումբի վրա հարձակում կատարած անձանցից երկուսը հետագայում հայտարարեցին, որ իրենք իրոք ֆաշիստական գաղափարների կրողն են: Ավելին՝ որոշ ժամանակ անց ակումբի պատերին հայտնվեց ֆաշիստական Գերմանիայի հայտնի սիմվոլը՝ սվաստիկան), հակառակ կարծիքն ունեցողներն էլ վերջինիս ֆաշիզմի մեջ մեղադրողներին հռչակեցին «ազգի դավաճան», «բարոյական խեղված նկարագիր ունեցողներ» և այլն: Համաշխարհային դավադրության տեսության կողմնակիցների կարծիքներն էլ տարամիտվեցին: Նրանցից մի մասը կասկածներ էր հայտնում, որ ակումբի պայթեցումը ՀՅԴ-ի նկատմամբ իշխանական պրովոկացիա էր, մյուս մասն էլ ավելի հեռուն գնաց՝ միջադեպում տեսնելով ռուսական, պարսկական, Արևմտյան և այլ բազմապիսի ձեռագրեր: Երրորդներն էլ համոզմունք հայտնեցին, որ սա իշխանությունների կազմակերպած պրովոկացիան է, որի նպատակը մայիսի 6-ին կայացած խորհրդարանական ընտրություններից հասարակության ուշադրության շեղումն է: Վերջիններիս կարծիքը համընկնում էր մի բանում. սա շատ լավ ծրագրված պովոկացիա է:

Արծվիկ Մինասյանի հայտարարություններին հաջորդեց մեկ այլ ՀՅԴ-ական՝ Նվարդ Մանասյանի հարցազրույցը լրատվամիջոցներից մեկին, որտեղ վերջինս ասել էր, թե «ՀՅԴ-ն դեմոկրատական, սոցիալիստական կուսակցություն է, որ գործում է ՀՀ Սահմանադրության համաձայն, որը և արգելում է այլատյացությունը, ուստի անհնար է նման կուսակցությանը մեղադրել նացիոնալիստական լինելու մեջ»: Մանասյանը ասել է նաև, որ DIY-ի խնդիրը քաղաքական խնդիր չէ, այլ քրեական և իրավական գործընթացով պետք է լուծվի:

Ապա Արծվիկ Մինասյանը հանդես եկավ հայտարարությամբ, որոում դատապարտեց «ակումբի սեփականատերերի և նրանց աջակիցների կողմից երևույթի անհարկի քաղաքականացումը և հատկապես ՀՅԴ անվան շահարկումը»:

Սրան էլ հաջորդեց Հայ Հեղափոխական Դաշնակցության «Շանթ» Ուսանողական Միության հայտարարությունը, որում կազմակերպությունը անհանգստություն հայտնեց Երևանի DIY ակումբի պայթեցման վերաբերյալ և դատապարտեց «ատելության ու «անհանդուրժողականության դրդումով կատարված հանցագործ արարքը»:

Թեժ քննարկումները շարունակվում էին, և պատասխանելով գրող Վահան Իշխանյանի հարցին՝ ՀՅԴ Բյուրոյի Հայ դատի գրասենյակի ղեկավար Կիրո Մանոյանը Facebook-ի իր էջում գրեց. «Ես չեմ կիսում իմ ընկեր Արծվիկ Մինասյանի՝ ձեր մեջբերած անձնական համոզումը, որովհետեւ գտնում եմ, որ մեր երկրում ոչ ոք՝ ո՛չ սովորական անհատ-քաղաքացի եւ կամ իշխանավոր-իրավապահ իրավունք չունի ուրիշի վրա բռնանալու»՝ հավելելով, որ «այլապես՝ եթե յուրաքանչյուրս իր կարծիքների, նախասիրությունների կամ ատելությունների համար սկսի բռնություն կիրառել աջ ու ձախ՝ կունենանք լրիվ քաոս եւ անիշխանություն, այլ խոսքով՝ կկորցնենք պետությունը, չի մնա հասարակություն, ժողովուրդ, ազգ եւ դրանց հետ կապված ամեն ինչը։ Ինչ-ինչ պատճառաբանություններով անհանդուրժողական մոտեցումով՝ չի կարելի ազատ քաղաքացիների արդար երկիր կառուցել»։

