Armenia: Leading Human Rights Defender Assaulted (update)

There are some not so surprising developments regarding yesterday's assault towards prominent Armenian human rights activist Mikael Danielyan. Attacker is turning into a "victim", perfectly in line with the expressed concerns that "state connected Tigran Urikhanyan will happily walk away, while the human rights activist, who is known for his criticism of the Authorities, will be left crying for justice". And it seems that police is taking Urikhanyan's take of the story (surprise-surprise!).

Meanwhile, Urikhanyan accuses Danielyan in "throwing indecent remarks at passing-by girls" alleging that "he tried to behave with restrain" at first but Mikael Danielyan continued with swearing and then attacked him first with "some object". Only then Urikhanyan (according to his 'story') put out his gas pistol and "shot into the air". He desparately wants others to understand that he behaved not as a head of political party but as "ordinary Armenian man".

Urikhanyan further alleges that Mikael Danielyan was drunk and perhaps "under the influence of drugs". The best defence is attacking first - it's as old as the earth!

"Seven years, I struggled for stability in the country [Unzipped: Gay Armenia - who would have thought that all these years, days and nights, he was struggling for our country; that's the real 'discovery' for me] and the gradual development, and today it's with the pain I note that the country is in such a situation that financed from abroad, gay rights advocate, half-man with the earrings and hair-tail can put his hands on and throw indecent remarks at Armenian female students and then drunkenly swear at someone who made a remark on his behaviour".

«7 տարի պայքարել եմ Հանրապետությունում կայունության ու աստիճանական զարգացման համար ու այսօր, ցավով եմ նշում, որ երկրում ստեղծվել է այնպիսի վիճակ, որ արտասահմանից ֆինանսավորվող, սեռական փոքրամասնությունների շահերը պաշտպանող, ականջողավոր ու պոչիկավոր կիսատղամարդը կարողանում է ձեռք տալ կամ լկտիություններ տեղալ հայ ուսանողուհիների հասցեին ու դրանից հետո լկտիաբար հարբած հայհոյել իրեն դիտողություն անող մարդուն»,-ավելացրեց Հայաստանի առաջադիմական կուսակցության նախագահ Տիգրան Ուրիխանյանը:

If you even for a moment thought that head of "Progressive Party" Urikhanyan is homophobe or "aggressive towards sexual minorities", you are wrong, oh, you are so wrong. Reading reports further.

In an interview with A1+, Urikhanyan did not deny that he "accused" Mikael Danielyan in "defending gays and destabilising country". "I do not have aggressiveness towards sexual minorities, I am aggressive towards aggressiveness of minorities". Make any sense to you? I think so too, so is A1+ reporter who tried to clarify as to what Urikhanyan meant. "It's out of topic; I am not interested in what others are doing". Very "progressive" idea, indeed.

Ուրիխանյանը չհերքեց այն լուրերը, թե միջադեպի ընթացքում երեկ Միքայել Դանիելյանին մեղադրել է արվամոլներին պաշտպանելու եւ երկիրը ապակայունացնելու մեջ. ՚Ես ագրեսիվ մոտեցում չունեմ սեռական փոքրամասնությունների նկատմամբ, ես ագրեսիվ մոտեցում ունեմ փոքրամասնությունների կողմից կիրառվող բռնություններինՙ: Իսկ ի՞նչ նկատի ունեք` ՚Ա1+ՙ-ի հարցին` Ուրիխանյանը ասաց. ՚Դա թեմայից դուրս է, եւ ինձ չի հետաքրրում, թե ով ինչով է զբաղվումՙ:

Human Rights Watch issued a statement today demanding from Armenian authorities a proper investigation of the circumstances of the attack on Mikael Danielyan.

"The circumstances of the attack on Mikael Danielian suggest that his prominence as a human rights defender was a motive. Given this, the Armenian authorities must consider it as part of a thorough and objective investigation into the attack."

Surprisingly, there are no reports on this incident on RFE/RL. We have not heard yet from Armenian Ombudsman too.

Investigate Whether Mikael Danielian Was Targeted for His

Human Rights Work

(New York, May 22, 2008) – As part of their investigation into yesterday’s assault of a leading human rights defender, the Armenian authorities should investigate the extent to which the victim’s human rights work was a motive for the attack, Human Rights Watch said today. Mikael Danielian, the Chairman of the Armenian Helsinki Association, was wounded by an air gun on May 21, 2008 in Yerevan, the country’s capital. Danielian was not seriously wounded.

“The circumstances of the attack on Mikael Danielian suggest that his prominence as a human rights defender was a motive,” said Holly Cartner, Europe and Central Asia director at Human Rights Watch. “Given this, the Armenian authorities must consider it as part of a thorough and objective investigation into the attack.”