Թեմայի քննարկումից անմասն չմնացին նաև ՀՀԿ-ականները: Մասնավորապես, կուսակցության մամլո խոսնակ Էդուարդ Շարմազանովը հայտարարեց, թե «բոլոր նրանք, ովքեր փորձում են իրենց պաշտպանության տակ առնել մեր հասարակությունը այլասերող համասեռամոլներին, պղծում են հայերիս ազգային նկարագիրը։ Ես, որպես Հայաստանի քաղաքացի եւ ազգային-պահպանողական կուսակցության անդամ, միանգամայն ճիշտ ու արդարացված եմ համարում երկու հայ երիտասարդների ընդվզումը մեր երկրում այլասերության որջ ստեղծած եւ հասարակությունն իր բարոյական արժեքներից հեռացնելու նպատակ ունեցող համասեռամոլների դեմ»: Հայտնի լրագրող Ծովինար Նազարյանը հանդես եկավ Շարմազանովի սուր քննադատությամբ, որին ի պատասխան վերջինս լրագրողին մեղադրեց լայնախոհ չլինելու մեջ (պարադոքս!) և իր մոտեցումները հիմնավորեց Հին ու Նոր կտակարաններից մեջբերումների շարքով:

Բայց այս ամենի գագաթնակետը ՀՅԴ-ական գեներալ Արթուր Աղաբեկյանի հարցազրույցն եր, որում նա, խոսելով ակումբի պայթեցման ու նույնասեռականության մասին, ասում է. «մեր հասարակությունը, ինչ-որ իմաստով, այո, բավականին անտարբեր է արատավոր այս երեւույթի նկատմամբ, բայց նաեւ հպարտ ու ոգեւորված եմ, որ կան երիտասարդներ, ովքեր անհանդուրժող են հասարակությունն այլասերող համասեռամոլների, աղանդավորների, այլ շեղումներ ունեցող խմբերի հանդեպ»՝ հավելելով. «ես ողջունում եմ, որ հայ երիտասարդները ոչ միայն իրենց ահազանգն են հնչեցնում, այլեւ կոնկրետ քայլերով են պայքարում մեր ազգային արժեքներն ու հավատը խարխլող արատների դեմ: Վստահ եմ, որ արդյունքում շահելու է հայ ժողովուրդը, վերականգնվելու է մեր ինքնության կորցրած հատվածը»: Պարոն Աղաբեկյանն իր հարցազրույցում մի քանի անգամ խոսում է «հայի ինքնության» և նույնասեռականության՝ որպես արատավոր և այդ ինքնությանը վնասող մի բանի մասին՝ այդպես էլ, սակայն, չբացատրելով, թե ինչ ի նկատի ունի ինքը «հայի ինքնություն» ասելով:

Ակումբի պայթեցումն և հոմոֆոբիան դատապարտող հայտարարությամբ հանդես եկան մի շարք հասարակական կազմակերպություններ, այդ թվում՝ միջազգային հեղինակավոր Amnesty International կազմակերպությունը:

Զարմանալի է, սակայն, որ սեռական փոքրամասնությունների նկատմամբ խտրական հայտարարություններով հանդես եկող քաղաքական գործիչներին սուր քննադատության արժանացնողները այդպես էլ չանդրադարձան հարցի իրավական կողմին:

Բանն այն է, որ գոյություն ունի մի հրաշալի փաստաթուղթ, որ կոչվում է Հայաստանի Հանրապետության Սահմանադրություն, որի 14.1. հոդվածում ասված է.

«Բոլոր մարդիկ հավասար են օրենքի առջև: Խտրականությունը, կախված սեռից, ռասայից, մաշկի գույնից, էթնիկական կամ սոցիալական ծագումից, գենետիկական հատկանիշներից, լեզվից, կրոնից, աշխարհայացքից, քաղաքական կամ այլ հայացքներից, ազգային փոքրամասնությանը պատկանելությունից, գույքային վիճակից, ծնունդից, հաշմանդամությունից, տարիքից կամ անձնական կամ սոցիալական բնույթի այլ հանգամանքներից, արգելվում է»:

Եվ ահա, այն մարդիկ, որոնք հանդես են գալիս սեռական փոքրամասնությունների նկատմամբ խտրական հայտարարությամբ, զբաղված են ոչ այլ ինչով, եթե ոչ՝ անարգելով ՀՀ Սահմանադրությունը: Մտահոգիչ է, որ այդ մարդիկ իրենց համարում են ազգի ու պետության, պետականության պաշտպան, տարբեր տարիներին զբաղեցրել և այժմ էլ զբաղեցնում են տարբեր պաշտոններ, սակայն չեն խորշում թքել Սահմանադրության վրա՝ իրենց դարակազմիկ ու հակամարդկային գաղափարներն առաջ տանելու համար:

Ավելին, գոյություն ունի նաև մեկ այլ փաստաթուղթ՝ Սեռական կողմնորոշման և գենդերային ինքնության մասին ՄԱԿ-ի հռչակագիրը, որը 2008-ի դեկտեմբերի 18-ին ներկայացվել է ՄԱԿ-ի Գլխավոր Ասամբլեայում և որի տակ Հայաստանի ներկայացուցիչը ստորագրել է: Հռչակագրում մասնավորապես ասվում է. «Մենք դատապարտում ենք մարդու իրավունքների ոտնահարումը՝ հիմնված սեռական կողմնորոշման կամ գենդերային ինքնության վրա, որտեղ էլ այն տեղի ունենա:… Մենք կոչ ենք անում պետություններին ապահովել սեռական կողմնորոշման և գենդերային ինքնության հիմքով կատարված մարդու իրավունքների ոտնահարումների հետաքննությունը, իսկ մեղավորներին՝ պատասխանատվության կանչել և հանձնել դատարանին»:

Գոյություն ունեն հարցին վերաբերող մի շարք այլ միջազգային փաստաթղթեր, որոնց տակ դրված է Հայաստանի Հանրապետության ներկայացուցչի ստորագրությունը:

Իսկ վերջերս ՄԱԿ-ի գլխավոր քարտուղար Բան Կի Մունը, ելույթ ունենալով ՄԱԿ-ի Մարդու իրավունքների հանձնաժողովում, ասել էր. «Նույնասեռականների նկատմամբ խտրականությունը հարձակում է համամարդկային արժեքների վրա: Նույնասեռականներին, բիսեքսուալներին ու տրանսսեքսուալներին ես մի բան եմ ուզում ասել՝ դուք միայնակ չեք։ Խտրականության և բռնության դեմ ձեր պայքարը հանդիսանում է մեր ընդհանուր պայքարը։ Ցանկացած հարձակում ձեր վրա հարձակում է ՄԱԿ-ի համամարդկային արժեքների ուղղությամբ... Այսօր ես ձեզ հետ եմ... Ու ես բոլոր երկրներին ու ժողովուրդներին կոչ եմ անում հանդես գալ ձեր պաշտպանությամբ»:

Եվ հիմա հարց է առաջանում. մարդիկ, որոնք հանդես են գալիս ՀՀ Սահմանադրության և Հայաստանի ստորագրած միջազգային հռչակագրերի ոգուն և տառին հակառակ հայտարարություններով, գիտակցո՞ւմ են, որ իրենք ոչ միայն խայտառակում են Հայաստանի Հանրապետությունը, այլև հանցագործություն են կատարում… Բան Կի Մունի կոչն ու ելույթը գուցե ձեզ համար «ասնավանի չի», բայց ՀՀ Սահմանադրությունն ու միջազգային պայմանագրերը դուք պարտավոր եք հարգել, պարոնայք:

Արթուր Մինասյան