Danielian told Human Rights Watch that at approximately 3 p.m. on May 21, in the afternoon he was riding in a taxi in downtown Yerevan with two of his colleagues. When the taxi stopped at a traffic light, a car pulled up behind the taxi and started to vigorously honk. A young man, Tigran Urikhanian, the former leader of the Armenian Progressive Party, got out of the honking car and approached the taxi. When Urikhanian recognized Danielian, he began swearing at him and allegedly punched him through the open car window. Danielian then got out of the taxi and he and Urikhanian engaged in a serious argument. Danielian then claims that, without warning, Urikhanian shot him with an air gun that fires highly compressed air and is sometimes carried for self defense in Armenia and other countries. Danielian sustained light wounds on his chest and neck, and was treated for a sharp increase in his blood pressure by an ambulance arriving on the scene.

Artur Sakunts, another human rights defender who arrived a few minutes after the altercation began, told Human Rights Watch that he witnessed Urikhanian verbally assault Danielian, calling him a spy and a “shame to Armenia,” because of his human rights work. Sakunts also witnessed Urikhanian and another man slap Danielian in the face again.

Following the incident, Danielian was immediately taken to the central police station, where he gave a statement. The investigator in the case ordered a medical forensic examination of Danielian, which was carried out on May 22.

Armenia faced a serious political and human rights crisis after the presidential elections of February 19, 2008. Armenian police used excessive force and violence to disperse peaceful demonstrators on Freedom Square in Yerevan in the early hours of March 1, while a violent clash between protesters and security forces later that evening left at least 10 people dead, including two security officials.

Տեղի ունցածի առթիվ այսօր հայատարությամբ հանդես է եկել Հելսինկյան Քաղաքացիական Ասամբլեայի Վանաձորի գրասենյակը, որի նախագահ Արթուր Սաքունցը երեկ ականատես է եղել Միքայել Դանիելյանի եւ Տիգրան Ուրիխանյանի վիճաբանության մի հատվածին:

՚ 2008թ. մայիսի 21-ին հրազենային եւ ֆիզիկական ուժի կիրառմամբ հարձակման է ենթարկվել հայտնի իրավապաշտպան Հելսինկյան ընկերակցության նախագահ Միքայել Դանիելյանը: Հարձակումն իրականացվել է մի խումբ մարդկանց կողմից, որոնց գլխավորել է Առաջադիմական կուսակցության նախագահ Տիգրան Ուրիխանյանը: Հարձակվողները սկզբում հրազենային զենք են օգտագործել /գազային ատրճանակ/, այնուհետեւ կիրառել նաեւ ֆիզիկական բռնություններ՝ հարձակումն ուղեկցելով հայհոյանքներով եւ անպարկեշտ արտահայտություններով, որոնք ուղղակիորեն կապված են եղել Միքայել Դանիելյանի իրավապաշտպանական գործունեության հետՙ,- նշված է հայտարարության մեջ:

Statement by Association of Armenian Attorneys and Lawyers of France (in French)

L’Association Française des Avocats et Juristes Arméniens (AFAJA) entend exprimer sa vive émotion et son indignation suite à l’agression armée dont le Président de l’Association Helsinki, Mikael Danielyan, a été victime à Erevan le 21 mai 2008.

Depuis de nombreuses années, l’AFAJA a eu l’occasion de suivre le travail accompli en toute indépendance par Mikael Danielyan et l’Association qu’il dirige et témoigne de son indéfectible engagement pour la défense des droits de l’Homme, quelle que soit l’appartenance politique du pouvoir en place.

L’AFAJA attend des autorités judiciaires l’ouverture d’une procédure impartiale concernant le ou les auteurs de cette agression qui aurait pu avoir des conséquences mortelles et rappelle que l’Arménie ne pourra tenir le rang des nations européennes que si elle demeure capable d’assurer le respect de l’intégrité physique ainsi que la liberté des militants des droits de l’Homme.

«О нападении на председателя Хельсинкской Ассоциации Армении
Микаэла Даниеляна»


Мы, российские правозащитники, глубоко озабочены сообщением о выстреле из травмирующего оружия в нашего коллегу, председателя Хельсинкской Ассоциации Армении Микаэла Даниеляна. Микаэл Даниэлян, один из ведущих правозащитников Армении, хорошо известен в своей стране и международном сообществе своей активной деятельностью по защите прав человека.

По поступающей из различных источников информации, 21 мая в Ереване бывший председатель Прогрессивной партии Армении Тигран Уриханян выстрелил из травмирующего оружия в главу Хельсинкской Ассоциации Армении Микаэла Даниеляна, сопровождая свои действия бранью и обвинениями в работе на иностранные спецслужбы и защите меньшинств. По информации Общественного телевидения Армении, Даниелян получил телесные повреждения. На место происшествия была вызвана полиция и бригада скорой помощи. Дальнейшие обстоятельства выясняются.

Мы выражаем солидарность с Микаэлом. Мы глубоко убеждены, что власти любого государства обязаны обеспечивать условия для нормальной и безопасной работы правозащитников, гражданских активистов и организаций, занимающихся защитой прав человека, и гарантировать эффективную защиту от нападений и угроз.

Мы призываем компетентные органы Армении провести быстрое, независимое и всестороннее расследование обстоятельств этого нападения и привлечь к ответственности виновных.
